Mission: The mission of the commission is to build the community of Dubuque through arts and cultural programs by developing visibility, funding, audiences, information and partnerships. (Ord. 64-04, ? 1, 9-7-2004) Sec. 8-13. Goals: The goals of the commission shall be as follows: (1) To promote, educate and create awareness for arts and cultural activities in the Dubuque community; (2) To develop and increase the market for arts and cultural activities in the Dubuque community; (3) To facilitate and convene partnerships for arts and cultural activities in the Dubuque community; and (4) To develop funding options and allocate budgeted funding for arts and cultural activities in the Dubuque community. Purpose: The purpose of the arts and cultural affairs advisory commission shall be to plan, promote and encourage programs to further public awareness of, accessibility to, participation in and support for the artistic and cultural development of the city and to make recommendations to the city council regarding the establishment of arts and cultural policies and programs, the expenditure of budgeted city funds on arts and cultural activities and the implementation of programs for arts and culture. (Ord. 64-04, ? 1, 9-7-2004) e ®1 er : The commission shall have the following powers: (1) To act in an advisory capacity to the city council in all matters pertaining to the arts and cultural environment of the city; (2) To hold regular public meetings and maintain a written record of its proceedings; (3) To make recommendations to the city council on the allocation of budgeted city funding for arts programs and services; (4) To recommend to the city council applications and solicitations for grant, gifts and donations from individuals, groups, organizations and agencies, both private and public, for any purpose consistent with the purposes of the commission; (5) To make recommendations to the city council regarding city sponsorship of public programs to further the development of public awareness of and accessibility to arts and culture programs and activities; (6) At the request of the city council, to work with area organizations on broad community issues in which a cultural perspective is relevant and desirable; and (7) To engage in comprehensive planning for the cultural development of the city. The initial term of four (4) of the members shall be for three (3) years and the initial term of three (3) of the members shall be two (2) years. Thereafter, all terms shall be three (3) years. The expiration date for all terms of office shall be June 30 of the appropriate year. (b) Four (4) members of the commission shall have significant knowledge and demonstrated interest in one or more areas of the arts including music, dance, literature, visual arts, theater, folk arts, media arts, design, arts education or be a member of the Dubuque Cultural Alliance. Two (2) members shall be from the business and professional community, one of whom lives or works in the cultural and entertainment district. One member shall be at large who lives or works outside the cultural and entertainment district. (c) Vacancies caused by death, resignation or otherwise shall be promptly filled by the city council for the unexpired term of office. Each brings a unique expertise to our work: Geri Shafer has been instrumental in initiating the first economic impact study of arts and culture in Dubuque, in our successful application and funding from the Iowa Community Cultural Grant in 2008, in authoring the Commission's position statement in support of keeping the Curtis Collection in Dubuque and in helping formalize our grant review process. Ellen Henkels brings the perspective of a working artist and art educator; she is key to the on-going success of the Art on the River public sculpture program. Julie Steffen is new to the Commission this year, but has already made an impact with her younger perspective as well as a strong business point of reference. She is a vital contributor to Commission meetings. The experience each brings adds to the whole as we move forward to meeting the Commission's long and short-term goals and continuing to grow Dubuque as a vibrant community for arts and culture. The reason I am applying for a second term is that the current commission has fine tuned a number of procedures for awarding grant monies. I feel that I understand the process well and have begun to see possibilities for additional funding opportunities such as National Endowment for the Arts and using Americans for the Arts as partners for the City. 1 am a very proud of Dubuque and the progress the City has made in the last decade. I want to see the Warehouse District blossom as well as the whole Cultural Corridor. I would like to have every person in the Dubuque Community have access to enjoy arts and culture throughout the whole City. Section 112, "Board Of Appeals," is hereby amended by repealing such section and replacing such section with a new section in lieu thereof as follows: Sec. 112. Building Code and Advisory Appeals Board. (a) Board Established. In order to determine the suitability of alternative building materials and methods of building construction, to provide for reasonable interpretation of the provisions of the building code, and to advise the city council on all building construction regulations and procedures, there is hereby created the building code advisory and appeals board. (b) Membership. The building code advisory and appeals board shall consist of five (5) members appointed by the city council. One (1) member shall be an architect or engineer registered in the state of Iowa, one (1) member shall be a general building construction contractor, one (1) member shall be a journeyman carpenter, and two (2) members shall be from the public at large. (c) Term Of Office. The term of office of all board members shall be for three (3) years, except that initial appointments of one (1) member shall be for a term of one (1) year, two (2) members for two-year terms and two (2) members for three- yearterms. (d) Rules And Regulations. The board shall make such rules and prescribe such procedures as may be reasonably necessary for its operation, except that such rules shall include the following: (1) Board Chairperson. The chairperson of the board shall be a member of the board elected annually by a majority of the board. (2) Secretary Of The Board. The building official, or designee, shall be secretary of the board. The secretary shall arrange for meetings and prepare and keep such minutes and records and perform such other clerical work as the board may direct. (3) Quorum. Three (3) members shall constitute a quorum. The concurring vote of three (3) members of the board shall be necessary to pass any motion. (4) Service Until Appointment Of Successor. Upon completion of the term of office, members of the building code board shall continue to serve in their full capacity until their successor has been duly appointed. (5) Meetings. The building code board shall meet upon call of the chairperson, secretary or city manager. Members of the building code board shall attend at least two-thirds of all scheduled meetings within atwelve-month period. If any member does not attend such prescribed number of meetings, it shall constitute grounds for the board to recommend to the city council that said member be replaced. (6) Attendance. The attendance of all members shall be entered on the minutes by the secretary. (7) Conformity With Open Meetings Law. All meetings shall be held in conformance with provisions of the Iowa open meetings law. (8) Minutes. The building code board shall file with the city council a copy of the minutes of each meeting of the board within ten (10) working days after such meeting. (9) Administrative Policies. All administrative, personnel, accounting, budgetary, and procedural policies of the city shall govern the building code board in all of its operations. (10) Duties When Serving As An Appeals Board. Any person who is aggrieved by a decision of the building official on any requirements resulting from the enforcement of the building code, may appeal from such decision to the building code board and said board shall serve as an appeal board. In case the aggrieved party is a member of said board, said member shall be disqualified as a member of the board acting as an appeal board, until the person aggrieved has been heard and a decision rendered. The appeal shall be made by the person aggrieved, giving written notice of such appeal to the building official within seven (7) days of receipt of decision from which the appeal is taken. The building code board sitting as an appeal board shall meet within ten (10) working days after receiving such notice and render a decision within five (5) working days thereafter. Any interested party, including the building official, shall have the right to present their case to the appeal board, whose decision shall be final unless appealed to the district court as provided by law. The board of appeals may reverse or modify a decision of the building official only on finding that: a. The building official had incorrectly interpreted the provision of this code; b. The decision of the building official creates an unnecessary hardship upon the appellant. The board of appeals shall require that sufficient evidence or proof be submitted to substantiate any claims made regarding the use of alternates. All appeal hearings shall be conducted in accordance with the procedures specified in this code. (e) Limitations Of Authority. The board of appeals shall have no authority relative to interpretation of the administrative provisions of this code nor shall the board be empowered to waive requirements of this code. In so modifying or reversing such decision of the building official, the board of appeals may authorize any alternate to the decision of the building official and the provisions, provided it finds the proposed material or method of construction is satisfactory for the use intended and complies with the provisions of this code, and that the material, method or work offered is, for the purpose intended, at least equivalent to that prescribed by this code in suitability, strength, effectiveness, durability, fire resistance and safety. Chapter 11 of the Dubuque Code of Ordinances is hereby amended by adding the following Article VIII: ARTICLE VIII. Accessibility Code for Readily Achievable Changes Sec. 11-84. Public accommodations. A place of public accommodation means a facility whose operations fall within one of the following categories: (a) An inn, hotel, motel, or other place of lodging, except for an establishment located within a building that contains not.more than five (5) rooms for rent or hire and that is actually occupied by the proprietor of such establishment as the residence of such proprietor; (b) A restaurant, bar or other establishment serving food or drink; (c) A motion picture house, theater, concert hall, stadium or other place of exhibition or entertainment; (d) An auditorium, convention center, lecture hall or other place of public gathering; (e) A bakery, grocery store, clothing store, hardware store, shopping center or other sales or rental establishment; (f) A Laundromat, dry-cleaner, bank, barber shop, beauty shop, travel service, shoe repair service, funeral parlor, gas station, office of an accountant or lawyer, pharmacy, insurance office, professional office of a health care provider, hospital or other service establishment; (g) A terminal, depot or other station used for public transportation; (h) A museum, library, gallery or other place of public display or collection; (i) A park, zoo, amusement park or other place of recreation; Q) A nursery, elementary, secondary, undergraduate, or postgraduate private school or other place of education; (k) A day care center, senior citizen center, homeless shelter, food bank, adoption agency or other social service center establishment; and (I) A gymnasium, health spa; bowling alley, golf course or other place of exercise or recreation. Sec. 11-85. Owner defined; Landlord and tenant responsibilities Fpr purposes of this Article, owner shall mean the owner of a building that is or houses a place of public accommodation, a landlord who owns property that is or 012408ba1 houses a place of public accommodation) and a tenant who owns or operates a. place of public accommodation. Sec. 11-86. Removal of architectural barriers if readily achievable. (a) 1t shall be a violation of this ordinance for an owner of a public accommodation to~ fail to remove architectural barriers, and communication barriers that are structural in nature, in any public accommodation, where such removal is readily achievable. The phrase "readily achievable" shall have the meaning set forth under the Americans with Disabilities Act of 1990 (42 U.S.C. 12182), as amended, and any implementing regulations. (b) Where an owner can demonstrate that the removal of a barrier under subsection (a) is not readily achievable, an owner shall nonetheless be required to make existing facilities available through alternative methods if such methods are readily achievable. Sec. 11-87. General Enforcement. The. building official is authorized to take such action as may be necessary to enforce this Article. Sec. 11-88. Compliance agreements. In lieu of or in addition to any penalty or procedure authorized herein or by law, the building official and an owner accused of violating Chapter 11, Article VIII may enter into a written agreement providing for the proper and timely abatement of violations. A compliance agreement may include a description of the specific action that will be taken to abate violations or to provide greater accessibility, a compliance timetable, a requirement for performance security, notice procedures and reporting requirements, liquidated penalties and other items reasonably related to the proper and timely abatement of violations. A compliance agreement shall constitute a written contract between the city and the owner which may be enforced by any appropriate action at law or in equity, including an action for specific performance or injunctive relief. A compliance agreement shall run with the land and shall be recorded. The violation of a compliance agreement shall constitute a separate violation of this Article. A compliance agreement shall not relieve an owner from the continuing obligation to comply with this Article or any other law or regulation pertaining to accessibility. Sec. 11-89. Notices and orders of building official (a) Whenever the building official has inspected or caused to be inspected any place of public accommodation and has found and determined that there exist .barriers whose removal is readily achievable, the building official shall commence proceedings to cause the removal of such barriers. (b} The building official shall attempt to reach an agreement with an owner alleged to have violated this Article on a plan for proper and timely abatement of violations. Such agreement shall be in writing signed by all of the owners and 012408ba1 the building official and shall include a description of the specific action that will be taken by the owner to abate the alleged violations or to provide greater accessibility, and a compliance timetable. A failure to abate the alleged violations in accordance with the timetable shall constitute a municipal infraction. (c) If the building official and an owner alleged to be in violation of this Article are unable to reach agreement within 30 days of inspection, for the abatement of the alleged violations, the building official shall issue a notice and order directed to all of the owners of the public accommodation. The notice and order shall include: (1) The street address and a legal description sufficient for identification of the premises upon which the building is located. (2) A statement that the building official has found that barriers exist whose removal is readily achievable. (3) A statement of the action required to be taken as determined by the building official. Such order shall require that all required permits be secured therefor and the work physically commenced and completed within such time as the building official shall determine is reasonable under all of the circumstances, but not to exceed twelve months from the date of the order. (4) Statements advising (a) that an owner may appeal from the notice and order or any action of the building official to the building code and advisory appeals board, provided the appeal is made in writing as provided in this Article and filed with the building official within thirty (30) days from the date of service of such notice and order; and (b) that failure to appeal will constitute a waiver of all right to an appeal of the matter. The building code and advisory appeals board shall follow the appeals and hearing process set forth in sections 11-26 and 11-27 of this Chapter, except that the board shall be supplemented with two additional members as described in section 11-89 for purposes of appeals under this Article. (d) Service of the notice and order shall be made upon all persons entitled thereto either personally or by mailing a copy of such notice and order by certified mail, postage prepaid, return receipt requested, to each such person at such person's last known address. If no address of any such person is known to the building official, then a copy of the notice and order shall be so mailed, addressed to such person, at the adriress of the building involver! in the proceedings and a summary of the notice and order shall be published in a newspaper as defined in Section 618.3 of the Iowa Code published in and having general circulation in the City. The failure of any such person to receive such notice shall not affect the validity of any proceedings taken 012408ba1 under this section. Sec. 11-90. Supplemental Membership on Building Code and Advisory Appeals Board. For purposes of enforcement of this Article, two additianal members shall be appointed by the City Council to the Building Code and Advisory Appeals Board. All programs, projects and services to be developed by the commission must conform to the policies of the city and to applicable local, state and federal laws, rules and regulations. The commission may solicit and otherwise accept donations and gifts of money, personal property and personal services. All such monies and personal property as received shall become the property of the city for the general use for the support of the civic center and its programs unless such items have been designated by the donors for specific purposes. (a) The commission shall be comprised of a membership of five (5) persons, who shall be appointed by the Dubuque City Council for terms of two (2) years. Two (2) of the initial appointments shall be for a term of one year, three (3) of such initial appointments shall be for a term of two (2) years. (b) Upon completion of their term of office, members of the commission shall continue to serve in their full capacity until a successor has been duly appointed. (c) Membership on the commission shall be limited to persons who are residents of the city. (d) On and after July 18, 1983, the terms of members of the commission shall be for three (3) years. Terms of those members originally scheduled to expire June 29, 1984, shall be extended to expire June 29, 1985, and terms of those members originally scheduled to expire June 29, 1985, shall be extended to expire June 29, 1986. (see last page) (a) The historic preservation commission is hereby established and shall consist of nine (9) members who shall be residents of the city. (b) Members of the commission shall be appointed by the city council as follows: one resident from each designated historic preservation district, including the districts hereinafter established; and four (4) at large members. Each member shall possess qualifications evidencing expertise or interest in architecture, history, archeology, law, construction or building rehabilitation, city planning or conservation in general. One commission member shall be a licensed architect. (c) Members shall serve three (3) year terms. (d) Vacancies occurring in the commission, other than through expiration of term of office, shall be only for the unexpired portion of the term of the member replaced. Each member shall serve until the appointment of a successor. (e) Members may serve for more than one term. (c) The commission shall adopt rules or bylaws for the transaction of its business. The bylaws shall provide for, but not be limited to, the time and place of holding regular meetings, the procedure for the calling of special meetings by the chairperson or by at least three (3) members of the commission and quorum requirements. (d) All meetings of the commission shall be subject to Iowa Code chapter 21, the Iowa open meetings act. (e) The commission shall keep a record of its resolutions, proceedings and actions. The records shall be subject to Iowa Code chapter 22, the Iowa public records act. (f) A quorum of the commission shall be required in order to transact business. (g) The affirmative vote of a majority of commission members present at a meeting shall be required for the approval of plans or the adoption of any resolution, motion or other action of the commission. Powers And Duties Generally; Procedures For ®perations: (a) The general duties and powers of the commission shall be as follows: (1) To promote and conduct educational and interpretive programs on historic properties within its jurisdiction; (2) To develop and adopt specific standards for review and design guidelines, in addition to those set forth in subsection 25-10 a of this chapter, for the alteration of landmarks, landmark sites or property and structures within historic districts; (3) To adopt its own bylaws; (4) To identify, evaluate, register, manage and protect significant prehistoric and historic archeological sites; (5) To conduct an ongoing survey to identify historically, archaeologically and architecturally significant properties, structures and areas that exemplify the cultural, social, economic, political, archeological or architectural history of the nation, state or city; (6) To research and recommend to the city council the adoption of ordinances designating areas as having historic, architectural, archeological or cultural value or significance as "historic districts"; (7) To research and recommend to the city council the adoption of ordinances designating properties or structures having historic, architectural, archeological or cultural value or significance as "landmarks" or "landmark sites"; (8) To maintain a register of all properties and structures which have been designated as landmarks, landmark sites or historic districts, including all information required for each designation; (9) To assist and encourage the nomination of landmarks, landmark sites and historic districts to the national register of historic places, and review and comment at a public hearing on any national register nomination submitted to the commission upon the request of the mayor, city council or the state bureau of historic preservation; (10) To confer recognition upon the owners of landmarks or of property or structures within historic districts; (11) To review in-progress or completed work to determine compliance with specific certificates of appropriateness or certificates of economic nonviability; and (12) To serve as an advisory design review body to the city council for review of public works projects which have historic preservation implications in historic districts, or for alteration of landmarks, landmark sites or structures, that would result in a material change in appearance or be visible from the public way. AN ORDINANCE AMENDING CHAPTER 25 (HISTORIC PRESERVATION) OF THE CITY OF DUBUQUE CODE OF ORDINANCES BY ADDING A NEW SECTION 25-3(h) TO ALLOW OWNERS OF REAL PROPERTY AND OWNERS OF BUSINESSES IN THE DISTRICT TO BE TEMPORARILY APPOINTED TO VACANT DISTRICT SEATS UNTIL SUCH A TIME A QUALIFIED RESIDENT CAN BE APPOINTED. Whereas, the Historic Preservation Commission has experienced occasional vacancies in membership due to the absence of qualified applicant for vacant seats on the Commission which seats require that the appointee be a resident of the district: and Whereas, the Historic Preservation Commission has found that such vacancies have in some instances reduced the effectiveness of the Commission; and Whereas, the Historic Preservation Commission has recommended an amendment to Chapter 25 (Historic Preservation) of the City of Dubuque Code of Ordinances to allow owners of real property and owners of businesses in the district to be temporarily appointed to vacant district seats until such a time a qualified resident can be appointed; and Whereas, the City Council concurs with the recommendation to allow owners of real property and owners of businesses in the district to be temporarily appointed to vacant district seats until such a time a qualified resident can be appointed; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Historic Preservation Commission Established; Membership; Term of Office; Vacancies in Office: (h) In the event that a vacancy occurs in a seat which requires that the appointee be a resident of the district and for which there is no application from a qualified resident, the City Council may appoint a person who is an owner of real property in the district or an owner of a business in the district to the vacant seat. This appointment shall be temporary and a resident of the district may at any time apply to fill this seat. Upon appointment of a qualified resident to this seat by the City Council, the temporary appointment shall terminate. Section 2. Housing Code Appeals Board: (a) Created: There is hereby created a Housing Code Appeals Board to have such powers and responsibilities to the extent of the authority granted by the City Council. (b) Purpose: The Housing Code Appeals Board shall conduct hearings upon application by any person aggrieved by a notice and order of the Housing Officer issued in connection with a violation of the City of Dubuque residential housing code or of any applicable rule or regulation issued pursuant to the City of Dubuque residential housing code. The Board shall also review revised or additional definitions and procedures submitted by the Housing Officer and shall be empowered to adopt, reject or modify same. If any member does not attend such a prescribed number of meetings, it shall constitute grounds for the Board to recommend to the City Council that said member be replaced. (4) The Housing Officer shall serve as secretary to the Board and shall render all decisions and findings in writing to the appellant. Intent: The City Council desires to assure full compliance with its cable franchise, that the franchise be interpreted and applied to the benefit of the City and its residents, that quality and updated services be delivered throughout the City, and that the public interest be protected in all matters related to the cable services delivery system. The membership may include a maximum of two (2) government officers and employees. Powers: The commission shall have the following powers, duties and responsibilities: (1) To provide a leadership role in the planning, coordinating and sponsoring of a periodic community planning process; (2) To coordinate and supervise the preparation and maintenance of the comprehensive plan; (3) To provide input to the city manager in the preparation of the city manager's recommended multi-year capital improvement program (CIP); (4) To make comprehensive studies of the present condition and the future growth of the city to provide input into the community planning process and to guide and accomplish a coordinated, consistent and harmonious development of the city in accordance with the present and future needs thereof to the end that the health, safety, morals, order, convenience, prosperity and general welfare may be promoted; (5) To make or cause to be made such surveys, studies, maps, plans, or charts of the city with due regard to its relation to neighboring territory as may be determined as necessary to carry out the purposes of the commission; (6) To recommend amendments to all or a part of the comprehensive plan in response to the community planning process, upon its own initiative or upon recommendation presented by the zoning advisory commission, but only after a public hearing; (7) To review proposed urban renewal plans and urban renewal plan amendments and urban revitalization plans and urban revitalization plan amendments for consistency with the comprehensive plan for the city; (8) To undertake public information efforts to enhance public understanding of the community planning process generally and the comprehensive plan specifically; and (9) To undertake from time to time other specific long-range planning projects which may be referred to it by the city council. Zoning Advisory Commission Created; Composition; Appointment: There is hereby created a City Zoning Advisory Commission, which shall consist of seven (7) residents of the City, appointed by the City Council, who shall be qualified by knowledge, experience and ability to act in matters pertaining to short-range planning and zoning, none of whom shall hold an elective position in the City. Appointment To Airport Zoning Commission: Two (2) members of the Commission shall be appointed by the City Council to serve on the Airport Zoning Commission. A member shall serve out the term on the Airport Zoning Commission even if the member's term on the Zoning Commission has expired. (Ord. 86-95, 12-18-1995) Sec. 36-11. Application And Appointment Process: The appointment process to the Commission by the City Council shall include at least the following: (1) An application form requesting basic information on the education, training, experience, expectations and other qualifications of the applicant; (2) Notice to and an opportunity for the general public to comment in writing on the qualifications of each applicant; and (3) A formal interview by the City Council to determine the applicant's qualifications and ability to effectively serve on the Commission. Terms; Filling Of Vacancies; Compensation: The term of office for members of the Zoning Advisory Commission shall be three (3) years or until a successor is duly appointed. Two (2) of the initial terms shall be for a term of one year; two (2) of the initial terms for two (2) years; and three (3) of the initial terms for three (3) years. A Commission member may be removed at any time with or without cause by a vote of two-thirds (2/3) of all members of the City Council. A vacancy occurring on the Commission caused by resignation or otherwise, shall be filled by appointment by the City Council for the remainder of the unexpired term. All members of the Commission shall serve without compensation except for actual expenses, which shall be subject to approval by the Council. P®wera: The Zoning Advisory Commission shall concern itself with short-range physical planning and shall have and possess the following powers, duties and responsibilities: (1) To prepare and recommend a Zoning Ordinance by exercising the powers conferred by Iowa Code chapter 414, "Municipal Zoning". Such Zoning Ordinance shall include the boundaries of the various zoning districts; the height, number of stories and size of buildings and other structures in each district; the percentage of ground that may be occupied; setback requirements; the size of yards, courts and other open space; the density of population; the location and use of buildings, structures, and land for trade, industry, commercial, residential or other purposes; and such regulations and restrictions necessary to enforce such zoning provisions. To this end the Zoning Advisory Commission shall prepare a preliminary Zoning Ordinance and hold public hearings thereon and after such hearings have been held, shall submit a final Zoning Ordinance and its recommendations to the City Council; (2) To recommend to the City Council, from time to time, as conditions require, amendments, supplements, changes or modifications to the Zoning Ordinance but only after a public hearing; (3) To make such surveys, studies, maps, plans or plats of the whole or any portion of the City and of any land outside thereof, which in the opinion of the Zoning Advisory Commission are consistent with the Comprehensive Plan and are necessary to carry out the purposes of the Commission; (4) To make recommendations to the City Council upon plans, plats or replats of subdivisions or resubdivisions within the City which show streets, alleys or other portions of the same intended to be dedicated for public use; (5) To make recommendations to the Long-Range Planning Advisory Commission on the preparation and maintenance of the Comprehensive Plan; (6) To fulfill those duties and responsibilities assigned to a City Planning Commission in Iowa Code chapter 409, "Plats"; and (7) To undertake from time to time other specific short-range planning projects which may be referred to it by the City Council.
