RE: Mechanic's Lien, Port of Dubuque Parking Facility
Dear Mr. Miller:
have received a copy of the Mechanic's Lien you filed in the Iowa District Court for
Dubuque County on March 10, 2009.
Under Iowa law, it is not permissible to file a Mechanic's Lien on publicly owned
property. The Port of Dubuque Parking Facility is owned by the City of Dubuque.
Please dismiss this Mechanic's Lien at your earliest opportunity.
The correct procedure is to file a claim with the City Clerk of the City of Dubuque under
Iowa Code chapter 573.

This office represents the claimant: Iowa Iron Workers Heavy Highway Pension Plan
which is a beneficiary of the collective bargaining agreement by and between Iowa
Reinforcing Steel, LLC and the International Association of Bridge, Structural,
Ornamental and Reinforcing Iron Workers, Local 89. The identified claimant hereby
submits NOTICE OF CLAIM -IOWA CODE CHAPTER 573 for unpaid fringe benefit
contributions and liquidated damages due and owing for the time period of October, 2008
through to and including January, 2009 on the Port of Dubuque Parking Rainp, City of
Dubuque project # 360-1957 upon which Kraemer Brothers, LLC was the general
contractor and Iowa Reinforcing Steel, LLC was as subcontractor to Kraemer Brothers,
LLC.
It is requested that you please provide to this office a copy of any and all payment bonds
applicable to this project.

NOTICE OF CLAIM -IOWA CODE CHAPTER 573
Iowa Reinforcing Steel, LLC as employer is signatory under a collective bargaining agreement
with the International Association of Bridge, Structural, Onlamental and Reinforcing Iron
Workers, Local 89. Pursuant to the collective bargaining agreement Iowa Reinforcing Steel,
LLC is required to submit on a periodic basis reports and contributions as required based on work
performed by employees covered under the terms of said collective bargaining agreement and as
determined by applicable rates applied to hours worked to total earnings of each employee. The
claimant under this Notice of Claim:
Iowa Iron Workers Heavy Highway Pension Plan
During October, 2008 through and including January, 2009, employees of Iowa Reinforcing
Steel, LLC who were covered under the identified collective bargaining agreement furnished
labor to the project for the construction of the Port of Dubuque Parking Ramp -City of Dubuque
project # 360-1957. The owner of the Project is the City of Dubuque, Iowa and the general
contractor on the project is Kraemer Brothers, LLC. The employer, Iowa Reinforcing Steel,
LLC, failed and continues to fail to remit is fringe benefit contributions in such amounts as are
required under the terms of the collective bargaining agreement to which employer, Iowa
Reinforcing Steel, LLC, is signatory.
The identified claimants claim losses based on the hours submitted by employees of the employer
for which payment not been made.
The claimants assert that the general contractor, Kraemer Brothers, LLC and its surety are
indebted to the claimants and each of them as is itemized:
