Minutes_Housing Code Appeals Board 10 21 08MINUTES OF HOUSING CODE APPEALS BOARD DATE: 21 October, 2008 TIME: 4:30 p.m. PLACE: Housing and Community Development Department Chairperson Robert Schaub called the meeting to order at 4:35 p.m. following staff assurance of compliance with Iowa Open Meeting Law. Board Members Present: Bill Kinsella Jim Matheos Robert Schaub David Young Staff Present: Robert Boge Roger Benz Tom Smith Tami Ernster Public Present: Dave Stuart Atty. Stuart Hoover Review and Certification of Minutes of 20 Mav 2008 Housing Code Appeals Board Meetinst Bill Kinsella motioned to approve the minutes. David Young seconded. Robert Schaub abstained. Motion passed. CorrespondencelPublic Input There was no public input. Consent Agenda The consent agenda items are considered to be routine and non-controversial and all consent items will be normally voted upon in a single motion without any separate discussion on a particular item. The following property owners have requested an extension of time to complete repairs. The Housing and Community Development staff concurs with the extension of time requested and respectfully requests Housing Appeals Board approval. Judge Properties, owner of 3203 Jackson Street #2 - extension to 11/10/08 ALL DEFICIENCIES AND MOTIONS ARE !N ACCORDANCE WITH THE DUBUQUE HOUSING CODE UNLESS OTHERWISE STATED. EXTENSIONS OF TIME ARE GRANTED 1N ACCORDANCE WITH SECTION 26-9.(I)(1}AND VARIANCES ARE GRANTED IN ACCORDANCE WITH SECTION 26-9.(f)(2}. Bili Kinsella moved to accept the consent agenda. Jim Matheos seconded. Motion passed. New Business CASE #1 ' Dave Stuart, owner of 1581 and 1589 Bluff Street is requesting the order of the Housing Officer be reversed as the owner feels these properties are not subject to Chapter 26 of the Housing Code. This is a GH inspection. Robert Boge presented the City's documentation for the repairs. Mr. Stuart provided background on the purchase and previous repairs to this building and his reasons why the Housing Department should not have jurisdiction in requiring that exterior repairs be made on his building. David Young moved that the Board table the matter pending a meeting with the City Solicitor, the Board and Mr. Boge to discuss the matter and decide jurisdiction. Jim Matheos seconded. Motion carried. Otd Business There are no items for old business. Information Sharing Bob Boge shared that the City is working on getting the Permits Plus inspection program up and running soon. ADJOURNMENT David Young motioned to adjourn. Jim Matheos seconded. Motion passed 4-0.
