Riverwalk Swimming ProhibitedMEMORANDUM October 30, 2002 TO:The Honorable Mayor and City Council Members FROM:Michael C. Van Milligen, City Manager SUBJECT:Ordinance Amendment Prohibiting Swimming or Wading at the Riverwalk Assistant City Manager Cindy Steinhauser recommends City Council adoption of an amendment to the City Code of Ordinances prohibiting swimming or wading at the Riverwalk. On August 19, 2002 the City Council adopted an amendment to section 10-36 of the Code of Ordinances prohibiting swimming or wading in the waters adjacent to the Rivers Edge Plaza and authorizing the City Manager to post appropriate signs. The prohibition on swimming or wading did not include the waters adjacent to the Riverwalk, which would include the two small pier steps that connect the Riverwalk to the Mississippi River. The proposed amendment includes these areas in the ordinance and authorizes the City Manager to post appropriate signage. Discussion On August 19, 2002 the City Council adopted an amendment to section 10-36 of the Code of Ordinances prohibiting swimming or wading in the waters adjacent to the Rivers Edge Plaza and authorizing the City Manager to post appropriate signs. Sec. 10-36(d) of the City of Dubuque Code of Ordinances, is amended to read as follows: (d) No Person shall swim or wade in the waters adjacent to the Rivers Edge Plaza or the Riverwalk.
