The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached-for your review.
Discussion
The applicant spoke in favor of the request, indicating that the requested rezoning to CS
Commercial Service and Wholesale District was decided upon based on the adjacent
commercial development of Asbury Plaza, and that the site lacks the visibility needed to warrant
commercial retail zoning.
Staff reviewed surrounding zoning and land use, and noted access to the site is anticipated to
be obtained by extension of a new public street to be built as part of the second phase of
Asbury Plaza.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the position of the subject
property adjacent to the third phase of Asbury Plaza is not conducive to development of the
property for residential uses, and that the CS Distdct is appropriate in this area and will not
adversely impact adjacent property.
Recommendation
By a vote of 4 to 0. with one abstention, the Zoning Advisory Commission recommends that the
City Council approves the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION ANNEXING CERTAIN PROPERTY
Whereas, Grandview Avenue United Methodist Church, property owner, has
voluntarily petitioned for annexation of approximately 26.398 acres of property lying outside of
the corporate limits of the City of Dubuque, Iowa as shown in Exhibit A; and
Whereas, Chapter 368 of the Code of Iowa authorizes the extension of City limits in
situations of this character by adoption of a resolution after notification is required by State
regulations; and
Whereas, this request has been found to be consistent with the Comprehensive Plan
and the Future Land Use Map of the Comprehensive Plan; and
Whereas, the future growth and development of the City of Dubuque, Iowa make it
desirable that the property be made part of the city of Dubuque, Iowa.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the territorial limits of the Dubuque, Iowa by and they are hereby
extended to include the property legally described, to wit:

This letter is written as a request for rezoning as a condition of annexation
of Lot 1 of 2 of Mineral Lot 459 in Section 16, T89N, R2E, 5th P.M. as
described in our letter to the mayor and City Council dated August 1,2002.

This 26 acre parcel was purchased as part of a larger 47 acre tract when
Grandview Ave. UMC was seeking a 15 to 20 acre site in the west side of
Dubuque for a new church. Construction has begun on the remaining 20
acres for the new church facility. After much discussion and planning it
appears the area annexed in 1999, now platted as Barton Randle Addition,
will provide for the church's future expansion needs. Therefore, in order to
provide for appropriate development in the area, we are seeking rezoning
of said lot 1 of 2 of Mineral Lot 459 to the classification of CS-Commercial
Service.
In order to keep traffic through Barton Randle Addition residential in nature
we would like to have the CS zoning prohibit access to John Wesley Drive
or the extension thereof. Since the entire boundary of the proposed
annexation abuts the Asbury Plaza development, we feel adequate access
points should be available from the south or west of the Northwest Arterial
and a proposed public street through the plaza. The rawne that runs
through the property would provide a natural area for storm water detention
and a roadway connection.
In summary, Grandview Ave. UMC is seeking a Commercial Service zoning
for Lot 1 of 2 of Mineral Lot 459 in conjunction with annexation with access
to the parcel through the existing commercial area on the south and west
sides of the site. No access would be allowed from the proposed extension
of John Wesley Drive, which is currently zoned residential.

Concurrence with Comprehensive Plan: The subject property is adjacent to the City
of Dubuque city limits and is accessible by City services and utilities. The proposed
property is supported by the land use goals and objectives in the Comprehensive Plan.
Impact of Request on:
Utilities: City water and sewer can be extended to serve the subject property.
Traffic Patterns/Counts: Access is proposed to be from a future public street to be
extended through Asbury Plaza.
Public Services: The site will be accessible to City services upon development
due to its proximity to John F. Kennedy Road and the Northwest Arterial.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control and storm water control is provided during all
phases of development.

Adjacent Properties: Staff does not anticipate any adverse impact to surrounding
property provided access to the proposed commemial site is by way of a future
public street through Asbury Plaza.
CIP Investments: John F. Kennedy Road reconstruction.
Staff Analysis: The Grandview Avenue United Methodist Church property that adjoins
their existing 20-acre parcel was annexed into the City in 1999. The subject parcel is
proposed to be rezoned to CS Commercial Service and Wholesale District.
The Commercial Service and Wholesale District is intended to provide an area for a
variety of business services, offices uses and limited industrial activity and major
wholesale operations. The CS Distdct is characterized by large storage space
requirements, high volume truck traffic and Iow volume customer traffic. The CS
Commercial Service and Wholesale District caters to businesses that typically do not
depend on a large volume of pass-by traffic for its customer base. The list of permitted
uses in the CS District is tailored to business services offices uses and limited
industrial activity.
Access to the parcel is anticipated to be by way of a future public street to be
constructed as part of Asbury Plaza Phase 2. This street will be a public street that will
have access to the Northwest Arterial. The applicant's have indicated in their letter of
August 29, 2002, that they would like the rezoning conditioned on prohibiting access to
John Wesley Drive from the proposed CS District. Planning staff believes such a
condition is not necessary as Grandview Avenue United Methodist Church is the owner
of the intervening property. Extension of John Wesley Drive cannot occur without the
church's knowledge and use of their property.
The proposed rezoning to CS Commercial Service and Wholesale District is requested
by the applicant because of the unique nature of the subject parcel. The parcel is on
the north boundary of Phase 3 of Asbury Plaza Shopping Center. The parcel will have
a clear view of the back of the large commercial buildings that will be built as part of
Phase 3 of that shopping center. The parcel is also bisected by a deep ravine that also
limits its suitability for residential development. Access and visibility of property is not
sufficient to warrant a retail commercial designation.
Planning staff recommends that the Zoning Advisory Commission review Section 6-1.1
of the Zoning Ordinance that establishes cdteria for rezonmg requests.

SUBJECT:Annexation Request of Grandview Avenue United Methodist Church
INTRODUCTION
This memo transmits a voluntary annexation request by Grandview Avenue United
Methodist Church for City Council review and approval. The church has requested
annexation of 26.398 acres southwest of John Wesley Drive and north of Asbury Plaza
in conjunction with rezoning to CS Commercial Service and Wholesale District. The
property is currently zoned County A-1 Agricultural. A staff report and a resolution are
attached.
DISCUSSION
The subject property is adjacent to a 20-acre parcel annexed by the church in 1999 for
construction of a new church facility. The subject property can be served by City sewer
and water, which are available from the adjacent church property.
On October 2, 2002, the Zoning Advisory Commission is scheduled to hold a public
hearing on the rezoning request to CS Commercial Service and Wholesale District in
conjunction with the annexation. On October 21, 2002, the City Council would be
scheduled to hold a public hearing on both the rezoning and annexation requests.
The subject property is not needed for church expansion and provides an opportunity
for commercial service and wholesale uses to develop just north of Asbury Plaza. The
church has proposed that access to the subject property be via a future public street to
be constructed for Asbury Plaza. The church is also suggesting that there be no
access to John Wesley Drive. With access restricted, commercial and residential
traffic would remain separated.
Annexation of the subject property is in conformance with the City's long range goals
and objectives. Annexation will give the City greater control over land use and building
standards on the subject property.

Since the subject property is within two miles of the City of Asbury and the City of
Sageville, the State of Iowa's City Development Board also must approve the
annexation request.
RECOMMENDATION
Staff recommends that the City Council set a public hearing on the annexation request
for October 21, 2002. This will allow approval of the annexation concurrent with the
Council's public hearing on the rezoning request.

This letter is wdtten as a request for voluntary annexation to the. City of
Dubuque. Grandview Avenue United Methodist Chumh has begun construction
on its new facility at 3342 John Wesley Drive, which was annexed in 1999. We
have installed sewer, water and street improvements on the site and anxiously
await the completion of John F Kennedy Road in front of our property.
Grandview Avenue UMC also owns a parcel immediately southwest of the
current campus which is legally described as
Lot 1 of 2 of Mineral Lot 459
in Section 16, Township 89 North,
Range 2 East of the 5th Principal Meridian
In Dubuque County Iowa.
This 26.398 acre parcel abuts Asbury Plaza property on the south and a portion
of the west boundary, and county agricultural land on the west and north. Our
church property and the Dubuque Community Schools property, currently within
the city limits abut on theeast side.
In order to adequately serve this 26 acre parcel with sewer, water, police and
fire protection, Grandview Avenue United Methodist Church requests to have
the area annexed to the City of Dubuque.

Purpose: To access City utilities and services for future commercial development.
Physical Characteristics: The property is in agricultural use with a ravine bisecting it
midway. The subject property adjoins the existing church property on the east; Asbury
Plaza and the Dubuque Soccer Complex lie to the south ana west. Agricultural land
surrounds the site on the north and west.
Conformance with Comprehensive Plan: Annexation of land adjacent to the City
limits and accessible to City services and utilities is supported by Land Use Goals and
Objectives in the Comprehensive Plan.
Impact of Request on:
Utilities: City water and sewer are available from the adjacent church property.
Traffic Patterns/Counts: Access is proposed to be from a future public street to be
extended through Asbury Plaza. No access would occur off John Wesley Drive,
which provides the primary access for the church property to John F. Kennedy
Road. Under this scenario, commercial and residential traffic would remain
separated if the subject property is developed.

Public Services: The site will be accessible to City services upon development
due to its proximity to John F. Kennedy Road and the Northwest Arterial.
Environment: No environmental impacts are expected if adequate erosion control
and storm water management are provided.
Adjacent Properties: Little or no impact on adjacent properties is expected if
access is through Asbury Plaza.
ClP Investments: John F. Kennedy Road reconstruction.
Staff Analysis and Recommendation: This 26+ acre parcel adjoins a 20-acre parcel
annexed by Grandview Avenue United Methodist Chumh in 1999. The 20-acre parcel
is the site of a new church, which is under construction. The subject property proposed
for annexation is not needed by the chumh for expansion. Instead, this site would
provide an opportunity for commercial service and wholesale uses to develop just north
and east of Asbury Plaza. Annexation of the subject property is conformance with the
City's Long Range Goals and Objectives stated in the Comprehensive Plan.
This annexation request is made conjunction with rezoning to CS Commercial Service
and Wholesale District. The Zoning Advisory Commission will consider the rezoning
request on October 2, 2002. City Council will then consider the rezoning request on
October 21, 2002.
