Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer ~' _ - DATE: May 20, 2009 SUBJECT: North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project -Phase I I CIP 7101802 & 7201658 INTRODUCTION The attached resolutions authorize the public bidding procedure for the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project -Phase II. BACKGROUND In December of 2001, the City Council formally adopted the Drainage Basin Master Plan (DBMP) that outlined a series of improvements in the North Fork Catfish Creek watershed to address roadway overtopping and flood damage along the North Fork Catfish Creek between the Pennsylvania Avenue/John F. Kennedy Road intersection and the Northwest Arterial. With the adoption of the FY2008-FY2012 Five-Year Capital Improvement Program Budget, $1,659,364 was established for the North Fork Catfish Creek Stormwater improvements outlined in the DBMP. In March of 2004, the City funded an evaluation of the sanitary sewer collection system referred to as the "Key Way sanitary sewer." Based on the recommendations of the study prepared by Veenstra & Kimm, Inc., the City Council established $1,904,250 to replace the existing 12-inch diameter clay sewer with a 24-inch diameter ductile iron sewer from University Avenue to Key Way and replacing it with an 18-inch diameter ductile iron sewer from Key Way to the Northwest Arterial. In November of 2006, the City Council authorized the City Manager to submit an application for, and subsequently approved the use of, State Revolving Loan funds for the project. In December of 2006 the State approved the City's application, placing the project on the Iowa Finance Authority State Revolving Fund (SRF) loan program intended use plan. In November of 2007, the City Council authorized the hiring of IIW Engineers & Surveyors, PC (IIW) to design the channel, culvert, and sanitary sewer improvements associated with the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project. In February of 2009, the City submitted an application for stimulus funding for the project through the State Revolving Loan Fund Program. In April of 2009, the Iowa Department of Natural Resources notified the City that the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project was included on the proposed Intended Use Plan to receive federal stimulus funding in the form of a forgivable loan equal to 20% of the amount borrowed for the $3.5 million project. In April of 2009, the State of Iowa Homeland Security and Emergency Management Division (IHSEM) presented City staff with a Project Grant Agreement awarding $1,914,250 for the sanitary sewer improvements associated with the project. In May of 2009, the City Council authorized the public bidding procedure for the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project -Phase I. DISCUSSION The second phase of the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project involves the replacement of 1,595 feet of 12-inch diameter clay sanitary sewer with 24-inch diameter ductile iron sewer from Kensington Place, through the Pennsylvania/John F. Kennedy intersection, north to Keymont Drive. According to the Iowa Department of Natural Resources, there is soil and groundwater contaminated with petroleum byproducts due to leaking underground storage tanks that were associated with gas stations on the north and south sides of Pennsylvania Avenue. The contamination plume extends into the public right-of-way and the construction of the sanitary sewer will require that the City's contractor must monitor, handle, and dispose of the contaminated soil. Fortunately, the Iowa Comprehensive Petroleum Underground Storage Tank Fund was established to assist with remediation costs. Iowa Code 455G.9(10) authorizes the use of the fund to provide cities reimbursement for expenses incurred for treating, handling, and disposing of petroleum contaminated soil and groundwater. The construction cost estimate for Phase II is as follows: Construction Contingency Environmental Costs Engineering $ 919,014.60 91,901.46 403,450.00 101,091.61 Total Project Estimate $1,515,457.67 The schedule for Phase II of the project is as follows: Advertisement for Bids June 5, 2009 Notice of Hearing on Plans & Specifications June 5, 2009 Public Hearing June 15, 2009 Receipt of Bids June 23, 2009 Award of Contract July 6, 2009 Final Completion Date November 20, 2009 Phase II includes an intermediate completion date; by August 28, 2009 the work through the Pennsylvania/John F. Kennedy intersection must be complete so that the intersection is completely open for traffic when school starts in the fall. The third and final phase of the project will involve the construction of the sanitary sewer from Keymont Drive to the west along the creek to the Northwest Arterial. Phase III will also include culvert improvements at Key Way and Rosemont Street and creek improvements to improve flow and stabilize the creek banks. Bidding of Phase III will likely take place in late July or early August of 2009. RECOMMENDATION I recommend that the City Council establish the date for the public hearing and authorize the City Clerk to advertise for proposals for the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project -Phase II. BUDGET IMPACT The sanitary sewer portion of the project will be funded from the Fiscal Year 2007, 2008, and 2009 appropriations for the North Fork Catfish Creek Interceptor Upgrade - University Avenue to the Northwest Arterial (CIP#7101802) in the amount of $1, 904,250. The stormwater improvements will be funded from the Fiscal Year 2005 appropriation for the Pennsylvania/John F. Kennedy Culvert Improvement (CIP#7201658) in the amount of $169,125. The North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project - Phase II involves the reconstruction of the sanitary sewer from just north of Kensington Drive to Keymont Drive. This work is eligible for the FEMA Hazard Mitigation Grant Program funds. Per the award agreement, 85% of the construction and engineering services costs associated with the project are eligible for the grant funding. Project expenses prior to April 16, 2009, such as the design engineering, are ineligible. Moreover, construction contingencies are ineligible. The approximate federal, state, and City share of the Phase II cost is $590,193.68, $482,142.49, and $457,121.49 respectively as outlined in Table 1. The state share reflects the reimbursement the city will receive for the estimated $403,450.00 associated with the contaminated soil and groundwater. The City intends to borrow $443,121.49 through the SRF program with approximately $82,405.98 of the loan to be forgivable through the ARRA stimulus package. Table 1.
