In response to a request received from City Engineering for the vacation of Gillespie
Street, Fink Street, and the adjacent alley which are located within the West 32"d Street
Detention Basin, City Engineer Gus Psihoyos states that the City has no plans for the
utilization of Gillespie Street, Fink Street, and the adjacent alley, except as use for the
detention basin, and recommends the vacation.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

A request has been received from City Engineering for the vacating of Gillespie
Street, Fink Street, and the adjacent alley which are located within the West 32"d
Street Detention Basin.
BACKGROUND
The proposed areas of Gillespie Street, Fink Street, and the adjacent alley will be
consolidated into Lot 1 of Gillespie's Second Addition. This proposed vacated
area is a part of the West 32"d Street Detention Basin. The abutting properties
are owned by the City of Dubuque.
DISCUSSION
The City has no plans for the utilization of Gillespie Street, Fink Street, and the
adjacent alley to be vacated except as use for the detention basin.
RECOMMENDATION
would recommend that Gillespie Street, Fink Street, and the adjacent alley in
the City of Dubuque, Dubuque County, Iowa as shown on the attached plat of Lot
1 of Gillespie's Second Addition be vacated, and that a public hearing be held for
the disposition of the public interest in the subject area on February 16, 2009.
ACTION TO BE TAKEN
The attached plat and resolution vacating the property should be submitted to the
City Council for consideration and approval.

RESOLUTION NO. 70-09
RESOLUTION APPROVING PLAT OF LOT 1 OF GILLESPIE'S
SECOND ADDITION INCLUDING THE PROPOSED VACATED GILLESPIE
STREET, FINK STREET, AND ADJACENT ALLEY
Whereas, there has been presented to the City Council of the City of
Dubuque, Iowa, a plat dated January 23, 2009 prepared by MSA Professional
Services, Inc., describing the proposed vacated portion of Gillespie Street, Fink
Street, and adjacent alley; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF DUBUQUE, IOWA:
Section 1. That the plat of Lot 1 of Gillespie's Second Addition dated
January 23, 2009 prepared by MSA Professional Services, Inc. relative to the
real estate hereinabove described be and the same is hereby approved, and the
Mayor and City Clerk be and they are hereby authorized and directed to execute
said plat for and on behalf of the City of Dubuque, Iowa.
Section 2. That the City Clerk be and is hereby authorized and directed
to file said plat and certified copy of this resolution in the office of the Recorder in
and for Dubuque County, Iowa.

RESOLUTION VACATING GILLESPIE STREET, FINK STREET, AND
ADJACENT ALLEY
Whereas, City of Dubuque Engineering Department has requested the vacating
of Gillespie Street, Fink Street, and adjacent alley; and
Whereas, MSA Professional Services has prepared and submitted to the City
Council a plat showing the vacated Gillespie. Street, Fink Street, and adjacent alley
shown as part of Lot 1 of Gillespie's Second Addition in the City of Dubuque, Dubuque
County, Iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined that
Gillespie Street, Fink Street, and adjacent alley are no longer required for public use,
and vacating of said Gillespie Street, Fink Street, and adjacent alley, shown as part of
Lot 1 of Gillespie's Second Addition in the City of Dubuque, Dubuque County, Iowa
should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the real estate described Gillespie Street, Fink Street, and
adjacent alley shown as Lot 1 of Gillespie's Second Addition in the City of Dubuque,
Iowa, be and the same is hereby vacated.
