SUBJECT:Annexation Request of Grandview Avenue United Methodist Church
Grandview Avenue United Methodist Church has requested City Council review and
approval of a voluntary annexation request. The church has requested annexation of
26.398 acres southwest of John Wesley Drive and north of Asbury Plaza in conjunction
with rezoning to CS Commercial Service and Wholesale District. The property is
currently zoned County A-1 Agricultural.
Planning Services Manager Laura Carstens is recommending that a public hearing be
set for October 21, 2002, on the annexation request. This will allow approval of the
annexation concurrent with the Council's public hearing on the rezoning request.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT:Annexation Request of Grandview Avenue United Methodist Church
INTRODUCTION
This memo transmits a voluntary annexation request by Grandview Avenue United
Methodist Chumh for City Council review and approval. The church has requested
annexation of 26.398 acres southwest of John Wesley Drive and north of Asbury Plaza
in conjunction with rezoning to CS Commercial Service and Wholesale District The
property is currently zoned County A-1 Agricultural. A staff report and a resolution are
attached.
DISCUSSION
The subject property is adjacent to a 20-acre parcel annexed by the church in 1999 for
construction of a new church facility. The subject property can be served by City sewer
and water, which are available from the adjacent church property.
On October 2, 2002, the Zoning Advisory Commission is scheduled to hold a public
hearing on the rezoning request to CS Commercial Service and Wholesale District in
conjunction with the annexation. On October 21, 2002, the City Council would be
scheduled to hold a public hearing on both the rezoning and annexation requests.
The subject property is not needed for church expansion and provides an opportunity
for commercial service and wholesale uses to develop just north of Asbury Plaza. The
church has proposed that access to the subject property be via a future public street to
be constructed for Asbury Plaza. The church is also suggesting that there be no
access to John Wesley Ddve. With access restricted, commercial and residential
traffic would remain separated.
Annexation of the subject property is in conformance with the City's long range goals
and objectives. Annexation will give the City greater control over land use and building
standards on the subject property.

Since the subject property is within two miles of the City of Asbury and the City of
Sageville, the State of Iowa's City Development Board also must approve the
annexation request.
RECOMMENDATION
Staff recommends that the City Council set a public hearing on the annexation request
for October 21, 2002. This will allow approval of the annexation concurrent with the
Council's public hearing on the rezoning request.

RESOLUTION ANNEXING CERTAIN PROPERTY
Whereas, Grandview Avenue United Methodist Church, property owner, has
voluntarily petitioned for annexation of approximately 26.398 acres of property lying outside of
the corporate limits of the City of Dubuque, Iowa as shown in Exhibit A; and
Whereas, Chapter 368 of the Code of Iowa author'~es the extension of City limits in
situations of this character by adoption of a resolution after notification is required by State
regulations; and
Whereas, this request has been found to be consistent with the Comprehensive Plan
and the Future Land Use Map of the Comprehensive Plan; and
Whereas, the future growth and development of the City of Dubuque, Iowa make it
desirable that the property be made part of the city of Dubuque, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the territorial limits of the Dubuque, Iowa by and they are hereby
extended to include the property legally described, to wit:
Lot 1 of Lot 2 of Mineral Lot 459, Section 16, T89N, R2E of 5th P.M. in Dubuque
County.
Section 2. The territory hereby annexed shall become a part of the 6th Precinct of
the 2r~ Ward of the City of Dubuque.
Section 3. That the City Clerk shall file this resolution, all exhibits and the petition
for voluntary annexation with the State of Iowa in accordance with State Regulations.

This letter is wriEen as a request for rezoning as a condition of annexation
of Lot I of 2 of Mineral Lot 459 in Section 16, T89N, R2E, 5th P.M. as
described in our letter to the mayor and City Council dated August 1, 2002.

This 26 acre parcel was purchased as part of a larger 47 acre tract when
Grandview Ave. UMC was seeking a 15 to 20 acre site in the west side of
Dubuque for a new church. Construction has begun on the remaining 20
acres for the new church facility. After much discussion and planning, it
appears the area annexed in 1999, now platted as Barton Randle Addition,
will provide for the church's future expansion needs. Therefore, in order to
provide for appropriate development in the area, we are seeking rezoning
of said lot 1 of 2 of Mineral Lot 459 to the classitication of CS-Commercial
Service.
tn order to keep traffic through Barton Randle Addition residential in nature,
we would like to have the CS zoning prohibit access to John Wesley Drive
or the extension thereof. Since the entire boundary of the proposed
~ffice annexation abuts the ,~,=bury Plaza development, we feel adequate access
$~ Laforml, secretary --~nts--sl~i~uld i~e available from the south or we'st of the Northwest Arterial
and a proposed public street through the plaza. The ravine that runs
through the property would provide a natural area for storm water detention
and a roadway connection.
In summary, Grandview Ave. UMC is seeking a Commercial Service zoning
for Lot I of 2 of Mineral Lot 459 in conjunction with annexation with access
to the parcel through the existing commercial area on the south and west
sides of the site. No access would be allowed from the proposed extension
of John Wesley Drive, which is currently zoned residential.

This letter is wff~ten as a request for voluntary annexation to the City of
Dubuque. Grandview Avenue United Methodist Church has begun construction
on its new facility at 3342 John Wesley Drive, which was annexed in 1999. We
have installed sewer, water and street improvements on the site and anxiously
await the completion of John F Kennedy Road in front of our property.
Gmndview Avenue UMC also owns a parcel immediately southwest of the
current campus which is legally described as
Lot 1 of 2 of Mineral Lot 459
in Section 16, Township 89 North,
Range 2 East of the 5th Principal Meridian
In Dubuque County Iowa.
This 26.398 acre parcel abuts Asbu~J Plaza property on the south and a portion
of the west boundary, and county agricultural land on the west and north. Our
church property and the Dubuque Community Schools property, currently within
the city limits abut on the east side.
In order to adequately serve this 26 acm parcel with sewer, water, police and
fire protection, Grandview Avenue United Methodist Church requests to have
the area annexed to the City of Dubuque.

Traffic Pattems/Counts: Access is proposed to be from a future public street to be
extended through Asbury Plaza. No access would occur off John Wesley Drive,
which provides the pdmary access for the church property to John F. Kennedy
Road. Under this scenario, commercial and residential traffic would remain
separated if the subject property is developed.

Public Services: The site will be accessible to City services upon development
due to its proximity to John F. Kennedy Road and the Northwest Arterial.
Environment: No environmental impacts are expected if adequate erosion control
and storm water management are provided.
Adjacent Properties: Little or no impact on adjacent properties is expected if
access is through Asbury Plaza.
