The Downtown Design Guidelines manual and a map of the project area are enclosed. BACKGROUND The creation of a Downtown Design Guidelines Manual is an action step of the Downtown Dubuque Master Plan adopted by the City Council in March 2004. The City of Dubuque has a grant agreement with the State Historic Preservation Office to develop a design guidelines manual for the streetscapes and built environment of the historic downtown. Like the City's Historic District Design Guidelines, the Downtown Design Guidelines address architectural design and streetscape/landscape design. The City Council selected Winter & Company as the consultant for this project. A Downtown Design Guidelines Task Force worked with Winter & Company to develop the Downtown Design Guidelines Manual. The Task Force includes downtown stakeholders, design professionals, and City staff. The Downtown Design Guidelines provided a portion of the local match for the federal grant which funded the Historic Millwork District Master Plan. This plan, adopted by the City Council in February 2009, specifically refers to the Downtown Design Guidelines. DISCUSSION The Design Guidelines manual is intended to provide guidance for improving properties within Downtown Dubuque. The guidelines are for property owners planning exterior alterations and additions to or the rehabilitation of existing buildings. They also guide the design of new structures. The guidelines will help property owners understand the historic character of downtown and assist with planning repair, maintenance, rehabilitation and new construction. Adoption and Implementation of Downtown Design Guidelines Page 2 The Downtown Design Guidelines are based on the Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Structures. The guidelines address the following: • An overview of preservation policies and principles, the City's design review system, and historic preservation benefits and resources. • Rehabilitation Guidelines for Historic Properties, including commercial, residential, and warehouse buildings. • Design Guidelines for all Properties, including signs and streetscape elements. • Guidelines for New Commercial Building Types. • Guidelines for New Residential Building Types. • Guidelines for New Warehouse Building Types. • Guidelines for New Transitional Building Types. • Character Area Design Guidelines. • Federal, state, local and other resources for technical and financial assistance. Implementation The implementation of the guidelines could be regulatory, advisory, or incentive-based. The Planning Services Department currently administers regulatory, advisory, and incentive-based programs using design guidelines. Regulatory An example of regulatory design guidelines is the Historic District Design Guidelines. These Guidelines are applied to exterior alterations in the City's 5 historic districts that require a building permit and are visible from public right-of-way. These projects are subject to design review by the Historic Preservation Commission unless signed off by Planning Services staff for compliance with these guidelines. As a regulatory approach, the Downtown Design Guidelines would apply to exterior alterations that require a building permit, demolition permits, and streetscape improvements that require a site plan approval (such as a parking lot) in the downtown area. All such work would have to comply with these design guidelines. Design review would be coordinated by the Planning Services Department. Appeals could be made to the Historic Preservation Commission or the City Council. The regulatory approach would ensure that the City's urban design vision for Downtown Dubuque as set forth in the guidelines is accomplished to the fullest extent. Advisory An example of advisory design review is the review of public works projects in historic districts. By City Code, the Historic Preservation Commission serves as an advisory design review body to the City Council for these projects. As an advisory program, the Downtown Design Guidelines would apply to exterior alterations that require a building permit, demolition permits, and streetscape improvements that require a site plan approval (such as a parking lot) in the downtown Adoption and Implementation of Downtown Design Guidelines Page 3 area. Design review would be coordinated by the Planning Services Department. With this approach, there would be no requirement for the applicant to adhere to the design guidelines. Appeals would not be necessary with an advisory review. The advisory design review would promote the City's urban design vision for Downtown Dubuque as set forth in the guidelines. There likely would be less compliance than if the guidelines were regulatory. Incentive-based An example of an incentive-based recommendation is the Historic Preservation Commission review process already established in the Greater Downtown Urban Renewal District. The adopted District Plan states the Secretary of the Interior's Standards for Rehabilitation and Guidelines for Rehabilitating Historic Structures will be used to guide the exterior modifications of historic and architecturally significant properties financed in whole or in part by the City of Dubuque and the improvement, installation, construction or reconstruction of public improvements in the District. The urban renewal district boundary is shown on the map. For the Downtown Design Guidelines, an incentive-based program could be tied to the City's funding programs available in Downtown Dubuque. For example, any project receiving public funds in the downtown area would have to comply with the Downtown Design Guidelines for exterior alterations and streetscape/landscape improvements. The Economic Development Department has done 22 projects in the Downtown Design Guidelines project area over the last five years, averaging 4 to 5 projects annually, using the incentive programs listed below: • City-funded programs for Downtown Dubuque are as follows: o Downtown Rehab Loan o Downtown Facade Grant o Downtown Design Grant o UDAG Loans/Grants o CDBG Loans/Grants o Development agreements using TIF • State and Federal pass-through programs used in Downtown Dubuque are: o EZ (Enterprise Zone) o CEBA Community Economic Betterment Account o HQJP High Quality Jobs Program o EVA Entrepreneurial Venture Assistance o RLF Revolving Loan Fund o EDA Economic Development Administration o EPA Environmental Protection Agency Adoption and Implementation of Downtown Design Guidelines Page 4 The Dubuque Main Street Board of Directors could also use an incentive-based approach, by making design review a requirement for their Downtown Loan Pool, using their design committee or some other process of the Board's choosing. Public Involvement Creation of the Downtown Design Guidelines has provided several opportunities for public involvement. In October 2008, the draft guidelines were presented to the Dubuque Main Street Board of Directors and to the Historic Preservation Commission, made available for public review and comment, and were the subject of a City Journal program. Review and discussion of the draft guidelines was coordinated with the Historic Millwork District master planning consultants in October and November 2008. The draft guidelines then were revised based on the input we received from the State Historic Preservation Office, the public, the task force, and other downtown stakeholders. At the City Council's December 1, 2008 work session on the Downtown Design Guidelines, Planning Services staff and consultant Nore Winter reviewed the format, content, and benefits of the design guidelines. Staff and Mr. Winter also discussed that implementation of the guidelines could be regulatory, advisory, or incentive-based. The City Council generally was satisfied with the format and content of the guidelines. City Council discussion on implementation included: • concerns over the implementation of the regulatory option, • protecting the downtown "core" district, • stakeholder preferences, • impact on the Historic Millwork District, • continued availability of incentives, • staged implementation of each option, and • consistency among the guidelines. City Council directed staff to seek more public input on how to implement the guidelines Input Received on Implementation As requested at the December 1, 2008 work session, the Planning Services Department sought additional input on implementation of the Downtown Design Guidelines. On February 5, 2009 and May 12, 2009, Planning Services staff hosted a series of open houses on the format, content and implementation of the Downtown Design Guidelines. Downtown property owners were invited to these open houses. Lists of attendees, comments received, and the mailing list are enclosed. Planning Services staff also asked the Historic Preservation Commission and the State Historic Preservation Office for further input on the Downtown Design Guidelines. Based on the input received, the draft guidelines were amended to include sustainable development and accessibility for persons with disabilities. Adoption and Implementation of Downtown Design Guidelines Page 5 The following input has received to date from the City Council, Task Force, Historic Preservation Commission, property owners, and the public regarding implementation options for the Downtown Design Guidelines. The Downtown Design Guidelines would apply to all exterior alterations that require a building permit, requests for demolition permits, and site improvements that require a site plan approval (such as a new or expanded parking lot) that fall into one of the following categories and are located in the project area: • Projects involving historic and architecturally significant properties (as identified on the map) that are financed in whole or in part with public funds. • Projects involving any other properties receiving public funds. • The improvement, installation, construction or reconstruction of public improvements. • Projects involving any property in the downtown core (as shown on the map). • All new construction. • Additions with a footprint of 500 square feet or greater. • All new or expanded parking areas. For projects that fall into one of these categories, the Historic Preservation Commission would serve as the design review body. Projects that comply with the Downtown Design Guidelines and do not create a material change in appearance could be approved by the Planning Services Department at the staff level without Commission review. Properties subject to State Historic Preservation Office review, such as historic tax credit projects, would not be subject to the Guidelines unless required by the State. This proposed implementation strategy would be subject to annual review and recommendation to the City Council by the Historic Preservation Commission as to whether the implementation process should be modified. The Historic District Design Guidelines and Port of Dubuque Design Standards would remain in place regardless of how the Downtown Design Guidelines are implemented. RECOMMENDATION Implementation of the Downtown Design Guidelines will add to the administrative workload of the Planning Services Department whether the guidelines are regulatory, advisory, or incentive-based. An incentive-based format will be considerably less of an administrative impact on the Planning Services staff than regulatory or advisory review. The Planning Services staff recommends the City Council use an incentive-based implementation strategy for the Downtown Design Guidelines similar to the current review process for private and public improvements in the Greater Downtown Urban Renewal District. Adoption and Implementation of Downtown Design Guidelines Page 6 Properties subject to State Historic Preservation Office review, such as historic tax credit projects, would not be subject to the Downtown Design Guidelines unless required by the State. Private Projects Receiving Public Funds Projects in the Downtown Design Guidelines project area financed in whole or in part by public funds, and that involve: a) exterior alterations that require a building permit, b) requests for demolition permits, and/or c) site improvements that require a site plan, would be subject to the Downtown Design Guidelines. These projects would be submitted to the Planning Services Department for analysis of compliance with the Downtown Design Guidelines. For projects that do not create a material change in the exterior architectural appearance or are normal repair and maintenance, and are in conformance with the Downtown Design Guidelines, Planning Services staff would sign-off on the project. Projects involving a material change in the exterior features of a structure or site, such as an alteration, construction, removal or demolition, would be considered by the Historic Preservation Commission. Waivers from the Downtown Design Guidelines could be granted by the Commission. Appeals of the Commission's decisions would be made to the City Council. Public Works Projects The improvement, installation, construction or reconstruction of public improvements in the project area would be subject to the Downtown Design Guidelines. These projects would be submitted to the Planning Services Department for analysis of compliance with the Downtown Design Guidelines.
