Schneider and Public Works Director Mike Koch are recommending that the City apply
for a Hazard Mitigation Grant to acquire six properties on Old Mill Road who have
flooded in the past. The federal grant would be for $496,916, with a local match of
$165,638. It will be proposed to the Community Development Block Grant Commission
and subsequently to the City Council that the local match come from Community
Development Block Grant Funds.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Road Damaged Due to Rainstorms
INTRODUCTION
The purpose of this memo is to provide information pertaining to the possible purchasing
of six homes located along Old Mill Road that have suffered damage from rainstorms,
most recently in June of this year.
DISCUSSION
During the June (2002) rainstorm, several homes located along Catfish Creek sustained
property damage due to the creek overflowing its banks. In July, I sent out letters to
residents in that neighborhood to inform them a program exists that through which the
City could possibly secure funds that would enable the City to purchase homes in their
neighborhood. I forwarded you a copy of the letter and a map at that time.
Six of the property owners have since contacted me and expressed interest in the
program. As a result, with the help of Mark Schneider of ECIA who assisted the City
secure funds from the same program to purchase the home at Pennsylvannia and JFK
after the 1999 rainstorm.
Kyle Kritz, acting for the designated floodplain manager, Laura Carstens, estimated that
four (4) of the properties were substantially damaged (>50%). These four properties
stand a better chance of getting funding.
There is a local 15% match that is required. The estimated City share would be
approximately $100,000 to purchase the six (6) properties that have expressed interest.
ACTION STEP
Please provide direction as to the City's level of monetary commitment or how we
should go about getting the Council's guidance.

INTRODUCTION
After the severe rainstorm on June 3-4, three property owners have indicated to various
city staff members that they would be interested in the possibility of selling their property
if the City secured funds available through the Hazard Mitigation Grant Program
(HMGP) administered by the Iowa Emergency Management Division.
DISCUSSION
HMGP funding due to a particular Presidential disaster declaration is limited, Between
15 and 20 percent of the total disaster grants awarded by FEMA is provided to the
State, The current HMGP has approximately $1 million available and there are 21
counties in Iowa that are eligible to apply for the funds.
Individual homeowners and businesses may not apply directly to the program; however,
the City of Dubuque can apply on their behalf.
Engineering has sent correspondence to the three property owners as well as their
neighbors to verify which property owners are interested in the voluntary buyout
program. Please find the attached letter and map. To date; Mr. Biedermann, Mr.
Tirnmons; Mr. Pancratz; Mr. Frazier; Mr. Laufenberg; and Mrs. McDermott have
responded, expressing interest in the program.
The City purchased a home on Pennsylvania Avenue just west of JFK after the
Presidential disaster declaration of 1999under the same program,

Attached you will find the Hazard Mitigation Grant Program apphcation and supporting
documents for your review. I discussed the application with Jeanne Schneider to place it on the
September 16 agenda. The Iowa Emergency Management Division (IEiV[D) informed me in a
recent discussion that apphcations must be submitted to them by October 1, 2002 to be eligible
for the June 2002 disaster fimds. I e-mailed these forms with the exception of the map to Jeanne
for inclusion in the agendas.
I followed up with Deron on the use of CDBG funds for the local match. That is an eligible use
of funds meeting the HUD national objective of imminent threat to health and safety. Further, I
discussed this with the IEMD and was assured that the fimds may be used as matching funds for
this project.
I did talk with all six of the property owners who continue to be very interested in the City
acquiring their properties through the program. I told them that I would follow up with a letter to
briefly outline the process, what they may expect to happen, and an anticipated timeline. I will
copy you with those letters.

Part III - Detailed Description of the Proposed Project
A. Describe the problem: All properties are located in or adjacent to a 100-year floodplain at the
confluence of Catfish Creek and the Middle Fork of Catfish Creek. Several of the properties are
in the floodway. This area experienced flood damage in 1993, flood damage to a greater extent in
1999 with higher flood levels, and the worst flooding in June 2002 with the highest flood levels
ever experienced by the six property owners. In August 2002 the area experienced flooding,
however, it did not reach the levels of the June floods. It is hypothesized that development
throughout much of the City is resulting in faster runoffs and flooding after heavy rainfalls
despite the City's requirements for storm water retention basins and other storm water drainage
work. The area is highly susceptible to ongoing future damage.
B. Detailed description of project: The 100-year floodplain base elevation is 621 feet for
reference.
House #1 had a water-filled basement and 23 inches of floodwater on the first floor of the house
in June 2002. This house is in or immediately adjacent to the floodway. The house suffered
damage to its foundation, furnace and air conditioner and all ductwork (filled with mud and fell
to floor ~ house is without a heating/cooling system), water heater, electrical system, floor and
floor coverings, walls, insulation, and framing components. House damage is estimated $50,000
- $60,000. This does not include the loss of vehic!es and personal items totaling well into the
thousands of dollars. The house also experienced significant flood damages in May 1999 and the
summer of 1993. The basement is not fluished, however it contains the furnace, water heater,
electrical panel, and other house components. The basement elevation is 609 feet and first floor
is 617 feet.
House #2 had seven feet of water in the basement that reached into the floor joists of the first
floor in June 2002. The house suffered damage to its foundation, furnace, water heater, electrical
system, floor, basement ceiling and ceiling insulation, and framing components. House damage
is estimated $30,000 - $40,000. The basement is not finished, however it contains the furnace,
water heater, electrical panel, and other house components. The basement elevation is 612 feet
and first floor elevation is 620 feet.
House #3 had six feet of water in the basement in June 2002. The house suffered damage to its
foundation, furnace, water heater, electrical system and framing components. House damage is
estimated $35,000. The basement is not finished, however it contains the furnace, water heater,
electrical panel, and other house components. The basemenf elevation is 613 feet and first floor
elevation is 621 feet.
Property g4 is a commercial property that had 53 inches of floodwater in June 2002. This
property contains the lowest buildings on Old Mill Rd. and is located in the floodway. The
structures suffered damage to its wall framing, furnace, water heater, electrical system and
insulation. Damage is est/mated at $30,000. The building had 23 inches of floodwater in 1999
and 17 inches in 1993. There is no basement, the floor elevation is 614 feet.
House #5 had severn feet of water in basement in June 2002. The house suffered damage to its
foundation, fianace, water heater, electrical system and framing components. House damage is
estimated $25,000. The basement is partially finished and contains the furnace, water heater,
electrical panel, and other house components. The basement floor elevation is 612 feet and first
floor is 620 feet.

House//6 had no water in it in June 2002. The property lost a chain link fence that washed out.
The basement is mostly finished and contains the furnace, water heater, electrical panel, and
other house components. The basement floor elevation is 619 feet and first floor is approximately
627 feet.
C. Does the project conform with State and Local mitigation goals and/or plans?
Explain: The project conforms with IEMD goals of acquisition of properties suffering
repetitive damages during heavy rains and floods. The City of Dubuque authorized two
citywide storm water studies that have not yet been completed. The studies are focusing on
the Bee Branch storm sewer due to the magnitude of houses that are affected in the north
end of the City during 100-year storm evants. However, the studies also detail the Catfish
Creek storm water drainage basin and affected properties. The City also completed a
Hazard Mitigation Plan that identified the development and adoption ora storm water
control program as one of its top priorities. The Planning Committee focused on the Bee
Branch project due to the high number of homes and businesses directly affected. The
Catfish Creek basin and Old Mill Rd. project was discussed. However, flooding in that area
that has occurred since the t/me of the plarming project was unprecedented. The City now
believes this situation is an immediate health and safety hazard for propc~-y owners and the
public at large and must now be an immediate priority.
D. Will the proposed mitigation measure provide an independent solution to the problem?
Explain: The proposed mitigation will eliminate all slructures in this drainage area that
flood during heavy rains. The acquisition of these properties will eliminate the damages to
private properties that are being experienced in the area. The City contacted all property
owners in this area and six who responded as having received damage are included in this
application.
E. How does the proposed mitigation measure address a repetitive problem or a problem
that poses a significant risk to public health and safety if left unresolved?
Explain: The proposed mitigation measure will only address the repetitive problem and
eliminate the significant risk to public health and safety if all six properties are removed.
The flooding results in two major immediate dangers. First is the danger of being persons
being swept away in floodwaters. The City law enforcement personnel respond to
immediately barricade streets. The second danger is that of electrocution. Homeowners are
warned as quickly as possible with the onset of fiashfloods. However, the greatest danger is
with the commercial property that lies the lowest, is first to flood, and creates the potential
for electrocution via the floodwater. Only the rcunoval of all of these properties will address
this serious public safety issue.
F. Discuss the negative impacts on the area if project is not approved: Negative impacts
include the continued flooding of properties in this area~ As detailed, property owners did
not abandon the properties during the flooding that poses tremendous health and safety
concerns. The continuing structural damage and deterioration and safety concerns,
particularly electrical associated with several feet of water in finished space are a great
concem.

G. Describe damage caused by previous and current disasters and associated costs: The
1993 damage to these six properties was in the $20,000 range. The 1999 damage to these
six properties was in the $35,000 range. The June 2002 damage to these six properties was
in excess of $180,000. Due to existing June 2002 flood damage, it is virtually impossible to
determine damages that would have been caused by the August 2002. Currently the
structures have foundation and structural damages, furnaces that are non-functioning, water
heaters that had to be replaced, damages that exceed fifty percent of the values in four of
the properties. Quite likely there is additional electrical equipment damage that may be
unknown for a period o£time as it was under water. Previous disaster damages include
major damage to basements, including the electrical system, furnace, water heater, etc. that
were submerged in 1999 and 1993. Damages in the past ten years to these properties well
exceed $235,000. Estimates of years prior to 1993 are not available.

I. How often does this type of disaster occur (use historical data): Disasters of this
magnitude occurred in 1993, 1999, and June and August 2002.
J. Est/mated dollar amount of damages prevented by completing project:
Amount: $ 23,500 per year average
Reasonable justification to explain/support the estimate: As detailed above, the
properties sustained in excess of $235,000 in damages resulting from the 1993, 1999, and
June 2002 floods. This does not account for the potential for loss of life and displacement
of property owners. As noted above, it is difficult to estimate damages that would have
been caused by the August 2002 flooding due to existing damage in structures. This
averages approximately $23,500 annually in damages related to flooding over the past ten
years.
K. What is the useful life of the project: Useful life the project is indefinite. The property
will be restricted by covenants and remain open space.

Yes - The City of Dubuque will maintain the open space as part of the City's routine property and
grounds maintenance programs under the Engineering and Park Departments at an estimated
annual cost of $5,000.

Part IV - Discussion of Alternatives:
A. Discuss mitigation alternatives (must discuss 2 alternatives in addition to proposed
project):
Do Nothing: Doing nothing allows for the continued flood damage to these
properties during major storm events. The occurrences are a serious threat to the
health and safety of the residents and others. Therefore, doing nothing was rejected.
Option #1: The City considered constructing a levee / floodwali to protect tiffs area.
This project would cost an estimated $4,000,000, require extensive routine
maintenance and take several years at a minimum to construct due to design and
regulatory approvals. Therefore, this option was rejected.
Option #2: The City considered limiting the acquisition to residential properties.
However, the commercial property lies in the middle and at the lowest elevation of
the area in question. The last storm produced 53-inches of flood water in this
building. It is impossible to elevate this property high enough to protect it from
another flood of the June 2002 magnitude. The flooding has rendered the property
vfftually useless and minimized the value of the property. The City determined that
this property must be acquired in this project and this option was rejected.
Proposed Pro./ect: The acquisition and demolition of these structures in the 100-
year floodplain is the proposed project to eliminate the ongoing damages incurred
during major storm events. In excess of $205,000 of damage resulted since 1993 as
a result of flooding. The acquisition and removal of the structure in the proposed
project will eliminate future damages to the structure and threats to health and
safety of residents.
B. Justify selection of this project over alternatives:
The City rejected Alternatives 1, 2 and 3. Alternative #1 will result in the continued exposure to
property damages and threats to life and safety of residents. The City rejected Alternative #2 due
to the cost / benefit when opposed to Alternative g4. The City rejected Alternative #3 as it would
leave one property to remain in the floodplain. Due to damages and losses incurred, the property
holds virtually no value or potential future use. It is likely that the property will continue to
deteriorate with time and pose a serious health and safety threat to human life. The City does not
desffe to allow this circumstance to occur. Therefore Alternative #4, the proposed project is the
best alternative available to mitigate damages to property and remove the threats to life and safety..

LOCAL MATCH RESOLUTION # 482-02
FOR THE
HAZARD MITIGATION GRANT PROGRAM
WHEREAS, the City of Dubuque (subgrantee), CountY of Dubuque, has made application
through Iowa Emergency Management Division (EMD) to the Federal Emergency Management
Agency (FEMA) for the Hazard Mitigation Grant Program, in the amount of
$ 662:554.00 for the total project, or $ 496.916.00 as the 75 % federal share,
and
WHEREAS, the City of Dubuque (subgrantee) recognizes the fact that this project that is
requested to be funded under the Hazard Mitigation Grant Program is a 75 % federal / 10 %
state / 15 % local matching grant,
and
WltEREAS, the City of Dubuque (subgrantee) shall form an agreement with Iowa ENID and
FEMA as to the date that said 15 % of local funds shall be available to match the federal funds
awarded.
The City of Dubuque (subgrantee) agrees to provide $ 99.383.00 ( ninety nine thousand, three
hundred eighty three dollars) of local monies to be used as matching funds for this Hazard
Mitigation Grant Program project as outlined in the grant application.
