Minutes Civil Service 9 5 02CIVIL SERVICE COMMISSION Date: Thursday, September 5, 2002 Time: 1:30 p.m. Place of Meeting: City Hall - Conference Room A Present: Chairperson Merle Duehr, Commissioner Lores Kluesner, Commissioner Wertzberger Also Present: Corporation Counsel Barry Lindahl, Leisure Services Manager Gil Spence, Police Chief Klm Wadding, John Rosenthal Approve Minutes of August 20, 2002 Meeting Wertzberger moved to approve the minutes of the August 20, 2002 meeting. Seconded by Kluesner, passed unanimously. = Request of Dave Baker, Teamsters Local Union No. 421, to Discuss Certain Portions of the City's Administrative Policy Regarding Residency Requirements John Rosenthal stated that the Teamsters Union was requesting to set a date and time to meet with the Commission to discuss portions of the City's residency requirements, especially the definition of the word "critical~ employees. Corporation Counsel Barry Lindale stated his opinion was that the Civil Service Commission had no jurisdiction over the City's residency requirement. He explained that administrative policies are determined by the City Manager. The Civil Service Commission only has authority to administer Civil Service tests and certify the lists, and to hear appeals on terminations, demotions, and lay-offs. He further stated that the Code of Iowa gives the City Manager the authority to set reasonable residency requirements and to determine who is a "critical" employee. If an employee were disciplined because of failure to comply with the residency policy and wish to appeal that disciplinary action, the Commission would have jurisdiction to hear the appeal. Chairperson Duehr requested that the Union provide the Commission with a wdtten statement as to why they feel the Commission had jurisdiction over this policy. Wertzberger moved to table the issue for a period no longer than ten days and that upon receipt of additional information from the Teamsters Union, the Commission would determine if they had jurisdiction in the case. Seconded by Kluesner, and passed unanimously. = Establish Passing Point and Certify List for Position of Events Coordinator Wertzberger moved that the passing point for the position of Events Coordinator be set at 60 and above. Seconded by Kluesner, passed unanimously. Kluesner moved to certify the list as determined. Seconded by Wertzberger, passed unanimously. s Amend Certified List for the Position of Corporal Wertzberger moved to amend the Certified List for the position of Corporal by adding Scott Baxter to Certified List and Abigail Simon to the Reserve List. Seconded by Kluesner, passed unanimously. Amend Certified List for the Position of Police Officer Wertzberger moved to amend the Certified List for the position of Police Officer by adding Adam J. Ohnesorge to the Certified List for Police Officer and adding Larry Nilmeier and Benjamin C. Dobson to the Reserve List. Seconded by Kluesner, passed unanimously. = Request of Raymond J. Behnke to be Added to the Certified List for the Position of Sanitation Driver Wertzberger moved to add the name of Raymond J. Behnke to the Certified List for the position of Sanitation Driver as requested by the employee. Seconded by Kluesner, passed unanimously.
