City Engineer Gus Psihoyos is recommending City Council approval of the plans,
specifications, form of contract and estimated cost of $302,374.97 for the Green Alley
Pilot Project (11t" - 13t" Between White and Jackson Streets), and approval of the
Resolution of Necessity and the Preliminary Schedule of Assessments.
Since this is a pilot project, it is proposed that the alley pavement not be assessed. This
project will help determine the appropriate pavement type to be used on future alley
reconstruction projects that will be assessed. Engineering staff has started preliminary
work on developing an Alley Assessment Policy. It is expected that this policy will be
brought to the City Council this fall. The lead service lines would be replaced and,
consistent with current City policy, would be assessed to the property owner.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

property owner. This is in accordance to current policy when encountering lead water
services.

I recommend that the City Council approve the plans, specifications, form of contract
and the estimated cost and to adopt the Resolution of Necessity and the Preliminary
Schedule of Assessments for the Green Alley Pilot Project.
BUDGET IMPACT
The estimate of probable cost for the Green Alley Pilot Project is as follows:

It is proposed that the majority of the funding for this project come from Community
Development Block Grant Recovery Funds. The Housing Department received this
stimulus funding and needs to have the funds committed by June 17, 2009. It is felt that
this funding would be an ideal fit for this project and it would reduce the use of city
funding on this project. The Housing Department will be drafting a separate memo
concerning the proposed funding for this project.

RESOLUTION WITH RESPECT TO THE ADOPTION OF THE RESOLUTION OF
NECESSITY PROPOSED FOR THE GREEN ALLEY PILOT PROJECT (11TH - 13TH
BETWEEN WHITE JACKSON STREETS)
Whereas, the City Council has proposed a Resolution of Necessity for the Green
Alley Pilot Project (11t" - 13t" between White & Jackson Streets) and has given notice of
the public hearing thereon as required by law; and
Whereas, the public hearing has been held, all persons offering objections have
been heard and consideration given to all objections and is pending before this Council;
and
Whereas, this is the time and place set as provided for the taking of action on the
proposed Resolution of Necessity.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
That the proposed Resolution of Necessity described above is hereby:
x_ Adopted, without amendment, and all objections filed or made having been duly
considered are overruled.
Adopted as amended by the Preliminary Schedule of Assessments attached
hereto as Exhibit A, and made a part hereof by reference. All objections filed or
made having been duly considered are overruled.
Deferred for later consideration to a City Council meeting to be held on the
day of , 2009, next at 6:30 p.m. in the Historic Federal Building
Council Chambers (second floor), 350 West 6tt' Street, with jurisdiction retained
for further consideration and action at the adjourned meeting.
