City Engineer Gus Psihoyos recommends City Council approval of the plans,
specifications, form of contract and estimated cost of $1,529,457.67 for the North Fork
Catfish Creek Stormwater and Sanitary Sewer Improvements Project -Phase II. Of the
$1,529,457.67 total project cost, the City's share is $374,715.52, the State's share is
$482,142.49 and the Federal share is $590,193.68.

INTRODUCTION
Creek Stormwater and Sanitary Sewer Improvements
The purpose of this memo is to recommend adoption of the attached resolution to be
considered at a public hearing approving the plans, specifications, form of contract and
the estimated cost for the North Fork Catfish Creek Stormwater and Sanitary Sewer
Improvements Project -Phase II.
DISCUSSION
The second phase of the North Fork Catfish Creek Stormwater and Sanitary Sewer
Improvements Project involves the replacement of 1,595 feet of 12-inch diameter clay
sanitary sewer with 24-inch diameter ductile iron sewer from Kensington Place, through
the Pennsylvania/John F. Kennedy intersection, north to Keystone Drive.
According to the Iowa Department of Natural Resources, there is soil and groundwater
contaminated with petroleum byproducts due to leaking underground storage tanks that
were associated with gas stations on the north and south sides of Pennsylvania
Avenue. The contamination plume extends into the public right-of-way and the
construction of the sanitary sewer will require that the City's contractor must monitor,
handle, and dispose of the contaminated soil. Fortunately, the Iowa Comprehensive
Petroleum Underground Storage Tank Fund was established to assist with remediation
costs. Iowa Code 455G.9(10) authorizes the use of the fund to provide cities
reimbursement for expenses incurred for treating, handling, and disposing of petroleum
contaminated soil and groundwater.
Phase II includes an intermediate completion date; by August 28, 2009 the work
through the Pennsylvania/John F. Kennedy intersection must be complete so that the
intersection is completely open for traffic when school starts in the fall.
RECOMMENDATION
recommend approval of the plans, specifications, form of contract and the estimated
cost for the North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements
Project -Phase II.
BUDGET IMPACT
The sanitary sewer portion of the project will be funded from the Fiscal Year 2007,
2008, and 2009 appropriations for the North Fork Catfish Creek Interceptor Upgrade -
University Avenue to the Northwest Arterial (CIP#7101802) in the amount of
$1,904,250.
The stormwater improvements will be funded from the Fiscal Year 2005 appropriation
for the Pennsylvania/John F. Kennedy Culvert Improvement (CIP#7201658) in the
amount of $169,125.
The North Fork Catfish Creek Stormwater and Sanitary Sewer Improvements Project -
Phase II involves the reconstruction of the sanitary sewer from just north of Kensington
Drive to Keymont Drive. This work is eligible for the FEMA Hazard Mitigation Grant
Program funds. Per the award agreement, 85% of the construction and engineering
services costs associated with the project are eligible for the grant funding. Project
expenses prior to April 16, 2009, such as the design engineering, are ineligible.
Moreover, construction contingencies are ineligible. The approximate federal, state, and
City share of the Phase II cost is $590,193.68, $482,142.49, and $457,121.49
respectively as outlined in Table 1. The state share reflects the reimbursement the city
will receive for the estimated $403,450.00 associated with the contaminated soil and
groundwater. The City intends to borrow $443,121.49 through the SRF program with
approximately $82,405.98 of the loan to be forgivable through the ARRA stimulus
package.
