SUBJECT:Building Permit Moratorium - Southwest Arterial Corridor
The City Council previously established a moratorium to prevent development that
would be incompatible with the future alignment of the Southwest Arterial. Kim Sanford
of 103 Cousins Road has requested to build a garage in the moratorium area.
Fred Dean of the Iowa Department of Transportation was contacted and he indicated
that IDOT felt the garage would not have a significant impact on the future plans to
improve Highway 20 in the Seippel Road/Cousins Road area.
Building Services Manager Rich Russell recommends that the City Council approve the
issuance of the building permit.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION: This memo transmits a request by Mr. Kim Sanford of 103
Cousins Road to build a garage in the Southwest Arterial Moratorium area.
DISCUSSION: The City Council previously adopted Ordinance 101-00. This
ordinance established a moratorium to prevent development that would be
incompatible with the future alignment of the roadway.
I have advised Mr. Fred Dean of the Iowa Department of Transportation (IDOT)
of the request. A copy of the packet I mailed to Mr. Dean is attached. Mr. Dean
responded by fax on December 3rd. His response indicated that the Iowa
Department of Transportation felt the garage would not have a significant impact
on the future plans to improve Highway 20 in the Seippel Road/Cousins Road
area. I have attached a copy of Mr. Dean's letter for your review.
RECOMMENDATION: I recommend that the City Council find that no negative
impacts would arise due to the issuance of this building permit and that I be
directed to issue the same.

Dear Mr. Russell:
In response to your November 26, 2002 letter in regards to the Building Permit Application
submitted by Mr. Kim Sanford, 103 Cousins Road, the proposed garage/storage structure does
fall within both the department's Corridor Preservation Zone and Development Moratorium Area
approved by the Dubuque City Council. However, based on the construction value and intended
use to both store and work on antique vehicles by Mr. Sanford, we have determined approval of
the requested permit does not'significantly impact future plans to improve U.S. 20 in the Seippel
Road/Cousins Road areal Therefore, we Consent to this application being forwarded to the City
Council for their consideration and approval, of a waiver from the permit moratorium.

The City of Dubuque Building Services Department recently received a request
for a building permit to construct a garage from Mr. Kim Sanford of 103 Cousins
Road. I've attached a copy of the study area for your use. Mr. Sanford's property
is #21,
The garage is 72" by 48' (3456 square feet). I've attached a copy of the permit
application for your review. The City's Board of Adjustment recently approved the
size and location of the proposed structure.
With your consent, I will forward this request to the Dubuque City Council for their
consideration of a waiver from the permit moratorium.
