SUBJECT:Bell Street Construction
At the July 15, 2002 City Council meeting, the City Council set the award of the contract
for the Bell Street Construction Project for the October 7, 2002 meeting. The Iowa
Department of Transportation delayed the bid-letting on the project.
Public Works Director Mike Koch recommends approval of a resolution ordering bids
and setting January 14, 2003, as the new bid-letting date. The award of the project has
been moved to the February 3, 2003 Council meeting, subject to the concurrence of the
Federal Highway Administration. The public hearing has previously been held by the
City Council.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
At the July 15, 2002 City Council meeting, the City Council set the award of the
contract for the October 7, 2002 meeting. Because of an error on the part of the
Iowa Department of Transportation in the performance of the historic review of
the property upon which Bell Street will be located, the Iowa Department of
Transportation delayed the bid-letting on the project.
DISCUSSION
The project consists of the construction of Bell Street from Fifth Street to its
northerly terminus near Pine Street. The pavement will be 41-foot wide concrete,
with curb and gutter. The project also includes the construction and installation
of an ornamental railing located between the back of sidewalk and the existing
parking lot; placement of trees, every 40 feet; installation of irrigation systems and
sidewalks; a recreational trail; historical lighting; and two (2) directional
monuments at the comer of Third and Bell Street, and two (2) at the westerly end
of Fifth Street.
Bell Street from 3rd to Fifth Street and Fifth Street from White Street to Bell Street
also includes the placement of trees, irrigation systems, sidewalks, and historical
lighting behind the existing pavement.
The revised schedule for the project will be as follows:

Award of Contract (subject to FHWA Approval) February 3,2003
RECOMMENDATION
I recommend that the City Council approve the attached resolution, Ordering
Bids, and setting January 14, 2003 as the new bid-letting date. The award of the
project has been moved to the February 3, 2003 Council meeting, subject to the
concurrence of the Federal Highway Administration. The public hearing has
previously been held by the City Council.
ACTION TO BE TAKEN
It is recommended that the City Council approve the attached resolution for
ordering bids for the Bell Street Construction Project.

ORDERING BIDS
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the Bell Street Construction Project is hereby ordered to be
advertised for bids for construction.
BE IT FURTHER RESOLVED, that the amount of the security to
accompany each bid shall be in an amount which shall conform to the provisions
of the Notice to Bidders hereby approved as a part of the plans and
specifications heretofore adopted.
That the City Clerk is hereby directed to advertise for bids for the
construction of the improvements herein provided, to be published in a
newspaper having general circulation in the City of Dubuque, Iowa, which notice
shall not be less than four days nor more than forty-five days prior to the receipt
of said bids at 9:00 a.m. on the 14th day of January, 2003. Bids shall be opened
and read by the Iowa Department of Transportation in Ames, Iowa, after 10:30
a.m. on the same date such as bids are scheduled to be received. The bid will
be submitted to the Council for final action at 6:30 p.m. on the 3rd day of
February, 2003, subject to the concurrence of the Federal Highway
Administration.

NOTICE TO BIDDERS OF THE RECEIPT OF BIDS
FOR THE BELL STREET CONSTRUCTION
Sealed bids will be received by the Iowa Department of Transportation, at
the Department of Contracts in Ames, Iowa and at C.T. Marriott in Des Moines,
Iowa no later than 9:00 o'clock A.M. on the 14th day of January, 2003, for the Bell
Street Construction Project.
Copies of the plans and specifications may be obtained in the Office of
Contracts at the Iowa Department of Transportation in Ames, Iowa until noon on
the previous day of the letting.
Payment to the contractor will be made from funds as may be legally used
for such purposes.
Failure to execute a contract and file an acceptable Performance Bond
and Certificate of Insurance within 30 days of the date of the approval for
awarding the contract, as herein provided, will be just and sufficient cause for the
denial of the award and the forfeiture of the proposal guarantee.
All proposals must be filed on the forms furnished by the Iowa Department
of Transportation, Contracts Office, sealed and plainly marked. Proposals
containing any reservations not provided for in the forms furnished will be
rejected, and the Iowa Department of Transportation reserves the right to waive
technicalities and to reject any or all bids.
A Proposal Guaranty not less than the amount as set forth in the proposal
form shall be filed with each proposal. The Proposal Guaranty shall be in the
form as specified by the Iowa Department of Transportation
The successful bidder will be required to furnish a Performance Bond in
an amount equal to one hundred percent (100%) of the contract price. Said bond
is to be issued by a responsible surety company approved and acceptable to the
City Council and the Iowa Department of Transportation, and shall guarantee the
faithful performance of the contract and terms and conditions therein contained,
and shall guarantee the prompt payment of all materials and labor and protect
and save harmless the City of Dubuque, Iowa, and the Iowa Department of
Transportation from claims and damages of any kind caused by the operations of
the Contractor. Said Bond shall also guarantee the material and the
maintenance of the improvement(s) constructed for a minimum period of two (2)
years from and after its completion and acceptance by the City Council.
No bid submitted by any Contractor which contains a condition or
qualification shall be recognized or accepted by the City Council and the Iowa
Department of Transportation and any letter or communication accompanying the
bid which contains a condition or.qualification upon the bid which has the effect
of qualifying or modifying any provision of the specifications in any manner will be
construed as a non-qualifying bid and will be rejected by the City Council as not
responsive.
The Bidder's attention is directed to the Iowa Department of
Transportation and/or on Federal-Aid projects where the Affirmative Action
Program is included in the Contract Specifications and the provisions thereof,
and hereby made a part of the Contract Documents by reference and
incorporated herein.
Bids shall be opened and read by the Iowa Department of Transportation
in Ames, Iowa after 10:30 a.m. on the same date such as the bids are scheduled
to be received, and will be submitted to the City Council for final action at a
meeting to be held in the Public Library Auditorium, 360 West 11th Street, at said
City at 6:30 p.m. on the 3rd day of February, 2003. A contract will be awarded,
subject to the concurrence of the Federal Highway Administration, at that time or
such subsequent time as the City may determine.
