Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed sign regulation changes for
^sbury Plaza, noting that the changes generally involved allowing a greater number of signs but
not increasing the total square footage of signs.
Staff reviewed the existing and proposed sign regulations and compared allowed signage at
^sbury Plaza to other commercial developments within the community.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that changes reflect a need to
allow tenants greater flexibility in advertising their business while not increasing the total square
footage of signage with Asbury Plaza.
Recommendation
By a vote of5to 1,the Zoning Advisory Commission recommendsthatthe City Councilapprove
thereque~.
A simple majodty vote is needed for the City Council to approve the request.

SUBJECT: Amended Sign Regulations for Asbury Plaza PUD
Dear Commissioners:
This letter serves as a formal request to amend Ordinance No. 44-99, Section E, Sign
Regulations. The following are the requested changes:
Section E, Sign Regulations:
2. (a) - Change number of tenant identification signs from two (2) to four (4). The
language would read, "... four (4) tenant identification signs. Each sign shall be a
ground-mounted monument or pylon sign a maximum of twenty-five (25) feet high and
twelve (12) feet long. Multiple tenants can be displayed on these signs with square
footage to be allocated by the developer."
2. (b) - Tenants occupying greater than 30,000 square feet of leased area shall be
allowed an unlimited number of wall-mounted signs, the aggregate total square footage
of which shall not exceed 20 percent of the front building wall area (corner spaces of
inline buildings shall be allowed an unlimited number of signs the aggregate total
square footage of which shall not exceed 20 percent of the front building wall area and
20 percent of the side building wall area).
2. (c) - Tenants occupying less than 30,000 square feet of leased area shall be allowed
an unlimited number of wall-mounted signs, the aggregate total square footage of which
shall not exceed 10 percent of the front building wall area (corner spaces of inline
buildings shall be allowed an unlimited number of signs the aggregate total square
footage of which shall not exceed 10 pement of the front building wall area and 10
percent of the side building wall area).
3 (a) - Change permitted signs from two (2) to four (4). The language would read,
"....The maximum number of signs per business is four(4) signs."

SUBJECT: Asbury Plaza PUD Text Amendment for Signage
INTRODUCTION
On January 15,1996, the City Council approved the rezoning from AG and C-3 to PUD
Planned Unit Development with a PC Planned Commercial designation for
approximately 80 acres of land at the intersection of Asbury Road and the Northwest
Arterial. This development is known as Asbury Plaza. On April 3, 1996, Corey
Development revised the sign regulations for the Asbury Plaza PUD. The sign revisions
were not deemed a significant change to the PUD regulations and were approved by
the Zoning Advisory Commission and City Council. On May 17, 1999, the City Council
approved an amendment the Asbury Plaza PUD that incorporated approximately 27
additional acres to the original PUD.
DISCUSSION
Mark Vondrak and the Rubloff Development Group, representing Asbury Plaza
Shopping Center, have asked to amend the Asbury Plaza PUD sign regulations to
permit:
1)
Four tenant identification signs at 30 feet in height where, currently, two signs 25
feet in height are permitted. Attached is a site plan showing the proposed tenant
identification sign locations.
2)
An unlimited number of wall-mounted tenant identification signs not to exceed
10% of the wall area for tenants of up to 30,000 square feet, and 20% of wall
area for tenants in excess of 30,000 square feet. Currently the PUD permits one
sign per tenant not to exceed 10% of wall area for tenants less than 30,000
square feet and 20% of wall area for tenants in excess of 30,000 square feet.
This means that each tenant would be allowed the same square footage of wall-
mounted signage but would not be limited in number. This request also asks to
permit corner tenants with two exposed building sides to have 10% wall area for
tenants with fewer than 30,000 square feet and 20% wall area for tenants for in
excess of 30,000 square feet for the exposed sidewall.
3)
To increase the amount of wall-mounted outlot signs from two signs per business
to four signs per business. Out lot signs will still be bound by existing C-3
General Commercial regulations.
RECOMMENDATION
This memo is provided for your information. Staff recommends that you review these
proposed sign standards and provide a recommendation to the City Council.

ORDINANCE NO. 97-02
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CITY OF
DUBUQUE CODE OF ORDINANCES FOR HEREINAFTER DESCRIBED PROPERTY LOCATED
NORTH OF ASBURY ROAD AND WEST OF THE NORTHWEST ARTERIALTO AMEND
ORDINANCE 44-99 THAT ESTABLISHED THE PUD PLANNED UNIT DEVELOPMENT
DISTRICT FOR ASBURY PLAZA AND ADOPTING AMENDED SIGN REGULATIONS.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by providing for the amendment of ordinance 44-99, which
adopted regulations for the Asbury Plaza Planned Unit Development District and approving an
amended Ordinance for the Asbury Plaza Planned Unit Development District for hereinafter
described property, as shown in Exhibit A and to the center line of the adjoining public right-of-
way, all in the City of Dubuque, Iowa, a copy of which is attached to and made a part hereof.
Section 2. Pursuant to Iowa Code Section 414.5 (2001), and as an express condition of
the reclassification, the undersigned property owners agrees to the following conditions, all of
which the property owners further agrees are reasonable and imposed to satisfy the public needs
that are caused directly by the zoning reclassification:
E. Si,qn Re.qulations.
On-premise signage shall be provided in compliance with the following:
1) Center Identification signage: One (1) center identification sign located along
the Northwest Arterial (Highway 32) frontage. This sign shall be a ground-
mounted sign a maximum of twelve (12) feet high and twenty-five (25) feet
long.
2) Tenant Identification signage:
a) Four (4) tenant identification signs. Each sign shall be a ground-mounted
sign a maximum of thirty (30) feet high and twelve (12) feet long. Multiple
tenants can be displayed on these signs with square footage to be
allocated by the developer.
b) Tenants occupying greater than 30,000 square feet of leased area shall
be allowed an unlimited number of wall-mounted signs. The total
aggregate square footage of wall-mounted signs will be based on 20% of
the front building wall area (corner spaces of inline buildings shall be
allowed an unlimited number of signs the aggregate total square footage
of which shall not exceed 20% of the front building wall area and 20% of
the side building wall area).
c) Tenants occupying less than 30,000 square feet of leased area shall be
allowed an unlimited number of wall-mounted signs. The total aggregate
square footage of wall-mounted signs will be based on 10% of the front
building wall area (comer spaces of inline buildings shall be allowed an
unlimited number of signs the aggregate total square footage of which
shall not exceed 10% of the front building wall area and 10% of the side
building wall area).
3. Outlot signage:
a) Each outlot parcel shall be allowed wall-mounted signage as per the C-3
General Commemial District sign regulations. The maximum number of
signs per business is four (4).
b) Each outlot parcel shall be allowed one (1) freestanding sign, limited to
100 square feet in size and a maximum height of 25 feet.
4. Directional signs will be allowed as permitted by C-3 General Commercial
District sign regulations.
Section 3. The foregoing amendment has heretofore been reviewed by the Zoning
Commission of the City of Dubuque, Iowa.
Section 4. The foregoing amendment shall take effect upon publication, as provided by
law.
