AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED SOUTHEAST OF
SEIPPEL ROAD AND OLD HIGHWAY ROAD FROM AG AGRICULTURAL
DISTRICT TO R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CiTY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from AG Agricultural District to R-1 Single-Family Residential District, to wit:
NW 1/4, Section 31, T89N, R2E, to the centerline of the adjoining
public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Description: To rezone recently annexed property from AG Agricultural District to R-1 Single-
Family Residential District (comparable to former County zoning).
Dear Mayor and City Council Members:
The Zoning Advisory Commission has reviewed the above-cited request. The application, staff
report and related materials are attached for your review.
Discussion
The applicant, Kyle Kritz, Associate Planner for the City of Dubuque, spoke in favor of the request,
stating that the subjec~ area was annexed in July, 1999, as part of the 1,000 acre annexation along
the U.S. Highway 20 corridor. The property owners did not request annexation to the City. The
proposed rezoning will provide similar zoning to what the parcel had in the County.
The Zoning Advisory Commission discussed the request noting that the general area is in transition
and that it may not be wholly developed for residential purposes. The specific request wiJl not
adversely impact adjacent property.
Recommendation
By a vote of 5 to 1, the Zoning Advisory Commission recommends that the City Council approve the
request.
A simple majority vote is needed for the City Council to approve the request.

This property was annexed into the City of Dubuque in July 1999.
Physical Characteristics: The property is approximately 9.5 acres in size and has been
used for agriculture since at least 1947.
Concurrence with Comprehensive Plan: This lot was not included on the future land
use map of the 1995 Comprehensive Plan. The property was included in the 1997
Annexation Study as part of Area IV, Priority 1, Immediate Opportunity Area.
Impact of Request on:
Utilities: City water service is available to the property and City sanitary sewer will
be available in the future once the interceptor line has been extended to within
closer proximity to the subject property.
Traffic Patterns/Counts: The subject property has frontage on the new Seippel
Road. Traffic counts are not available for this two roadway.
Public Services: Existing public services are adequate to serve the site.
Environment: Approval of the request for rezoning will not adversely impact the
environment as no substantial changes to the property are anticipated.

Adjacent Properties: No adverse impacts to adjacent properties are anticipated
as the proposed rezoning basically provides appropriate zoning for this existing
single-family residential parcel.
CIP Investments: None proposed.
StaffAnalysis: The requested rezoning from Agricultural to R-1 Single-Family
Residential is being requested by the City of Dubuque as the subject property owned by
James and Doris Graf was annexed to the City in July of 1999. The property was
zoned R-1 Rural Residential. Upon annexation, the property was zoned Agricultural
and the submitted request is to provide a zoning classification similar to what the
property had when it was in the County.
The requested rezoning is consistent with the development and zoning of surrounding
property both in the County and within the City of Dubuque.
Staff recommend that the Zoning Advisory Commission review Section 6-1.1 that
establishes criteda for review of the rezoning request.
