SUBJECT:Acceptance of Public Improvements in Jaeger Heights Subdivision No. 2 -
Phase 3
Public Works Director Mike Koch is recommending acceptance of the public
improvements that the developer, Lloyd S. Gudenkauf, has recently completed in
Jaeger Heights Subdivision No. 2 - Phase 3. Maintenance of said improvements shall
be the responsibility of the contractor, Horsfield Construction, and the owner, Lloyd S.
Gudenkauf, for a pedod of two years from the date of acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT:Acceptance of Public Improvements in Jaeger Heights Subdivision
No. 2 - Phase 3
INTRODUCTION
The enclosed material provides for City Council acceptance of the public
improvements which the developer, Lloyd S. Gudenkauf, has recently completed
in Jaeger Heights Subdivision No. 2 - Phase 3.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 546-01, the
developer of Jaeger Heights Subdivision No. 2 - Phase 3 was required to install
certain improvements including street paving, storm sewer, sanitary sewer,
watermain and street lighting, and to dedicate the improvements to the City upon
completion. The developer of Jaeger Heights Subdivision No. 2 - Phase 3, Lloyd
S. Gudenkauf, has recently completed the improvements and has formally
requested the City's acceptance of the public improvements which have been
installed.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required
public improvements, the subdivider shall notify the City in writing of the
completion of the improvements, requesting that the City either approve or reject
the acceptance of the improvements, together with a statement of reasons for
any rejection.
On July 11, 2002, Lloyd S. Gudenkauf requested the City's acceptance of the
improvements in Jaeger Heights Subdivision No. 2 - Phase 3 and to refund any
unused inspection fees. Upon a recent inspection by the City, it has been
determined that all of the public improvements required by Resolution No. 546-01
have been completed in accordance with plans approved by the City Council and
in conformance with City specifications.
RECOMMENDATION
I would therefore recommend that the City Council accept the improvements.
Maintenance of said improvements shall be the responsibility of the contractor,
Horsfield Construction, and owner, Lloyd S. Gudenkauf, for a period of two years
from the date of acceptance by the City Council. The amount of the inspection
fee refund would total $5,692.95.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the
improvements.

NO. 2 - PHASE 3
Whereas, pursuant to Resolution C346-01, certain improvements including
street paving, storm sewer, sanitary sewer, watermain, and street lighting were
installed by the developer of Jaeger Heights Subdivision No. 2 - Phase 3; and
Whereas, the improvements have been completed and the City Manager
has examined the work and has filed a certificate stating that the same has been
completed in accordance with the plans approved by the City Council and in
conformance with City specifications, and has recommended that the
improvements be accepted by the City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, iOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvements in Jaeger Heights Subdivision No. 2 - Phase 3 and
the same is hereby accepted.
Section 2. That maintenance of said improvements shall be the
responsibility of the contractor and the owner for a period of two years from this
date.
