Although I have had an opportunity to give input on this as a member of the Park and Recreation Advisory Commission, I write now as a private citizen, and I urge the council members to keep the park open. Although there are a small number of households that have been continuously calling for the closure of tl dog park, this is not substantially different from issues that arise in relation to any park. It is not uncommon for a few of those who live near any given park to complain that noise and/or activity is not a welcome addition to their neighborhood, but that doesn't mean that we shouldn't have parks. And unlike other parks, the hours of this park were reduced substantially, limiting the impact on neighbors. In all honesty, I have spent time at the park and have not heard all that much barking. In addition, I and other members of the commission have spent time in the Aspen Court neighborhood at various moments to get a sense of the impact of the dog park, and there hasn't been anything out of the ordinary in the way of noise. In fact, much of the barking heard comes from the Aspen Court neighborhood and the surrounding neighborhoods themselves. Possibly the echoing that occurs due to the bluff has confused some as to the source of the noise. Not only do I think that the dog park does not infringe on the rights of residents, I believe it is actually an asset to the city of Dubuque. If we want to attract the kind of young professionals to Dubuque who will keep our city and economy vital, we must provide the kinds of amenities that allow us to compete with other cities, and a dog park is certainly one of the ways we can do that. In addition, dogs that spend time with other dogs and people who are not their owners are more socialized, and thus present less of a nuisance to the people of Dubuque in general. I have never lived in a city that didn't allow leashed dogs in parks, as is the case in all but one or two part in Dubuque. Having a dog park allows those residents with dogs the ability to enjoy one park out of the many, and it puts the city in a competitive position for attracting businesses and professionals. The DHS would consider hosting a dog park if the city would be willing to put the $95,000 budgeted for a dog park towards the purchase of our land. The DHS has an option to purchase 13+ acres behind the Star movie theater. We have raised 40% of the money and have about $294,000 to go by December 1. This would mean that after we purchase the land we would not be able to have the park up and running until spring of 2010. We would like to meet with the city to see if we could cooperate together on a project to help the dog owners of Dubuque. We look forward to meeting with you. I can be reached at 584-1925. Roy Buol & Members of the City Council Dubuque City Hall Dubuque, IA 52001 Re: Pet Park Options Dear Mr. Mayor & Council Members: WAYNE A. NORMAN, JR. wan@thenormanlaw.com I am writing on behalf of Dubuque Yacht Basin, Inc. ("DYB"), in relation to the proposed Pet Park options. In short, we urge you not to choose the McAleece Park and Recreation Complex ("McAleece") for the following reasons: • Since the current owners purchased DYB in 2004, DYB has invested well into seven figures to upgrade facilities, build a new restaurant and acquire a tour boat to provide its patrons with a venue to relax, unwind and dine. These improvements have substantially increased the property tax dollars accruing to the City as result, and DYB hopes to make substantial additional improvements in the future. • Locating the Pet Park at McAleece would put the Park in much closer proximity to DYB's boat and motor home owners than it is now in its current location on North Grandview in relation the property owners across the street, and DYB has a much more dense population during the season than the neighborhood near the existing Pet Park. • Under its leases with the City, DYB has the right to "quiet enjoyment" of the leased property and its facilities. We suggest that locating the Pet Park at McAleece may well be a breach of the City's obligations under its leases with DYB. For these reasons, we sh•ongly recommend that if the present Pet Park is relocated, that it be to a site with no neighbors or strictly industrial/commercial neighbors in order to avoid the same problems which now exist at the North Grandview location.
