The application, staff report and related materials are attached for your review. Discussion The applicant reviewed the plat, noting that it will take care of some long-standing encroachments into his property. Staff reviewed the plat, noting the lots created would be labeled non-buildable as they do not have adequate lot area or frontage on a street. The Zoning Advisory Commission discussed the request, noting that the plat will help correct property lien problems in the neighborhood and will not adversely impact adjacent property. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, waiving Section IV Lots and Blocks [Section 42-19(b)]. A simple majority vote is needed for the City Council to approve the request. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOW~ Section 1. Lot I will remain approximately 4.8 acres and Lots 2 thru 5 will be relatively uniform, being approximately 50' by 75' with approximately 3,500 square feet of area. Lots 2 thru 5 will be sold to abutting property owners at 918, 924, 934, and 944 Liberty Avenue. Lots 2 thru 5 abut the adjacent properties along their southern property line. Over the years, the residents along Liberty Avenue have encroached on Mr. Fitz's property. They have cleared, mowed, built storage sheds, and stored materials on the property. In an attempt to resolve this, Mr. Fitz has offered to subdivide the property directly behind the four residences on Liberty Avenue, and sell the lots to the abutting property owners. This would expand the lots along Liberty Street from 70 feet of depth to 120 feet of depth. Lots 2 through 5 are substandard, given that they do not meet the 5,000 square feet minimum requirement, and the 50 feet of frontage minimum requirement. These lots are labeled "non-buildable" on the submitted plat and could not be sold for a residential building site. Also, because these lots are separate from the lots on which the primary structure is located, no accessory structures would be permitted on these lots unless they are built in such a manner as to transcend the common lot line or they are consolidated. Staff recommends the Zoning Advisory Commission approve this plat waiving Section 4, Lots and Blocks.
