Leisure Services Manager Gil Spence is recommending acceptance of the Five Flags,
Paint Arena Ceiling and Walls Project, as completed by the John C. Kaiser Company, in
the final contract amount of $79,190.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Five Flags, Paint Arena Ceiling and Walls Project
INTRODUCTION
The purpose of this memorandum is to recommend that the City Council accept the Five
Flags, Paint Arena Ceiling and Walls Project.
DISCUSSION
The Five Flags Theater, Paint Arena Ceiling and Walls Project has been completed by the
John C. Kaiser Company in the final contract amount of $79,190. A summary of the project
costs is as follows:

TOTAL $ 71,785.00 $ 79,190.00
The contract called for painting the metal ceiling and metal on the walls. Change order#1
was for painting the concrete block walls in the locker room and concession areas and
change order #2 was for painting the concrete block walls in the arena, and repairing and
painting the blue wall header.
ACTION STEP
The action requested is that the City Council adopt the attached resolutions accepting the
improvement and setting the final cost.

RESOLUTION NO. 523-02
ACCEPTING IMPROVEMENT
WHEREAS, the contract for the FIVE FLAGS, PAINT ARENA CEILING AND
WALLS PROJECT has been completed and the City Manager has examined the work and
filed his certificate stating that the same has been completed according to the terms of the
contract, plans and specifications and recommends its acceptance.
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
1. That the recommendation of the City Manager be approved and that said
improvement be and the same is hereby accepted.
BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby directed
to pay to the contractor from the General Fund in amount equal to the amount of his
contract, less any retained percentage provided for therein.

WHEREAS, the contract for the FIVE FLAGS, PAINT ARENA CEILING AND
WALLS PROJECT has been completed and the Engineer has submitted his final estimate
showing the cost thereof including the cost of estimates, notices and inspection and all
miscellaneous costs;
NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the cost of said improvement is hereby determined to be $79,190,
and the said amount shall be paid from the General Fund of the City of Dubuque, Iowa.
