Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting the plat subdivides an existing parcel
into two lots and that Lot 1 of 2 will be reserved as open space.
Staff reviewed the submitted plat of survey, noting that the Zoning Advisory Commission is
reviewing the plat because Lot 1 of 2 has no frontage.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that Lot 1 of 2 will not
have frontage, but if only used for open space, will not adversely impact adjacent property.
The Commission required that the plat be revised to label Lot 1 of 2 as "non-buildable."
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION APPROVING THE PLAT OF SURVEY LOT 1-2 AND LOT 2-2 OF
SHIPTON'S SECOND ADDITION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Survey Lot 1-2 and
Lot 2-2 of Shipton's Second Addition in the City of Dubuque, Iowa; and;
Whereas, said plat provides Lot 1-2 with 0 feet of lot frontage where 50 feet of
lot frontage is required; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they
find that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 1-2 with 0 f~,et of lot frontage where 50 feet of lot frontage is required,
provided that Lot 1-2 is labeled as ~non-buildable2
Section 2 That the Plat of Survey is hereby approved, and the Mayor and
City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Plat of Survey.

SUBJECT: Plat of Survey Lot 1 - 2 and Lot 2 -2 of Shipton's Second Addition
INTRODUCTION
The submitted plat of survey of Lot 1-2 and Lot 2-2 of Shipton's Second Addition
subdivides an existing parcel of land fronting on Rockdale Road into two parcels. The
submitted plat of survey facilitates the sale of Lot 1-2.
DISCUSSION
The submitted plat of survey subdivides an existing 1.13-acre parcel into two lots. The
lot split is necessary to transfer ownership of Lot 1-2. However, Lot 1-2 will not have
frontage on a public street as required by the City of Dubuque Subdivision Regulations.
The future owner of Lot 1-2 has no plans to develop the parcel and plans to preserve it
as open space. The submitted plat of survey is in all other respects in compliance with
the City of Dubuque Subdivision Regulations.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission approve the
submitted plat of survey of Lot 1-2 and Lot 2-2 of Shipton's Second Addition. If the
Zoning Advisory Commission has a concern regarding the future development of Lot 1-
2, staff recommends that their motion include a stipulation that Lot 1-2 be labeled on the
plat as "non-buildable.'
