Description: To amend Section 4-3.11 Sign Regulations to place a freestanding sign
along the 7th Street frontage in a C-5 Central Business District.
Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant, Jeff Morton, spoke in favor of the request. He said that the current C-5
district regulations allow free-standing signs on Locust Street, but not on adjacent side
streets. He said that if the sign were to be positioned on the Locust Street frontage, it
would impede access to the accessible ramp and be obscured by the traffic signal. He
distributed a site diagram showing the location of the sign and some decorative planters
as related to the building and adjacent public right-of-way.
Staff Member Kritz reviewed the staff report noting that the existing C-5 district sign
regulations allow free-standing signs on Locust Street and Iowa Street and a portion of
Main Street. He said that the proposed amendment is limited to 7th Street from Locust
Street to the alley. He distributed aerial photos of the site. He said that if the sign were
to be moved to the Locust Street side, as permitted, it would conflict with the accessible
ramp and traffic signal.
There were no public comments.
The Zoning Advisory Commission discussed the request, the C-5 district sign
regulations and different options for placement of the sign. Commissioners discussed it
is better to place the sign as indicated, than to move it closer to Locust Street where it
would conflict with pedestrian access and a traffic signal. Commissioners noted that
this site is unique and because of the lot layout and architecture, signage on this site will
not be obtrusive.

Recommendation
By a vote of 6 to 1 the Zoning Advisory Commission recommends that the City Council
approve the request, as submitted.
A simple majority vote is needed for the City Council to approve the request.

Central Business District
INTRODUCTION
Jeff Morton and Dubuque Initiatives are requesting an amendment to the on-premise
sign regulations section of the C-5 Central Business District regulations to permit
freestanding signs along 7tH Street frontage. This 7tH Street frontage is limited to the
half-block between Locust Street and the alleyway between Locust and Main Streets.
Currently, freestanding signs in the C-5 District are permitted along Locust and Iowa
Street frontages and a portion of Main Street. The proposed amendment establishes
the same height and sign area as the existing freestanding signage allowed along
Locust and Iowa Street frontages.
DISCUSSION
Currently, the C-5 Central Business District sign regulations permit freestanding signs
along Locust and Iowa Street frontages and a portion of Main Street. Freestanding
signs are not permitted along 7tH Street frontage within the C-5 District. The restriction
on freestanding signage in the C-5 District was originally established, in part, because
most of the buildings within the C-5 District extend up to the public right-of-way affording
little, if any, space for signage. In 1998, the Zoning Advisory Commission and City
Council approved an amendment to the C-5 District sign regulations that allowed
freestanding signs of up to 100 square feet in area and 25 feet in height along Locust
and Iowa Street frontages. Several of the businesses along these frontages, including a
bank and gas station, are setback from the property line and are better able to
accommodate freestanding signage. In 2008, Cottingham and Butler received approval
for an amendment that allowed freestanding signage along Main Street from 4tH to 10tH
Streets.
The applicants are now proposing to amend the C-5 District regulations to permit
freestanding signs along 7tH Street between Locust Street and the alley. This

amendment only impacts two properties on 7th Street -the Roshek Building and U.S.
Bank. Both of the buildings within this area are built up to the public right-of-way
easement. Therefore, a freestanding sign located in this area would have to be
reviewed and approved by the City primarily for conflict with utility locations and traffic
and pedestrian safety. The proposed text amendment would allow freestanding signs
within the proposed area to be 100 feet in area and no taller than 25 feet in height.
RECOMMENDATION
Staff recommends that the Zoning Advisory Commission review the request in
accordance with Sections 3-3.5 and 4-3.1 of the Zoning Ordinance.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY REPEALING SECTION 4-3.11
SCHEDULE OF SIGN REGULATIONS FOR THE C-5 CENTRAL BUSINESS
DISTRICT AND ADOPTING SECTION 4-3.11 SCHEDULE OF SIGN REGULATIONS
FOR THE C-5 CENTRAL BUSINESS DISTRICT IN LIEU THEREOF, PERTAINING TO
THE ADDITION OF FREESTANDING IDENTIFICATION SIGNS ALONG 7T" STREET
FROM LOCUST STREET TO THE ALLEY.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) of the City of Dubuque
Code of Ordinances is hereby amended by repealing section 4-3.11 Schedule of Sign
Regulations for the C-5 Central Business District and adopting section 4-3.11 Schedule
of Sign Regulations for the C-5 Central Business District in lieu thereof, pertaining to the
addition of freestanding identification signs along 7t" Street from Locust Street to the
alley.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.
