SUBJECT: Acceptance of Public Improvements in Indiana Subdivision
DATE: April 14, 2009
City Engineer Gus Psihoyos is recommending acceptance of the public improvements
that the developer, KZ Investments, LLC, has recently completed in Indiana
Subdivision. Maintenance of said improvements shall be the responsibility of KZ
Investments, LLC, successors, or assigns, for a period of two years from the date of
acceptance.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Public Improvements in Indiana Subdivision
INTRODUCTION
The enclosed material provides for City Council acceptance of the public improvements which
the developer, KZ Investments, LLC, has recently completed in Indiana Subdivision.
BACKGROUND
As a condition of subdivision plat approval through Resolution No. 341-05, the developer of
Indiana Subdivision was required to install certain improvements including street paving with
curb, sanitary sewer main, watermain, storm sewers and catch basins, boulevard street
lighting, and a stormwater detention facility and to dedicate these improvements to the City
upon completion.
DISCUSSION
The Subdivision Ordinance requires that upon completion of all the required public
improvements, the subdivider shall notify the City in writing of the completion of the
improvements, requesting that the City either approve or reject the acceptance of the
improvements, together with a statement of reasons for any rejection.
Upon inspection by the City, it has been determined that all public improvements required by
Resolution No. 341-05 have been completed in accordance with plans approved by the City
Council and in conformance with City specifications.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the improvements. Maintenance of
said public improvements shall be the responsibility of KZ Investments, LLC, successors, or
assigns for a period of two (2) years from the date of acceptance by the City Council.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the improvements.

RESOLUTION NO. 121-09
ACCEPTING IMPROVEMENTS IN INDIANA SUBDIVISION
Whereas, pursuant to Resolution 341-05, certain public improvements including
street paving with curb, sanitary sewer main, watermain, storm sewers and catch basins,
boulevard street lighting, and a stormwater detention facility were installed by the
developer of the Indiana Subdivision.
Whereas, the improvements have been completed and the City Manager has
examined the work and has filed a certificate stating that the same has been completed
in accordance with the plans approved by the City Council and in conformance with City
specifications,. and has recommended that the improvements be accepted by the City
Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved and
that said public improvements in the Indiana Subdivision be and the same is hereby
accepted.
Section 2. That maintenance of said public improvements shall be the
responsibility of the contractor and owner for a period of two (2) years from this date.
Section 3. That the City Clerk be and is hereby authorized and directed to file a
certified copy of this resolution in the office of the Recorder in and for Dubuque County,
Iowa.
