The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed layout of the
residential structure and stating the eight units will only be rented to people with
disabilities.
Staff reviewed surrounding zoning and land use and noted the size of the subject
parcels and parking requirements.
There were several public comments with concerns expressed about the impact of the
request on traffic and property values, Several speakers noted the proposed eight-unit
building is not compatible with the surrounding single and two-family homes.
The Zoning Advisory Commission received and filed a letter of support, a petition in
opposition, and 26 letters in opposition. Within 200 feet of the subject property, 38.4%
of the property owners filed written objections.
The Zoning Advisory Commission discussed the request, noting that the site conditions
will make it difficult for the proposal to comply with accessibility rules. The Commission
also noted that the proposed eight-unit building would also be much larger in terms of
size and density when compared to surrounding property.

Recommendation
By a vote of 4 to 1, the Zoning Advisory Commission recommends that the City Council
deny the request.
A simple majority vote is needed for the City Council to deny the request. A super
majority vote is needed for the City Council to overturn the denial and approve the
request.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by reclassitying the hereinafter-described
property from R-2A Alternate Two-Family Residential District to R-4 Multi-Family
Residential, to wit:
Lots 13 and 14, Cook's Addition, and to the centerline of the adjoining
public right-of-way, all in the City of Dubuque, Iowa,

retaining wall. The property is surrounded by the Stafford Street and Garfield Avenue

Concurrence with Comprehensive Plan: The Comprehensive Plan makes no
recommendation for this area.
Impact of Request on:
Utilities: Existing utilities are adequate to serve this site.
Traffic Patterns/Counts: There are no available traffic counts for this area.
Property square footage would limit development to eight or less units, which would
add very little traffic to adjacent streets.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.

Adjacent Properties: Development of this site is bound by existing setback, height,
lot coverage and parking requirements. Development of this site for up to eight
units should have very limited impact on the adjacent properties.
CIP Investments: None proposed.
StaffAnalysis: The applicant is proposing to rezone two lots, which total
approximately 15,00 square feet from R-2A Alternate Two-Family residential zoning
District to R-4 Multi-Family Residential zoning district. It is the applicant's intention to
develop an eight-unit handicapped housing facility at this location. Current R-2A
requirements allow a duplex on each lot for a total of four units. Because the lot is
approximately 15,000 square feet in size, if rezoned, it would be limited to eight units.
There appears to be adequate area to provide parking from an existing alley on the
west side of the property.
The property is located across the street from the Hoffman Industrial Center, which is a
processing facility for handicapped adults, and Hess Brick's storage yard. Across the
alley and to the south are single and multi-family residences, several that front along
Rhomberg Avenue with their back yards adjoining the alley. Construction of a
residential facility at this location would place the building approximately 10 feet at its
closest point to the adjacent residence to the south.
Staff recommends the Commission review the criteria for granting a rezoning.

I would tike to take a momant, on behalf of the Hoffmann Development Center, to express our
thoughts regarding the plans for development of the property located at the comer of Garfield Avenue and
Stafford Street
On Tuesday, October 1, 2002, Mr. Winger, of Winger Construffdan, visited the Center to explain
his iment to camstmct a rosidenfial housing project for individuals with disabilities. As an employer of the
disabled we feel there is geouine need for such housing in our Community.
Over the years we have become sensitive to many of the difficolties facing the disabled when
trying to find adequate housing that is affordable as well as in a location that meets their needs. We feel
Mr. Winger is offering both with the construction of this facility.
The Center has been in operation at our present location since 1968 and feels the neighborhood to
be most accommodating to such projects. We hope that Mr. Wlnger's plans will be warmly accepted to the
residentg and businesses alike within our neighborhood.
