On February 2, 2009, the City signed a joint partnership agreement between the City
and the Iowa Department of Transportation to perform right-of-way property acquisition
services for the Southwest Arterial Project.
Six proposals were received in response to the Request for Proposals. Based on a
thorough review of the proposals, the Consultant Selection Committee recommends
Peoples Company of Iowa as the first-ranked Consultant.
City Engineer Gus Psihoyos recommends City Council approval of Peoples Company of
Iowa as the selected Review Appraisal Services Consultant for the Southwest Arterial
Project and that the City Manager be authorized to negotiate a Professional Services
Agreement and execute a contract with Peoples Company of Iowa.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The purpose of this memorandum is to seek City Council concurrence in the selection of
Peoples Company of Iowa from Indianola, Iowa, as the Professional Appraisal Consultant
to provide real estate property Review Appraisal Services for the acquisition of right-of-way
for the development of the Southwest Arterial project.
BACKGROUND
The preliminary design phase was completed in March, 2008 by AECOM (formerly Earth
Tech, Inc.) and now the project is ready to proceed with the final engineering design
phase, right-of-way property acquisition, and archaeological and cultural resource phase III
mitigation work.
In an attempt to accelerate the right-of-way acquisition and the final design process, the
City has evaluated several options to potentially "fast track" the next phases of the project
so that the Southwest Arterial project is favorably positioned to potentially take advantage
of any future state or federal economic stimulus funding packages; or to be included in
Iowa's Five-Year Highway Transportation Improvement Program; or the new Federal
Transportation Bill.
On February 2, 2009, the City signed a joint partnership agreement between the City and
the Iowa Department of Transportation (Iowa DOT) to perform right-of-way property
acquisition services for the Southwest Arterial Project.
Based on the right-of-way property acquisition services agreement with the Iowa DOT, the
City will be responsible for contracting the following acquisition related work tasks:
^ Acquisition Appraisals
^ Review Appraisals
The Iowa DOT Office of Right-of-Way will be responsible for completing the following
acquisition phases:
^ Right-of-Way Negotiations and Acquisition
^ Relocation Assistance
^ Condemnation Services (if required)
^ Title and Closing Services
Iowa DOT property acquisition is anticipated to begin upon completion of the appraisal
process for the complete four-lane project and is expected to be complete in 12 months.
On March 2, 2009, the City approved the selection of AECOM to complete the final
engineering design phase. AECOM has agreed to commit and allocate the necessary
resources to "fast track" the final design phases of the project and complete the interim 2-
lane highway design in 12 months.
DISCUSSION
The right-of-way Review Appraisal phase of the project will complete real estate property
Review Appraisal Services to establish an amount to be offered by the City as "Just
Compensation" for the approximate forty-seven (47) impacted properties to allow for the
acquisition of right-of-way within the project corridor for the construction of the Southwest
Arterial, which is a proposed 6.1-mile four-lane divided, hard-surface freeway facility with
priority 1-access control on a new alignment between U.S. Highway 61/151 and U.S.
Highway 20.
The Review Appraiser shall independently perform an all inclusive review and evaluation
of all acquisition appraisals and other reports submitted to determine the soundness of the
acquisition appraiser's opinion of fair market value, adequacy of the acquisition appraiser's
supporting data and documentation, the logic of acquisition appraiser's analysis, whether
the acquisition appraisal written report conforms to the provisions of this manual, if
adequate consideration was given to all compensable items of damage, and, to verify the
exclusion of items non-compensable under Iowa law.
The Review Appraiser shall review the final written acquisition appraisal report submitted
for each parcel and shall either reject, accept or approve appraisals submitted and shall
approve an estimate of just compensation for the property under appraisal.
The Appraiser shall prepare, sign and furnish to the City a separate, written acquisition
appraisal report for each impacted parcel identified and follow generally accepted
standards of professional appraisal principles and techniques in accordance and
compliance with the Iowa Department of Transportation's Appraisal Policy & Procedures
Manual, Appraisal Operational Manual and the Uniform Relocation Assistance and Real
Property Acquisition Policies Act.
Appraisal Consultants are required to be prequalified and certified by the Iowa Department
of Transportation to perform real estate property Review Appraisal Services.
CONSULTANT SELECTION PROCESS
Because the professional consultant services contract to complete the real estate property
Acquisition Appraisal Services will use federal funding, the RFP and the consultant
selection process was done in accordance with the Iowa Department of Transportation
"Modified" Consultant Selection Process. The selection ranking was based upon the
overall strength of information provided in the Consultant's response proposal submitted,
the Consultant's demonstrated competence, experience and qualifications and ability to
respond and perform to an accelerated completion schedule. Consultant's presentation
and interviews were not conducted.
The Consultant Selection Committee for the Southwest Arterial project -Review Appraisal
consultant selection included the following:

On March 30, 2009, six (6) Consultant response proposals were received and are as
follows:

On April 1, 2009, the Consultant Selection Committee met to evaluate and rate each of the
Consultants. The Committee carefully deliberated each Consultants strengths and
weaknesses. Although each of the Consultants was uniquely qualified, the Consultant
Selection Committee selected Peoples Company of Iowa from Indianola, Iowa as the first-
ranked Consultant to provide real estate property Review Appraisal Services for the
Southwest Arterial project right-of-way acquisition phase.
CONSULTANT QUALIFICATIONS
Peoples Company of Iowa and there designated Project Manager, Brian Linnemeyer, has
significant public project review appraisal experience with government agencies which
includes an impressive client list that includes the Department of Justice, Iowa DOT, Iowa
DNR, Federal Aviation Authority, U.S. Army Corps of Engineers and various Law Firms,
banks and cities across Iowa.
Brian Linnemeyer MS, MAI, ARA has significant public project review appraisal experience
throughout the State of Iowa. This includes experience and expertise with a variety of
property types including commercial, industrial, agribusiness, agricultural, and residential.
Further, Mr. Linnemeyer recently completed a 52 parcel review appraisal project for the
Iowa Department of Transportation near the Mississippi River corridor in Eastern Iowa.
This review appraisal project involved a highly similar proposed by-pass highway and was
completed in a timely and cost effective manner.

consultant selection requirements and includes /incorporates the DOT's approval and
concurrence through every step of the process.
RECOMMENDATION
Based on the thorough review of the proposals, the Consultant Selection Committee
recommends Peoples Company of Iowa as the first-ranked Consultant and that the City
negotiate a Professional Services Agreement and execute a contract with Peoples
Company of Iowa to complete the Review Appraisal Services for the Southwest Arterial
project.

The City is proposing to use DMATS STP funding on eligible City street construction and
traffic capacity /safety related improvement projects which will allow local funds to be
transferred to the Southwest Arterial Project and used as matching cost for the federal
funds. Staff has identified approximately $4.6 million in local project funds over the next
five (5) years that could be shifted using DMATS STP funds which would allow the
leveraging of approximately $18.4 million in federal dollars.
ACTION TO BE TAKEN
I respectfully request that you recommend to City Council the approval of Peoples
Company of Iowa as the selected Review Appraisal Services Consultant for the Southwest
Arterial project and that you request City Manager authority to negotiate a Professional
Services Agreement and execute a contract with Peoples Company of Iowa.

(RFP) and solicited qualified professional appraisal consultants to provide the
real estate property review appraisals for the right-of-way acquisition for the
development of the Southwest Arterial Project (Project); and
Whereas, the consultant selection process was done in accordance with
the Iowa Department of Transportation "Modified" Consultant Selection Process;
and
Whereas, the Consultant Selection Committee selected Peoples Company
of Iowa of Indianola, Iowa as the first-ranked appraisal consultant to provide real
estate property review appraisal services for acquisition of right-of-way for the
development of the Project; and
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the City Council hereby concurs with the Consultant
Selection Committee recommendation of Peoples Company of Iowa as the first-
ranked appraisal consultant and hereby approves Peoples Company of Iowa to
provide real estate property Review Appraisal Services for the right-of-way
acquisition for the development of the Southwest Arterial Project (Project).
Section 2. That the City Manager is hereby authorized to develop a
Professional Services Agreement with Peoples Company of Iowa, subject to
approval of the Iowa Department of Transportation, to complete the review
appraisal phase of the Project.
Section 3. That the City Manager is hereby authorized and directed to
execute three copies of said Consultant Professional Services Agreement
(Contract) with Peoples Company of Iowa to provide real estate property Review
Appraisal Services for acquisition of right-of-way for the development of the
Southwest Arterial Project.
