A list of the proposed projects is included in the attached resolution. Background On March 27, 2009 the City received notification from the Iowa Department of Economic Development (IDED) of a $4.44,328 grant for the Neighborhood Stabilization Program (NSP). The purpose of the grant is to provide emergency assistance to state and local governments to purchase foreclosed or abandoned homes and to rehabilitate, resell or redevelop these homes in order to stabilize neighborhoods and deter decline in valuation of neighboring housing. The City of Dubuque must publish a notice of environmental review finding for projects to be funded with NSP funds. This notice allows 7 days for citizen and public agency comments on the environmental assessment of these programs. After that time, the City may file a Request for Release of funds with the Iowa Department of Economic Development (IDED). Discussion Publication of the attached notice, Exhibit A, indicates that the City of Dubuque has carried out its responsibilities according to HUD regulations. The approval of the attached resolution and the publication of its accompanying public notice are required procedural steps for securing the release of NSP funds. Recommendation Staff recommends that the City Council authorize publication of the Notice of Intent to Request Release of Funds for Neighborhood Stabilization Program funds. Copies of the environmental review record will be made available to the public and interested agencies. Public comment will be accepted until 5:00 p.m. on June 11, 2009 and will be taken into account before proceeding with the request for release of funds. Action Step The action step is for the City Council to adopt the attached resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the environmental review record for each of the projects shall be placed on file in the Office of the Housing and Community Development Department, 350 West 6t" Street, Suite 312, Dubuque Iowa where said record may be examined and copied by any interested party. Section 3. That the Mayor of the City of Dubuque is hereby authorized and directed to submit to the Iowa Department of Economic Development seven (7) days after publication of appropriate notice a Request for Release of Funds to undertake the said projects. Section 4. That the Mayor of the City of Dubuque is hereby authorized to consent to assume the status of a responsible federal official under the National Environmental Protection Act, insofar as the provisions of the said Act apply to the Iowa Department of Economic Development responsibilities for review, decision making, and action assumed and carried out by the City of Dubuque as to environmental issues. Section 5. That the Mayor of the City of Dubuque is hereby authorized to consent personally, in his official capacity and on behalf of the City of Dubuque, to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to environmental review, decision-making and action. The request and certification relate to the application of the City of Dubuque for a grant of funds for the Neighborhood Stabilization Program (NSP), as amended, for the purpose of undertaking the project(s) hereinafter _ described. Purchase and rehabilitate homes and residential properties that have been abandoned or foreclosed upon, in order to sell, rent or redevelop such homes and properties in Census Tracts 5 and 11.02 along the Central Avenue corridor north of 20th Street in the City of Dubuque, Iowa. The City of Dubuque has prepared an environmental review record respecting the above described project for which the release of funds is being sought. The environmental review record is available at the Housing and Community Development Department, 350 West 6th Street Suite 312, Dubuque, Iowa between the hours of 8:00 am to 5:00 pm Monday thru Friday where the same may be examined by the public and copies thereof obtained. Such written comments should be received at the address specified on or before June 11, 2009.
