SUBJECT:Ice Harbor West Road & Trail Construction Project
On September 16, 2002, the City Council awarded the construction contract for the Ice
Harbor West Road & Trail Construction Project to Tschiggfrie Excavating Company in
the amount of $2,171,905.67. Resolution No. 491-02 contained an incorrect contract
amount.
Resolution No. 491-02, which was provided to Council for the award of the contract,
included an incorrect contract amount of $2,447,166.67. The $2,447,166.67 value was
the total estimated project cost, which included Construction Contract, Contingency,
Engineering Design, Construction Engineering and Inspection. The correct contract
amount is $2,171,905.67.
Public Works Director Mike Koch recommends amending Resolution No. 491-02 to
correct the amount of the construction amount of the construction contract to Tschiggfrie
Excavating to be $2,171,905.67.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
On September 16, 2002, the City Council awarded the construction contract for

Company in the amount of $2,171,905.67.
DISCUSSION
Resolution No. 491-02, which was provided to Council for the award of the
contract, included an incorrect contract amount of $2,447,166.67. The
$2,447,166.67 value was the total estimated project cost which included
Construction Contract, Contingency, Engineering Design, Construction
Engineering and Inspection. The correct contract amount is $2,171,905.67.
ACTION TO BE TAKEN
The City Council is requested to amend Resolution No. 491-02 correcting the
amount of the construction amount of the construction contract to Tschiggfrie
Excavating Company to be $2,171,905.67.

AMENDING RESOLUTION NO. 491-02 AWARDING CONTRACT FOR
THE ICE HARBOR WEST ROAD AND TRAIL CONTRUCTION PROJECT
Whereas, on September 16, 2002, the City Council passes Resolution No.
491-02 awarding the construction contract for the Ice Harbor West Road and
Trail Construction Project in the contract amount of $2,447,166.67; and
Whereas, the correct amount of the contract should have been
$2,171,905.67.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the Resolution No. 491-02 awarding the contract to Tschiggfde
Excavating Company in the amount of $2,447,166.67 be amended to correct the
contract amount to be $2,171,905.67.

SUBJECT:Ice Harbor West Road and Trail
Sealed bids were received for the Ice Harbor West Road and Trail Project. Public
Works Director Mike Koch recommends award of the contract to the Iow bidder,
Tschiggfrie Excavating Company, in the amount of $2,171,905.67, which is 38.1% over
the engineer's estimate.
City staff, Durrant, and IIW, the designers for the project, will be meeting with
representatives from Tschiggfrie Excavating Co. to look for ways to save money on the
project through possible redesigns or value engineering. The outcome of those
meetings is, however, totally unknown at this time as to whether any significant savings
can be identified.
If the City and the contractor cannot find any savings in the design as proposed, the
$599,297 shortfall will be covered utilizing part of the $904,631 savings from the
Mississippi River National Education and Conference Center bids.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT:Ice Harbor West Road and Trail
INTRODUCTION
The enclosed resolution provides for the award of the construction contract for the Ice
Harbor West Road & Trail Project.
DISCUSSION
The roadway will be partially located on City property and partially on property owned by
the City and leased to the Chicago Central & Pacific Railroad Company.
As part of the roadway construction, a 42-inch high decorative barder railing will be
installed adjacent to the sidewalk on top of the sheet pile wall at the edge of the Ice
Harbor, which will complement the decorative railing installed on the Riverwalk. The
barrier railing will also function as a vehicular protective guardrail since the harbor side
walkway will be 15 feet higher than the water elevation at normal pool elevation. The
barrier railing will be strengthened by the installation of decorative cast stone pedestals
spaced at approximately 44 feet. Intermediate steel posts will be placed at appropriate
5-foot intervals between the cast stone pedestals as additional reinforcing for the
vehicular guardrail. The cast stone pedestals will have decorative ornamental lights
placed on top that will match the lighting theme of the Riverwalk.
On the railroad side of the roadway, a 42-inch high safety railing will be installed at
approximately 10 feet from the centedine of the railroad tracks that will match the
decorative railing installed on the Riverwalk. This safety fence is intended to prevent
pedestrians from gaining access to the rail lines. The railroad safety barrier will
compliment the harbor side railing, but will not have the level of architectural features
such as cast stone bollards or lighting.
While the roadway will be 24 feet wide to accommodate two-way traffic, it is planned
that this traffic be limited to vehicles of less than five (5) tons, and thus no semi or heavy
truck traffic.
The pavement surface will be traditional concrete paving, and the sidewalk is proposed
to be identical to the Riverwalk sidewalk in texture and color. At the southerly end of the
sidewalk, there will be a widened area where benches, planters, and trash receptacles
will be located. The roadway will tie into the existing pavement on First Street and the
existing cul-de-sac will be removed.
The project completion date has been specified for May 23, 2003.
BID RESULTS
Sealed bids were received on the project on September 10, 2002. Tschiggfrie
Excavating Company of Dubuque, Iowa submitted the Iow bid in the amount of
$2,171,905.67. This amount is 38.1% over the engineer's estimate. A summary of the

AWARDING CONTRACT
Whereas, sealed proposals have been submitted by contractors for the Ice
Harbor West Road and Trail Project pursuant to Resolution No. __ and notice
to bidders published in a newspaper published in the City of Dubuque, Iowa on
the 16th day of August, 2002.
Whereas, said sealed proposals were opened and read on the 10th day of
September, 2002, and it has been determined that the bid of Tschiggfde
Excavating Co. of Dubuque, Iowa, in the amount of $2,447,166.67 was the
lowest bid for the furnishings of all labor and materials and performing the work
as provided for in the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Tschiggfrie
Excavating Co. and the Manager be and is hereby directed to execute a contract
on behalf of the City of Dubuque for the complete performance of the work.
BE IT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's
bond, the City Treasurer is authorized and instructed to return the bid deposits of
the unsuccessful bidders.
