Van Milligen, City Manager SUBJECT: Isaac Hanna Subdivision -Acceptance of Sanitary Sewer DATE: February 10, 2009 City Engineer Gus Psihoyos is recommending acceptance of the sanitary sewer that the developer, Isaac Hanna, LLC/George Isaac, has recently completed in the Isaac Hanna Subdivision, a commercial subdivision located between Old Highway Road and U.S. Highway 20. Maintenance of said sanitary sewer shall be the responsibility of Isaac Hanna, LLC, for a period of two years from the date of acceptance. Van Milligen, City Mana er FROM: Gus Psihoyos, City Engineer ~ DATE: February 6, 2009 SUBJECT: Isaac Hanna Subdivision -Acceptance of Sanitary Sewer INTRODUCTION The enclosed material provides for City Council acceptance of the sanitary sewer which the developer, Isaac Hanna, LLC/George Isaac, has recently completed in the Isaac Hanna Subdivision, a commercial subdivision located between Old Highway Road and US Highway 20. BACKGROUND As a condition of subdivision plat approval through Resolution No. 507-07, the developer of Isaac Hanna Subdivision was required to install certain improvements including sanitary sewer and stormwater detention facilities and to dedicate these improvements to the City upon completion. The developer has formally requested the City's acceptance of the sanitary sewer which has been installed. The remaining public improvements will be accepted at a later date. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On January 23, 2009, Isaac Hanna, LLC/George Isaac requested City's acceptance of the sanitary sewer in the Isaac Hanna Subdivision. Upon inspection by the City, it has been determined that the sanitary sewer required by Resolution No. 507-07 has been completed in accordance with plans approved by the City Council and in conformance with City specifications. However, since the subdivision is not 75% developed, the stormwater detention facilities are not required to be accepted. Maintenance of the detention facilities would therefore remain with the developer, Isaac Hanna, LLC. RECOMMENDATION I would, therefore, recommend that the City Council accept the sanitary sewer. Maintenance of sanitary sewer shall be the responsibility of Isaac Hanna, LLC for a period of two years from the date of the acceptance by the City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the sanitary sewer at the Isaac Hanna Subdivision. Prepared by Ronald J. Turner, PLS cc: Deron Muehring, Civil Engineer II RESOLUTION NO. 52-09 ACCEPTING SANITARY SEWER IMPROVEMENTS IN THE ISAAC HANNA SUBDIVISION Whereas, pursuant to Resolution 507-07, certain public improvements including sanitary sewer and stormwater detention facilities were installed by the developer of the Isaac Hanna Subdivision. Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the sanitary sewer improvements be accepted by the City Council. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1: That the recommendation of the City Manager be approved and that said sanitary sewer in the Isaac Hanna Subdivision be and the same is hereby accepted. Section 2. That maintenance of said public sewer shall be the responsibility of Isaac Hanna, LLC with costs for said maintenance of the sanitary sewer being the responsibility of Isaac Hanna, LLC for a period of two (2) years from the date of this resolution.
