The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.

Planning Staff Member Kyle Kritz reviewed the submitted Plat of Survey, reviewing lot
layout and right-of-way acquisitions. He noted that the Plat of Survey cleans up the
existing fragmented lot layout in this area of the Port of Dubuque by consolidating lots to
make them more useable.
There were no public comments.
The Zoning Advisory Commission felt the request was appropriate.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted plat of survey resubdivides property located at the northwest corner of
Bell and East 5t" Streets. The subject property is owned by the City of Dubuque. The
plat of survey is being reviewed by the Zoning Advisory Commission as there are six
new lots platted:
DISCUSSION
The submitted plat of survey of Riverwalk 9t" Addition is comprised of six lots. Lots 1
and 2 are owned by the City of Dubuque, while Lots A and B are right-of-way
acquisitions to E. 5t" Street, and Lots C and D are right-of-way acquisitions for Bell
Street. The submitted plat of survey continues the process of cleaning up the historic lot
pattern which was comprised of small City lots. The submitted plat of survey is in
substantial compliance with the City of Dubuque Subdivision Regulations. Lots A, B, C,
and D, since they are right-of-way acquisitions for Bell and East 5t" Streets, are exempt
from the minimum lot requirements of the Subdivision Regulations.
RECOMMEND~-TION
Planning staff recommends that the Zoning Advisory Commission approve the plat of
survey for Riverwalk 9t" Addition as it is in substantial compliance with the City of
Dubuque Subdivision Regulations.

A RESOLUTION APPROVING THE PLAT OF SURVEY OF RIVERWALK NINTH
ADDITION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey of Riverwalk
Ninth Addition in the City of Dubuque, Iowa, and;
Whereas, upon said Plat of Survey appears streets to be known as East Fifth
Street (Lot A and Lot B) and .Bell Street (Lot C and Lot D), together with certain public
utility and visibility corridor easements, which the owner, by said plat of survey, has
dedicated to the public forever; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they
find that it conforms to the statutes and ordinances relating to it.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of East Fifth Street (Lot A and Lot B) and Bell
Street (Lot C and Lot D), and the easements for public utilities and visibility corridor as
they appear upon said Plat of Survey, be and the same are hereby accepted; and
Section 2. That the Plat of Survey of Riverwalk Ninth Addition is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa, upon said Plat of Survey.

for the purpose of subdividing and platting said real estate, henceforth to be known as Lots 1
and 2 and Lots A through D, inclusive, of RIVERWALK NINTH ADDITION in the City of
Dubuque, Dubuque County, Iowa, the plat of which is attached hereto and made a part of this
certificate; that said real estate was surveyed by me in February, 2009, and staked out and
platted into lots and streets as shown on said plat; that said plat sets forth the boundaries
thereof, the Tines of the streets and widths and names thereof, and the size and dimensions of
all lots in accordance with said survey; that the corners are marked with iron T-bar monuments
and caps bearing the number 9761 or found existing monuments, and all dimensions on said
plat are shown in feet and decimals thereof.
