Zoning Garfield, Stafford WingeI, Michael Winger, of Winger Construction Co., wish to withdraw my rezoning request from this evening's City Council meeting. Dated this 21st day of October, 2002. /s/ Michael Winger October 14, 2002 (563) 5894210 office (563) 5894221 fax (563) 690-6678 TDD The Honorable Mayor and City Council Members City of Dubuque City Hall - 50 W. 13th Street Dubuque, IA 52001 RE: Rezoning Applicant: Jay Winger/Winger Construction Location: Corner of Garfield Avenue and Stafford Street (719 Garfield Avenue) Description: To rezone property from R-2A Alternate Two-Family Residential District to R-4 Multi-Family Residential District. Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, reviewing the proposed layout of the residential structure and stating the eight units will only be rented to people with disabilities. Staff reviewed surrounding zoning and land use and noted the size of the subject parcels and parking requirements. There were several public comments with concerns expressed about the impact of the request on traffic and property values, Several speakers noted the proposed eight-unit building is not compatible with the surrounding single and two-family homes. The Zoning Advisory Commission received and filed a letter of support, a petition in opposition, and 26 letters in opposition. Within 200 feet of the subject property, 38.4% of the property owners filed written objections. The Zoning Advisory Commission discussed the request, noting that the site conditions will make it difficult for the proposal to comply with accessibility rules. The Commission also noted that the proposed eight-unit building would also be much larger in terms of size and density when compared to surrounding property. Service People Integrity ResponsibOJty Innovation Teamwork The Honorable Mayor and City Council Members October 14, 2002 Page 2 Recommendation By a vote of 4 to 1, the Zoning Advisory Commission recommends that the City Council deny the request. A simple majority vote is needed for the City Council to deny the request. A super majority vote is needed for the City Council to overturn the denial and approve the request. Respectfully submitted, Eugene Bird, Jr., Chairperson Zoning Advisory Commission Attachments Prepared by: Laura Caretens, City Planner Address: 50 W. 13th St.. That Appendix A (The Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by reclassitying the hereinafter-described property from R-2A Alternate Two-Family Residential District to R-4 Multi-Family Residential, to wit: Lots 13 and 14, Cook's Addition, and to the centerline of the adjoining public right-of-way, all in the City of Dubuque, Iowa, Section 2. The foregoing amendment has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. This ordinance shall take effect immediately upon publication, as provided by law. Passed, approved and adopted this day of 2002. Attest: Terrance M. Duggan, Mayor Jeanne F. Schneider, City Clerk REZONING STAFF REPORT Zoning Agenda: October 2, 2002 Property Address: Property Owner: Applicant: 719 Garfield Avenue Jay Winger/Winger Construction Jay Winger Proposed Land Use: Residential Proposed Zoning: R-4 Existing Land Use: VacantJResidential Existing Zoning: R-2A Adjacent Land Use: North- Processing/Commercial East- Industrial South - Residential West - Residential Adjacent Zoning: North - C-1 East - LI South - R-2A West- R-2A Former Zoning: 1934 -Two-Family; 1975 - R-4 1985 - R-2A Total Area: 15,000 square feet Property History: The original residence was built circa 1870 and the property has served as a residential lot since that time. A demolition permit for the residence was issued on December 11, 2001 and the property has been vacant to the present. Physical Characteristics: The property is an approximately 15,000 square foot pamel consisting of two level lots. The property is slightly elevated above Garfield by a stone retaining wall. The property is surrounded by the Stafford Street and Garfield Avenue rights-of-way, an alley to the rear and a residential lot to the south. Concurrence with Comprehensive Plan: The Comprehensive Plan makes no recommendation for this area. Impact of Request on: Utilities: Existing utilities are adequate to serve this site. Traffic Patterns/Counts: There are no available traffic counts for this area. Property square footage would limit development to eight or less units, which would add very little traffic to adjacent streets. Public Services: Existing public services are adequate to serve the site. Environment: Staff does not anticipate any adverse impact to the environment provided adequate erosion control and storm water control is provided during all phases of development. REZONING STAFF REPORT Page 2 Adjacent Properties: Development of this site is bound by existing setback, height, lot coverage and parking requirements. Development of this site for up to eight units should have very limited impact on the adjacent properties. CIP Investments: None proposed. StaffAnalysis: The applicant is proposing to rezone two lots, which total approximately 15,00 square feet from R-2A Alternate Two-Family residential zoning District to R-4 Multi-Family Residential zoning district. It is the applicant's intention to develop an eight-unit handicapped housing facility at this location. Current R-2A requirements allow a duplex on each lot for a total of four units. Because the lot is approximately 15,000 square feet in size, if rezoned, it would be limited to eight units. There appears to be adequate area to provide parking from an existing alley on the west side of the property. The property is located across the street from the Hoffman Industrial Center, which is a processing facility for handicapped adults, and Hess Brick's storage yard. Across the alley and to the south are single and multi-family residences, several that front along Rhomberg Avenue with their back yards adjoining the alley. Construction of a residential facility at this location would place the building approximately 10 feet at its closest point to the adjacent residence to the south. Staff recommends the Commission review the criteria for granting a rezoning. October 2, 2002 To Whom It May Con.tm I would tike to take a momant, on behalf of the Hoffmann Development Center, to express our thoughts regarding the plans for development of the property located at the comer of Garfield Avenue and Stafford Street On Tuesday, October 1, 2002, Mr. Winger, of Winger Construffdan, visited the Center to explain his iment to camstmct a rosidenfial housing project for individuals with disabilities. As an employer of the disabled we feel there is geouine need for such housing in our Community. Over the years we have become sensitive to many of the difficolties facing the disabled when trying to find adequate housing that is affordable as well as in a location that meets their needs. We feel Mr. Winger is offering both with the construction of this facility. The Center has been in operation at our present location since 1968 and feels the neighborhood to be most accommodating to such projects. We hope that Mr. Wlnger's plans will be warmly accepted to the residentg and businesses alike within our neighborhood. Sincerely, Cathy A. Kaesbauer Executive Director September 27, 2002 Members Of Planning Commission Ref: Rezoning of Winger Construction Property Garfield Ave Dear Members, I am writing to request the deafial of the rezoning request, to R4, for Winger Construction. I feel that the rezoning would increase traffic on Garfield as well as in the alley, that is in poor repair now, behind our homes. The area is currently zoned R 2 and that zoning has allowed us to have a very quiet residential area, with little or no problems from persons renting property. This may b, because much of the property is owner occupied. I feel the requested rezoning would allow for a large building, and the increased population would increase noise, and may Cause prohlems that may require police intervention, such as in the 600 block of Rhomberg Ave, as wet,as storm water nm off that is already a problem in the North End of Dubuque. The Winger Construction Company does not have a good track record of property maintenance on this site. The old home was torn down last year and since that time construction equipment has been stored on the site, and most recently a weed complaint was filed with the City to have the site cut. The weeds were welt over five feet tall, only weeds that could be gotten with ease were cut the remainder still remain, as does the construction equipment. Thank you for your time regarding this matter. I feel the requested rezoning would allow for a large building, and the increased population would increase noise, and may cause problems that may require police intervention, such as in the 600 block of Rhomberg Ave, as well as storm water nm off that is already a problem in the North End of Dubuque. The W'mger Construction Company does not have a good track record of property maintenance on this site. The old home was tom down last year and since that time construction equipment has been stored on the site, and most recently a weed complaint was filed with the City to have the site cut. The weeds were well over five feet tall, only weeds that could be gotten with ease were cut the remainder still remain, as does the construction equipment.
