Under Iowa law, it is not permissible to file a Mechanic's Lien on publicly owned property. The Port of Dubuque Parking Facility is owned by the City of Dubuque. Please dismiss this Mechanic's Lien at your earliest opportunity. The correct procedure is to file a claim with the City Clerk of the City of Dubuque under Iowa Code chapter 573. Pursuant to the collective bargaining agreement Iowa Reinforcing Steel, LLC is required to submit on a periodic basis reports and contributions as required based on work performed by employees covered under the terms of said collective bargaining agreement and as determined by applicable rates applied to hours worked to total earnings of each employee. The claimant under this Notice of Claim: Iowa Laborers District Council Health and Welfare Trust During October, 2008 through and including January, 2009, employees of Iowa Reinforcing Steel, LLC who were covered under the identified collective bargaining agreement furnished labor to the project for the construction of the Port of Dubuque Parking Ramp -City of Dubuque project # 360-1957. The owner of the Project is the City of Dubuque, Iowa and the general contractor on the project is Kraemer Brothers, LLC. The employer, Iowa Reinforcing Steel, LLC, failed and continues to fail to remit is fringe benefit contributions in such amounts as are required under the terms of the collective bargaining agreement to which employer, Iowa Reinforcing Steel, LLC, is signatory. The identified claimants claim losses based on the hours submitted by employees of the employer for which payment not been made.
