SUBJECT: Acceptance of Lot C and Lot D South Pointe Subdivision
DATE: January 8, 2018
City Engineer Gus Psihoyos recommends City Council acceptance of Lot C and Lot D
of South Pointe Subdivision in the City of Dubuque, lowa. These lots are being used for
storm water detention and approval of the resolution formally transfers title to the City of
Dubuque. Acceptance of the lots does not constitute approval/acceptance of the
recently constructed storm water detention facilities on the lot, which will not be
accepted until after they have been inspected and certain lots have been built on
according to the original plat acceptance resolution.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

SUBJECT: Acceptance of Lot C and Lot D South Pointe Subdivision
INTRODUCTION
The enclosed material provides for City Council acceptance of Lot C and Lot D of South Pointe
Subdivision in the City of Dubuque, lowa. These lots are currently being used as storm water detention
basins.
BACKGROUND
The final plat of the South Pointe Subdivision dedicated streets (Lots F, G, N, O, P, and Q), and storm
water detention lots (Lot C and Lot D). The resolution approving the plat and plans included the
acceptance of all dedicated lots except for Lot C and Lot D.
DISCUSSION
The approval resolution should have included the acceptance of said storm water detention lots, Lot C
and Lot D. The dedication of the storm water detention lots (Lot C and Lot D) should be accepted by
resolution to formally transfer title to the City of Dubuque. Acceptance of the lots does not constitute
approval/acceptance of the recently constructed storm water detention facilities on the lot. These
improvements will not be accepted until after they have been inspected and certain lots have been built
on according to the original plat acceptance resolution.
RECOMMENDATION
I would, therefore, recommend that the City Council accept the dedication of Lot C and Lot D of South
Pointe Subdivision.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the dedication of Lot C and Lot
D in South Pointe Subdivision.

RESOLUTION NO. 12-18
ACCEPTING LOT C AND LOT D OF SOUTH POINTE SUBDIVISION, IN THE CITY
OF DUBUQUE, IOWA
Whereas, Lot C and Lot D (Storm Water Detention), Lot F (Rockdale Road), Lot
G (South Pointe Drive), Lot N (Waterbridge Lane), Lot 0 (Cedar Trail Drive), Lot P
(Summit Hill Drive), and Lot Q (Whisper Woods Lane) of the Final Plat of South Pointe
Subdivision in the City of Dubuque, Iowa were dedicated to the public for the described
purposes; and
Whereas, Pursuant to Resolution No. 211-17, Lot F (Rockdale Road), Lot G
(South Pointe Drive), Lot N (Waterbridge Lane), Lot 0 (Cedar Trail Drive), Lot P
(Summit Hill Drive), and Lot Q (Whisper Woods Lane), of the Final Plat of South Pointe
Subdivision in the City of Dubuque, Iowa were accepted by the City of Dubuque for the
described purposes.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City of Dubuque wishes to now accept the dedication of Lot C
and Lot D of the Final Plat of South Pointe Subdivision for the purposes of owning and
maintaining the storm water detention facilities on said Lot C and Lot D.
Section 2. That the dedication of Lot C and Lot D of the Final Plat of South Pointe
Subdivision in the City of Dubuque, Iowa, is hereby accepted.
