Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The application, staff report and related materials are attached for your review. ®iscusaion The applicant spoke in favor of the request, reviewing need for portable classroom space and difficulty in raising funds to construct permanent classrooms. Staff reviewed the history of changes to campus and previous exclusions granted to allow portable classrooms. There were no public comments. The Zoning Advisory Commission discussed the request, noting that the portable classrooms should be replaced with permanent accommodations, but were willing to grant another three-year extension. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request to extend the use of portable classrooms to June 30, 2012. A simple majority vote is needed for the City Council to approve the request. BY REPEALING SECTION 2(D)(2) OF ORDINANCE NO. 18-03, AND ENACTING A NEW SECTION 2(D)(2) IN LIEU THEREOF PERTAINING TO THE TIME LIMIT FOR USE OF PORTABLE CLASSROOMS AT HILLCREST FAMILY SERVICES. Whereas, Ordinance No. 18-03 was adopted on March 17, 2003, by the City Council amending the ID Institutional District for Hillcrest Family Services; and Whereas, Hillcrest Family Services has requested an amendment to the ID Institutional District regulating the time limit for use of the portable classrooms in the ID Institutional District. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code of Ordinances is hereby amended by repealing Section 2(D)(2) of Ordinance No. 18-03 and enacting a new Section 2(D)(2) in lieu thereof, as follows: 2(D)(2): All portable classrooms located in this ID district shall be removed by Hillcrest Family Services no later than June 30, 2012. Section 2. The foregoing amendment. has heretofore been reviewed by the Zoning Advisory Commission of the City of Dubuque, Iowa. Section 3. I failed to renew my request in 2006 for athree-year extension for Hillcrest Family Services to allow a portable classroom to remain on our property at 2005 Asbury Road within the ID institutional district. I became aware of this oversight on January 28, 2009, when discussing the rezoning of 1985 and 1989 Asbury Road with Guy Hemenway. Our original request was granted in June 2000 and reapproved in 2003. Hillcrest added a portable classroom in 2000 due to the need for additional classroom space for our special education program. This classroom was needed for our secondary students. Since that time, our program has continued to expand due to increased demand from the Dubuque Community School District to where we have had as many as 130 students within our program on our campus. If additional space was available, the program could grow even more tomorrow. Hillcrest is providing a valuable alternative for the Dubuque Community School District that allows them to use their existing spaces most efficiently and appropriately. Hillcrest did construct in 2003 two additional classrooms, restrooms and support space in the lower level of our building located at 2005 Asbury Road. A concern in the past has been the bus traffic and parking situation. Presently, one full size Dubuque School District bus makes two trips each school day to our Hillcrest school. The bus pulls into our parking lot behind the school on Wilbricht Lane at 7:15 A.M. to pick up staff. At 8:15 A.M. the bus returns and drops off students and staff on 2 Wilbricht Lane next to the new sidewalk that Hillcrest installed in 2002. The bus returns at 2:45 P.M. to pick up students and staff at the same location. It returns once again at 3:45 P.M. and drops off staff in the Flora Park parking lot across the street. Four vans delivering students from four other school districts arrive in the morning and in the afternoon. At all times, these vans pull into our parking lot behind the school. In 2003, Hillcrest expanded our on-campus parking to 102 spaces. All school staff uses either the 102 off-street paved parking spaces on our campus or the thirty spaces in the Flora Park parking lot. Up unti12008, we were allowed to use the Flora Parlc lot under agreement with the Park Department without charge as long as we handled the snow removal. We negotiated a fee agreement with the Park Department for rental of these spaces in 2008. We continue to handle all the snow removal. We prohibit all Hillcrest staff from parking on the south side of Wilbricht Lane, which has made the traffic flow much easier. The Zoning Advisory Commission recommended approval of the request, subject to limiting the use of the portable classroom to June 2003. In March of 2003, Hillcrest Family Services submitted a request to the Zoning Advisory Commission asking to extend the deadline for use of the portable classroom to June 30, 2006. The Zoning Advisory Commission recommended approval of the request. Included with this memo is a copy of the June 2000 and March 2003 Commission minutes with the discussion regarding the time limitation on the portable classroom highlighted. Hillcrest Family Services Executive Director/CEO Gary L. Gansemer has provided a letter that outlines the continued need for the use of the portable classrooms beyond the June 30, 2006 deadline. Mr. Gansemer's letter also outlines the scheduling for bus pick-up and drop-off for students at the Hillcrest facility, and details the number of parking spaces available and their location on the campus and in the Flora Park remote lot.
