Duggan and Members of the City Council November 13, 2002 Claim Against the City By Tammi Herbst Date of Claim Date of Loss 11/12/02 10/08/02 Nature of Claim Vehicle Damage This is a claim in which claimant states that paint was splattered on her vehicle while parked in the Locust Street Ramp. According to the report of Tim Horsfield, Parking Systems Supervisor, an employee of the Parking Division was repainting the top of the stairwell in the Locust Street Ramp when he noticed paint had splattered on the claimant's vehicle. It is therefore the recommendation of Tim Horsfield to approve this claim in the amount of $121.85 The Legal Department concurs with this recommendation. On October 8, 2002, a staff member of the Parking Division was repainting the top of the stairwell in the Locust Street Ramp when he noticed some paint on two vehicles. The employee was painting with a roller and being it was a bit windy that day, some of the paint blew onto the cars causing speckles of paint on the finish. It is my opinion that the damage claim filed by Tammi Herbst is consistent with the employee's side of the story and also with the damage I observed the day this happened. It is therefore my recommendation to pay the claim as filed. If you need any additional information concerning this claim, please contact me at your convenience.
