Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing the proposed lot split.
Staff reviewed the history of platting of the property, size of parcels created and
previous conditions applied to the subject property.
There were no public comments.
The Zoning Advisory Commission discussed the request, reviewing existing curb cuts,
past discussions by the Commission and possible conditions on access.
Recommendation
By a vote of 6 to 0 with one abstention, the Zoning Advisory Commission recommends
that the City Council approve the request, subject to requiring access from Lot 2 of Lot 1
utilize the existing 66-foot wide easement to Pennsylvania Avenue.
A simple majority vote is needed for the City Council to approve the request.

A RESOLUTION APPROVING THE PLAT OF SURVEY LOTS 1 OF 1 AND 2 OF 1 NORTH
RANGE INDUSTRIAL PARK NO.3 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey Lots 1 of 1 and 2 of 1
North Range Industrial Park No. 3 in the City of Dubuque, Iowa; and
Whereas, the plat of survey has been examined bythe Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said plat of survey has been examined by the City Council and they find that it
conforms to the statutes and Resolutions relating to it
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the Plat of Survey,Lots 1 of 1 and 2 of 1 North Range Industrial Park No.
3 is hereby approved and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa, upon said Plat of Survey provided that the
owner of said property shall execute a written acceptance hereto attached, acknowledging and
agreeing.
a) That access for Lot 2 of Lot 1 Northrange Industrial Park No. 3 must utilize the 66-
foot easement "A" for access to Pennsylvania Avenue.

SUBJECT: Plat of Survey Lots 1 of 1 and 2 of 1 Northrange Industrial Park No. 3
INTRODUCTION
The submitted Plat of Survey Lots 1 of 1 and 2 of 1 Northrange Industrial Park No. 3 is a
simple plat subdividing property located west of Radford Road with frontage on
Pennsylvania Avenue. The submitted plat of survey subdivides an existing
approximately 10 acre parcel into two lots. Lot 1 of 1 has frontage at the end of Wolff
Road while Lot 2 of 1 has frontage on Pennsylvania Avenue.
DISCUSSION
The submitted Plat of Survey Lots 1 of 1 and 2 of 1 Northrange Industrial Park No. 3
must be reviewed by the Zoning Advisory Commission as the submitted plat of survey
does not comply with Resolution No. 558-02 (attached) that has a condition in Section
1, subparagraph A that states, "No further lot split of Lot 1 can occur in an east to west
direction without improvement and dedication of a platted street to provide public
access."
This condition was carried over from a previous resolution (66-90)approving the Final
Plat Northrange Industrial Park No. 2 in 1990. The plat of survey submitted and
approved in 2002 created Lot 2 Northrange Industrial Park No. 3, which currently is the
location for Runde Upholstery.
The applicant has submitted this plat of survey to facilitate the sale of Lot 2 of 1 to a
local business. The Zoning Advisory Commission is being asked to revise the
conditions established on this property in February of 1990 and again in 2002 to allow
the proposed parcels without requiring the improvement and dedication of a platted

street. Staff will note that Lot 2 of 1, if approved, will still be encumbered by half of the
66-foot wide easement designated for roadway purposes platted along the east property
line. This easement will impact the development of Lot 2 of 1 by constraining the area
available for construction of a building or parking.
Attached to this memorandum is a copy of the resolution and final plat approved in
February 1990, the minutes of the Zoning Advisory Commission and the Council record
for the same. The Plat of Survey and resolution approved in 2002 are also attached for
the Commission's review.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission review the enclosed
materials and make a recommendation to the City Council on whether to approve the
submitted plat of survey of Lots 1 of 1 and 2 of 1 Northrange Industrial Park No. 3.

A RESOLUTION APPROVING THE FINAL PLAT OF~THE SUBDIVISION
OF LOT 2 OF NORTHRANGE INDUSTRIAL PARK N0. 2 IN THE CITY
OF DUBUQUE, IOWA.
WHEREAS, there has been filed with the City Clerk a final plat of
the subdivision of Lot 2 of Northrange Industrial Park, No. 2 in the City of
Dubuque, Iowa; and
WHEREAS, said final plat has been examined by the City Planning and
Zoning Commission and has its approval endorsed thereon; with the conditions
that no further lot split of Lot 1, Lot 1 of 2 and Lot 2 of 2 can occur in an
east to west direction without improvement and dedication of a platted street
to provide public access; and no further lot split of Lot 1 of 2 can occur in
a north to south direction to minimize the propensity for curb cuts on
Pennsylvania Avenue without review by the Planning and Zoning Commission.
WHEREAS, said final plat has been examined by the City Council and
the City Council finds that the same conforms to statutes and ordinances
relating thereto; and
WHEREAS, the City Council concurs in the condition of approval
• established by the City Planning and Zoning Commission.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the final plat of the Subdivision of Lot 2 of
Northrange Industrial Park No. 2 in the City of Dubuque, Iowa, be and the same
is hereby approved and the Mayor and. City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa upon said final
plat, provided that the owner of said priiperty shall execute a written
acceptance hereto attached, acknowledging and agreeing:
a) No further lot split of Lot 1, Lot 1 of 2 and Lot 2
of 2 can occur, in an east to west direction without
improvement and dedication of a platted street to
provide public access; and
b) No further lot split of Lot 1 of 2 can .occur in a
north to south direction to minimize the propensity for
curb cuts on Pennsylvania Avenue without review by the
Planning and Zoning Commission.

The City of Dubuque Planning and Zoning Commission has reviewed the final plat
of the subdivision of Lot 2 of Northrange Industrial Park, No. 2, located north
of Pennsylvania Avenue and west of Radford Road. The property is owned.by Steve
Smith. A vicinity map and copy of the plat are attached for your review.
The proposed final plat subdivides an existing lot containing approximately 6
acres into two lots. The property is currently zoned C-2 Commercial adjoining
Pennsylvania Avenue, and a conditional CS Com_mercia7 Service and Wholesale
District zoning to the rear of the property.
The Commission has determined that the proposed final plat is in compliance with
the subdivision regulations of the City of Dubuque. By a 6-0 vote, the Planning
Commission has approved the final plat with the condition that no further lot
split of Lot 1, Lot 1 of 2 and Lot 2 of 2 can occur in an east to west direction
without improvement and dedication of a platted street. to provide public access
and no further lot split of Lot 1 of 2 can occur in a north to south directio n
to minimize the propensity for curb cuts on Pennsylvania Avenue without review
by the Planning and Zoning Commission. They request your approval of this final
plat with the same conditions.

AFFIDAVIT OF COMPLIANCE: Staff presented an Affidavit of Compliance verifying
that the meeting was being held in compliance with the Iowa Open Meetings Law.
The meeting was called to order at 4:15 p.m. Commissioner Schrup arrived at 4:20
p.m.
-~-.- FINAL PLAT/Smith: The Commission reconsidered a final plat of the subdivision
of Lot 2 of Northrange Industrial Park No. 2 owned by Steve Smith and located
north of Pennsylvania Avenue and south of Wo]ff Road. Steve Smith and Staff
Laura Carstens discussed the proposed restrictions on the final plat with the
Commission regarding the east/west and north/south splits and curb cuts.
Motion by Hardie, seconded by Guy, to approve the final plat with the conditions
as recommended by staff as follows: No further lot split of Lot 1, of Lot i of
2 or Lot 2 of 2 can occur in an east to west direction without improvement and
dedication of a platted` street to provide public access; and no further lot split
of Lot 1 of 2 can occur in a north to south direction to minimize the propensity
for curb cuts on Pennsylvania Avenue without review by the Planning and Zoning
Commission. The motion carried by the following vote: Aye - Fitch, Hardie,
Schrup, Guy, D. Hartig and R. Hartig; Nay - None.
MINUTES: The Minutes of the December 20, 1989 meeting were approved with a
correction on the spelling of Bertsch.
ORDINANCE AMENDMENTS~Sians in Freewav Corridor: The Commission reviewed an
amendment to the Zoning Ordinance on the recommendation of the Freeway Planning
Committee for signage in the freeway corridor, and staff's proposal for the
overlay district.
The Commissioners questioned Staff as to the rationale for their suggested
changes in the corridor's boundaries; the height, size and spacing of signs; and
the bulk standards and language.
