Dear Mr. Van Milligen:
We'are attorneys for T-Corp;, an Iowa corporation owned,.by Ed
Tschiggfrie and family members. As you know, T-Corp. owns a 93-
acre.parcel in Key West which is located to the west of Rockdale
Road and south.of. Jaeger Heights Subdivision No. 2 ...The T-Corp'
property is presently zoned PUD-Planned Unit Development. It is
suitable for residential (single family and multi-family) and
commercial development and could accommodate up to 600 living
units. Commercial development would be limited to approximately
five acres. With the elimination of a previously planned second
access through Jaeger Heights Subdivision No. 2, the T-Corp.
property is left with only one public access.
At the present time, Brian Feldman owns a mobile home park at
the end of Tower Hills Drive in Key West. That portion of Tower
Hills Drive serving Mr. Feldman,s mobile home park is a private
road which, if it were to become a city street, would provide a
second public access to the T-Corp. property. Mr. Feldman has
indicated, by letter to you dated October 10, 2002, that he will
not voluntarily agree to Tower Hills Drive becoming a public
street..
By this letter T-Corp, and Mr. Tschiggfrie are requesting that
the City of Dubuque take steps, through its power of eminent

domain, to acquire Tower Hills Drive as a public street. Although
a second public access to a residential development is not required
by ordinance, it would be highly desirable in facilitating the
development of the T-Corp. property. We would appreciate a
response to our request at your earliest convenience.
