MOTION: ED SWIFT
SECOND: BILL KINSELLA
THE FINDINGS OF THE BOARD WERE:
Horizon Asset Management, agents for MDI Limited Partnership
$47, requested a variance for light, ventilation and ceiling
height as required by 26-10.(f) (3)a.
Unit 409:
Living room is 14 x 17 (238 sq ft) and has one window 36.5 x
53.5. This room is 6.48 sq ft short of light and short 2.74
sq ft of ventilation.
Unit 309:
Same as unit 409.
Unit 209:
Room is 13.75 x 17.5
4'. This room is 7.24
short of ventilation.
f"~^ ~ and ~
x==~.62 sq =~j ~== a window 3' x
sq ft short of light and 3.62 sq ft
Unit 402:
Bedroom is 11.33 x 10.16 (115.11 sq ft) and has a window
30.5 x 30.5. This room is 2.73 sq ft short of light and 1.37
sq ft short of ventilation.
The rooms in question are all short light and ventilation.
The owners could not enlarge the windows due to historical
reasons. The State of Iowa Historic Preservation Office
would not allow this. The Building Department used the
Provisions of the Uniform Code For Building Conservation
(UCBC) to allow these non-conformities.
Codes call for 6'8" in height above stairs. Stairways have 2
steps between landings that measure 6' on fourth step up and
6'3" on 5th step up. Need variance of 8" and 5"
respectively. The existing stairways are of concrete
construction and have been in place since 1916. There was no
feasb!e way to correct the height from the nose of the tread
to the ceiling. Only two steps per section are below the
present code of 6'8"
ED SWIFT MOTIONED TO GRANT THE VARIANCE AS REQUESTED AN~ DUE
TO THE FACT THE STATE OF IOWA HISTORIC PRESERVATION OFFICE
WOULD NOT ALLOW THE OWNER TO ENLARGE THE WINDOWS. THIS
BUILDING IS ON THE HISTORICAL REGISTER.
BILL KINSELLA SECOndED. MOTION PASSED 5-0.
