The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant's representative spoke in support of the Plat of Survey, stating the new
parcel would allow them to build a new structure for their business.
Staff reviewed the plat, noting that the City Council previously approved a plat for the
same parcel of land in 1990 that stipulated that prior to any new lots being created, that a
public street be built and dedicated from Pennsylvania Avenue to Wolff Road. The
submitted Plat of Survey does not comply with that condition and thus requires Zoning
Advisory Commission and City Council approval.
The Zoning Advisory Commission discussed the request, noting that the proposed Plat of
Survey only involves the platting off of a small parcel and would have little impact on traffic
along Pennsylvania Avenue.
Recommendation
By a vote of 4 to 1, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION APPROVING THE PLAT OF SURVEY NORTHRANGE INDUSTRIAL
PARK NO. 3 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a plat of Survey Northrange
Industrial Park No. 3 in the City of Dubuque, Iowa; and
' Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and has its approval endorsed thereon; with the conditions that no further lot split of Lot 1 can
occur an east to west direction without improvement and dedication of a platted street to.
provide public access; and
Whereas, said Plat of Survey has been examined by the City Council and they find
that it conforms to statutes and ordinances relating thereto; and
Whereas, the City Council concurs in the condition of approval established by the
Zoning Advisory Commission.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA-'
Section 1. That the Plat of Survey Northrange Industrial Park No. 3 in the City of
Dubuque, Iowa, is hereby approved, and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa upon said Plat of Survey
provided that the owner of said property shall execute a written acceptance hereto attached,
acknowledging and agreeing:
a)
No further lot split of Lot 1 can occur in an east to west direction without
improvement and dedication of a platted street to provide public access.
Section 2. That in the event the owner fails to execute the Acceptance provided for
in Section 1 herein within forty-five (45) days after the date of this Resolution, the provisions
herein shall be null and void and the approval of the plat shall not be effective.

INTRODUCTION
The submitted Plat of Survey of North Range Industrial Park No. 3 is a simple plat
located at the western corporate limit of the City of Dubuque fronting on Pennsylvania
Avenue. The submitted plat of survey subdivides an existing 10-acre parcel into two
lots. Both lots have sufficient lot frontage and lot area as required by the City
Subdivision Regulations.
DISCUSSION
The submitted Plat of Survey North Range Industrial Park No. 3 is being reviewed by
the Zoning Advisory Commission as the submitted plat of survey does not comply with
the previous plat approved by Resolution No. 66-90 (attached) that established a
conditional in Section 1, Subparagraph A that, "no further lot split of Lot 1, Lot 1 of 2,
and Lot 2 of 2 can occur in the east/west direction without improvement and dedication
of platted street to provide public access."
The applicant has submitted this plat of survey to allow the sale of Lot 2 to a local
business to expand their operation. The zoning Advisory Commission is being asked to
revise the conditions established on this property in February 1990 to allow the splitting
of Lot 1 into two parcels without requiring the improvement and dedication of a platted
street.
Attached to this memorandum is a copy of the resolution and plat approved in February
1990, as well as the minutes for the Zoning Advisory Commission and the Council
record for the same time period.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission review the enclosed
materials and make a recommendation to the City Council on whether approve the
submitted Plat of Survey of North Range Industrial Park No. 3.

The City of Dubuque Planning and Zoning Commission has reviewed the final plat
of the subdivision of Lot 2 of Northrange Industrial Park, No. 2, located north
of Pennsylvania Avenue and west of Radford Road. The property is owned by Steve
Smith. A vicinity map and copy of the plat are attached for your review.
The proposed final plat subdivides an existing lot containing approximately 6
acres into two lots. The property is currently zoned C-2 Commercial adjoining
Pennsylvania Avenue, and a conditional CS Commercial Service and Wholesale
District zoning to the rear of the property.
The Commission has determined that the proposed final plat is in compliance with
the subdivision regulations of the City of Dubuque. By a 6-0 vote, the Planning
Commission has approved the final plat with the condition that no further lot
split of Lot 1, Lot I of 2 and Lot 2 of 2 can occur in an east to west direction
without improvement and dedication of a platted street to provide public access
and no further lot split of Lot 1 of 2 can occur in a north to south direction,
to minimize the propensity for curb cuts on Pennsylvania Avenue without review
by the Planning and Zoning Commission. They request your approval of this final
plat with the same conditions.

The meeting was called to order at 4:15 p.m. Commissioner Schrup arrived at 4:20

of Lot 2 of Northrange Industrial Park No. 2 owned by Steve Smith aed located
north of Pennsylvania Avenue and south of Wolff Road. Steve Smith and Staff
Laura Carstens discussed the proposed restrictions on the final plat with the
Commission regarding the east/west and north/south splits and curb cuts.
Motion by Hardie, seconded by Guy, to approve the final plat with the conditions
as recommended by staff as follows: No further lot split of Lot 1 of Lot 1 of
2 or Lot 2 of 2 can occur in an east to west direction without improvement and
dedication of a platted street to provide public access; and no further lot split
of Lot 1 of 2 can occur in a north to south direction to minimize the propensity
for curb cuts on Pennsylvania Avenue without review by the Planning and Zoning
Commission. The motion carried by the following vote: Aye - Fitch, Hardie,

MINUTES: The Minutes of the December 20, 1989 meeting were approved with a
correction on the spelling of Bertsch.
ORDINANCE AMENDMENTS/Signs in Freeway Corridor: The Commission reviewed an
amendment to the Zoning Ordinance on the recommendation of the Freeway Planning
Committee for signage in the freeway corridor, and staff's proposal for the
overlay district.
The Commissioners questioned Staff as to the rationale for their suggested
changes in the corridor's boundaries; the height, size and spacing of signs; and
the bulk standards and language.
