This is a claim in which the claimant alleges that he drove over a pothole on Cedar
Cross Road and damaged the rim on his vehicle.
According to the report of John Klostermann, Street & Sewer Maintenance Supervisor,
Public Works records indicate that crews patched holes on Cedar Cross Road prior to Mr.
Vogt's incident as recently as March 11 and April 1, 2009. Mr. Klostermann states that
while the Public Works Department has knowledge of the general condition of Cedar
Cross Road, records indicate that several attempts have been made to respond to the
pothole hazards as they develop.
It is therefore the recommendation of John Klostermann to deny this claim due to the
efforts that the Public Works Department has made to repair the hazards as they appear.
The City Attorney's Office concurs with this recommendation.
