Van Milligen, City Manager SUBJECT: Iowa Department of Transportation Agreement for Improvements to US 20 Public Works Director Mike Koch recommends City Council approval of a pre- construction agreement between the City of Dubuque and the Iowa Department of Transportation (IDOT) to construct improvements to US 20 within the City of Dubuque. The agreement provides that IDOT will design, let, and construct traffic flow improvements to US 20 (Dodge Street). It will involve intersection improvements from Devon Drive westerly to the new "Menards" entrance on US 20, which is located just beyond the old US 20 intersection. The proposed improvements will be accomplished in two phases: · Phase I will involve a traffic signal interconnect from Devon Drive extending westerly to the west limits of the project at the new "Menards" entrance. · Phase II will involVe the installation of right- and left-turn lanes from Devon Drive extending westerly to Century Drive. The Iowa Department of Transportation (IDOT) will bear the entire cost of the $3i5 million project. I concur with the recommendation and respectfully request Mayor and City Council approval. Koch, Public Works Director Iowa Department of Transportation Agreement for Improvements to US 20 INTRODUCTION Enclosed is a pre-construction agreement between the City of Dubuque and the Iowa Department of Transportation (IDOT) to construct improvements to US 20 within the City of Dubuque. DISCUSSION The agreement provides that IDOT will design, let, and construct traffic flow improvements to US 20 (Dodge Street). It will involve intersection improvements from Devon Drive westerly to the new "Menards" entrance on US 20, which is located just beyond the old US 20 intersection. The proposed improvements will be accomplished in two phases: · Phase I will involve a traffic signal interconnect from Devon Drive extending westerly to the west limits of the project at the new "Menards' entrance. · Phase II will involve the installation of right- and left-turn lanes from Devon Drive extending westerly to Century Drive. As noted on Exhibit "B" of the pre-construction agreement, the Iowa Department of Transportation (IDOT) will bear the entire cost of the $3.5 million project. RECOMMENDATION I would recommend that the City Council approve the proposed pre-construction agreement between the City of Dubuque and IDOT for the intersection improvements to US 20. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution authorizing the Mayor to execute two copies of the pre-construction agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the pre-construction agreement between the City of Dubuque and the Iowa Department of Transportation for the construction of traffic signal and turn-lane improvements between the City of Dubuque and the Iowa Department of Transportation be and is hereby approved. Section 2. That the Mayor be authorized and directed to execute two copies of the pre-construction agreement between the City of Dubuque and the Iowa Department of Transportation. Local Systems Engineer STAFF ACTION NO: PRECONSTRUCTION AGREEM]~NT County Dubuque CITY Dubuque Project No. STP-A-2100(620)- -86-31 Iowa DOT Agreement No. 2003-16-019 This Agreement, is entered into by and between the Iowa Department of Transportation, hereinafter designated the "DOT", and the City of Dubuque Iowa, hereafter designated the "CITY" in accordance with 761 Iowa Administrative Code Chapter 150, Iowa Code sections 28E.12, 306A, 307.44, 312.2(16) and Sec.104(b)(2) and Sec. 149 of Title 23, United States Code; WITNESSETH; that WHEREAS, the DOT and CITY propose to improve an extension of Primary Road No. U.S. 20 within the CITY; and WHEREAS, the DOT and the CITY are willing to jointly participate in said improvement, in the manner hereinafter provided; and WHEREAS, this Agreement reflects the current concepts for intersection improvements along U.S. 20 (Dodge Street) within the CITY which are subject to modification by the DOT; and NOW, THEREFORE, IT IS AGREED as follows: The DOT will be responsible for design, letting and construction inspection of the following described project in accordance wi~ the project plans and DOT standard specifications: The U.S. 20 (Dodge Street) project will involve intersection improvements extending from Devon Drive westerly and southwesterly to the west limits of the project at the new "Menards' entrance which is located along the south side of U.S. 20 approximately M mile southwest of the Iowa 32 intersection (see Exhibit "A" attached). The proposed improvements will be accomplished in two phases as further described below: Phase I will involve a traffic signal interconnect frOm Devon Drive extending westerly and southwesterly to the west limits of the project at the new "Menards" entrance. Phase II will involve installation of right and left-turn lanes, as determined by the current traffic engineering study, from Devon Drive extending westerly to Century Drive. C. The DOT will be responsible for project administration. The DOT will inspect this project, however, the DOT's design consultant will also be responsible for supplemental construction services involving the traffic signal work. SPecial Provisions The funding breakdown for project construction is shown on Exhibit "B" attached. Traffic Safety Funding secured by the DOT will be used for development and completion of the following described Traffic Safety Improvement which will be accomplished as part of this overall project: Existing signals on U.S. 20 from Devon Drive extending westerly and southwesterly to the new "Menards" entrance shall be interconnected as part of this project. Interconnection and coordinated traffic signal timing plans shall be developed by the DOT to provide for progressive traffic flow. No changes shall be made to said signal timing/coordination without the written approval of the OffiCe of Traffic and Safety of the DOT. General Provisions U.S. 20 through-traffic will be maintained during the construction period. The DOT will bear all costs except those allocated to the CITY under other terms of this Agreement. Upon completion of the project, no changes in the physical features thereof will be undertaken or permitted without the prior written approval of the DOT. Also as part of the project, it may be necessary to temporarily close various local CITY streets and/or alleys during portions of said project. If temporary closures are necessary, the DOT will furnish and install the required road closure barricades and signing at project cost and shall remove same upon completion of the project also at no expense or 10. 11. 12. 13. 3 obligation to the CITY. The DOT will work in close cooperation w/th the CITY and the contractor to accommodate fire protection and local access across the project during construction. Future maintenance of the primary highway within the project area w/Il be carried out in accordance with the terms and conditions contained in 761 Iowa Administrative Code Chapter 150. Any costs incurred by the CITY in performing its obligations hereunder will be borne exclusively by the CITY without reimbursement by the DOT. Parking shall be prohibited by the CITY with an appropriate ordinance which shall go into effect at such time as the project is completed and opened to through traffic. Parking shall be prohibited along both sides of U.S. 20 withh~ the limits of the proposed project. Subject to the provisions hereof, the CITY in accordance with 761 Iowa Administrative Code Sections 150.3(1)c and 150.4(2) will remove or cause to be removed all encroachments or obstructions in the existing primary highway right of way. The CITY will also prevent the erection and/or placement of any structure or obstruction on said right of way including but not limited to private signs, buildings, pumps, and parking areas. Subject to the approval of and without expense to the DOT, the CITY agree to perform or cause to be performed all relocations, alterations, adjustments or removals of existing utility facilities within the CITY, including but not limited to power, telephone and telegraph lines, fiber optics lines, natural gas pipelines, water mains and hydrants, curb boxes, storm water intakes, sanitary sewers, and related poles, installations and appurtenances, whether privately or publicly owned, and kll other facilities or obstructions which are located within the limits of an established street or alley and which will interfere with construction of the project and the clear zone, as provided in Chapter 761 Iowa Administrative Code Section 150.4(5) and in accordance with the Utility Accommodation Policy of the DOT referenced therein. The CITY will comply with all provisions of the equal employment oppommity requirements prohibiting discrimination and requiring affirmative action to assure equal employment oppornmity as required by Iowa Code Chapter 216. No person will, on the grounds of age, race, creed, sex, color, national origin, religion or disability, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which State funds are used. Miscellaneous Provisions 14. It is the intent o£both parties that no third party beneficiaries be created by this Agreement. 15. 16. 17. If any section, provision, or part of this Agreement shall be found to be invalid or unconstitutional, such judgment shall not affect the validity of the Agreement as a whole or any section, provision, or part thereof not found to be invalid or unconstitutional, except to the extent that the original intent of the Agreement cannot be fulfilled. This Agreement may be executed in two counterparts, each of which so executed w/Il be deemed to be an original. This document, including the attached Exhibits "A" & "B" represents the entire Agreement between the CITY and DOT regarding this improvement. Any subsequent change or modification to the terms of this Agreement will be in the form of a duly executed amendment to this document.
