SUBJECT:US 20 Highway Intersection Improvements
On December 16, 2002, the City Council approved the execution of a pro-construction
agreement between the City of Dubuque and the Iowa Department of Transportation
(IDOT) to construct improvements to US 20 within the City of Dubuque. Those
improvements involved traffic signal interconnect along the entire corridor and
intersection improvements from Devon Drive westerly to Century Drive.
Public Works Director Mike Koch is recommending City Council approval of the
Addendum to Preconstruction Agreement which will allow for the US 20 five-lane
widening project from the Northwest Arterial to just west of "Old Highway Road." The
project would provide for the creation of left-turn bays where there currently is
insufficient roadway width, allowing left-turning vehicles to make turns from the
protection of a separate lane, thereby decreasing the current risk of rear-end collisions
from other vehicles in the through lane. The current estimate for this project is
$760,000. The City will be responsible for 50% of the construction cost, up to a
maximum contribution of $350,000.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
On December 16, 2002, the City Council approved the execution of a pre-construction
agreement between the City of Dubuque and the Iowa Department of Transportation (IDOT) to
construct improvements to US 20 within the City of Dubuque. Those improvements involved
traffic signal interconnect along the entire corridor and intersection improvements from Devon
Drive westerly to Century Drive.
DISCUSSION
Enclosed is an addendum to the agreement to include the US 20 five-lane widening project from
the Northwest Arterial to just west of "Old Highway Road".
The City has been working with IDOT on roadway improvements to accommodate a five-lane
cross-section, as part of the Urban-State Traffic Engineering Program (U-STEP), to solve traffic
operation and safety problems. The project would provide for the creation of left-turn bays
where there currently is insufficient roadway width allowing left-turning vehicles to make turns
from the protection of a separate lane, thereby decreasing the current risk of rear-end collisions
from other vehicles in the through lane.
The current estimate for this project is $760,000. The City will be responsible for 50% of the
construction cost up to a maximum contribution of $350,000. IDOT will pay for the remaining
50% of the cost of construction up to a contribution of $350,000, plus 100% of all construction
costs above $700,000. The City's funding for this project is also provided for in the Fiscal Year
2003 and proposed Fiscal Year 2004 Capital Improvement Program.
The City will be the lead agency in the design of the five-lane improvement. The City's intent is
to contract with the engineering firm of Howard R. Green Company of iowa City, Iowa, since
they are designing the interconnect and other intersection improvements to be included in the
project. This will also keep the project on schedule for an anticipated March, 2003 bid-letting.
RECOMMENDATION
I would recommend that the City Council concur in the City's funding for the project and approve
the "ADDENDUM TO PRECONSTRUCTION AGREEMENT" between the City of Dubuque and
IDOT for this five-lane widening of US20.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution authorizing the Mayor to execute
two copies of the "ADDENDUM TO PRECONSTRUCTION AGREEMENT 2003-16-019".

OF TRANSPORTATION FOR IMPROVEMENTS TO US 20
Whereas, the City has entered into Pro-Construction Agreement No. STP-A-
2100(620)--86-31 with the Iowa Department of Transportation to provide traffic signal
interconnect along US 20 and to construct intersection improvements from Devon Drive
westerly to Century Drive.
Whereas, the Iowa Department of Transportation has prepared an addendum to
said pre-construction agroement between the City of Dubuque and the Iowa Department
of Transportation to include the construction of a five-lane widening project from the
Northwest Arterial to just west of "Old Highway Road"; and
Wheroas, the City Council of the City of Dubuque approves of said addendum
and funding participation as described in the pre-construction agroement addendum.
NOW, THEREFORE, BE IT RESOLVED BY THE CiTY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the addendum to the pre-construction agreement between
the City of Dubuque and the Iowa Department of Transportation for the US 20 five-lane
widening project from the Northwest Arterial to just west of "Old Highway Road" between
the City of Dubuque and the Iowa Department of Transportation be and is hereby
approved.
Section 2. That the Mayor be authorized and directed to execute two copies
of the addendum to the pre-construction agreement between the City of Dubuque and
the Iowa Department of Transportation.

This Addendum, is entered into by and between the Iowa Department of Transportation,
hereinafter designated the "DOT", and the City of Dubuque Iowa, hereafter designated
the "CITY" in accordance with 761 Iowa Administrative Code Chapter 150 and IOwa Code
sections 28E. 12 and 306A.7;
WITNESSETH; that
WHEREAS, the DOT has let a project to improve an extension of Primary Road No.
U.S. 20 as a controlled access facility within Dubuque County, Iowa; and
WHEREAS, the DOT and the CITY are willing to jointly participate in said project,
in the manner hereinafter provided; and
WHEREAS, this Addendum reflects the current concept of this project which is
subject to modification by the DOT; and
NOW, THEREFORE, IT IS AGREED as follows:
The CITY and DOT are currently negotiating Agreement 2003-16-019 for
construction of the following project:
Intersection improvements will be provided on U.S. 20 (Dodge Street)
extending from Devon Drive westerly and southwesterly to the new"Menards'
entrance which is located along the south side of U.S. 20 approximately ~ mile
southwest of the Iowa 32 intersection.

Subsequently the CITY requested that a five-lane, construction project also be
accomplished on U.S. 20, within the CITY, from just west of"Old Highway Road"
(Sta. 1174+51.30) extending northeasterly to just east of the "Northwest Arterial"
(Sta. 1200+26.62).
The proposed improvement will provide for 12-foot wide outside lanes, 11-foot
wide inside lanes, a 3-foot wide raised median with 2-foot wide curb and gutter
units on each side, 12-foot wide left-tm lanes (the 12-foot width includes a 2-
foot wide curb and gutter unit on the median side) and 8-foot wide shoulders (4-
foot paved, 4-foot granular). Said improvement will be accomplished in
accordance with the following terms and conditions:
The CITY shall provide project design for the 5-lane improvement, all at
no expense to the DOT.
The CITY shall submit the final design plans to the DOT no later than 12
weeks prior to the contract letting.
The DOT will let this improvement as part of the project described in
Section 1 herein:
D. The DOT will secure CITY concurrence in the contract award.
The current estimated cost for this project is $760,000. The CITY shall be
responsible for 50% &the cost of construction up to a maximum
contribution of $350,000. The DOT shall be responsible for the remaining
50% of the cost of construction up to a contribution of $350,000 plus
100% of all construction costs above $700,000.
The DOT shall provide construction administration.
General Provisions
If the CITY has completed a Flood Insurance Study (FIS), which may be affected by
the proposed Primary Highway project area, the CITY shall provide the DOT with a
copy of the FIS findings in a timely manner, so that final highway design decisions
can be determined as they relate to the potential for flooding as described in said FIS.
The CITY will comply with all provisions of the equal employment oppommity
requirements prohibiting discrimination and requiring affirmative action to assure
equal employment opportunity as required by Iowa Code Chapter 216. No person
will, on the grounds of age, race, creed, sex, color, national origin, religion or
disability, be excluded from participation in, be den/ed the benefits of, or be
otherwise subjected to discrimination under any program or activity for wh. ich State
funds are used.
Miscellaneous Provisions
It is the intent of both parties that no third party beneficiaries be created by this
Agreement.
If any section, provision, or part of this Addendum w/Il be found to be invalid or
unconstitutional, such judgment will not affect the validity of the Addendum as a
whole or any section, provision, or part thereof not fmmd to be invalid or
unconstitutional.
This Addendum may be executed in two counterparts, each of which so executed will
be deemed to be an original.
This document; as well as the unaffected provisions of Agreement 2003-16-019,
represents the entire Agreement between the CITY and DOT regarding this project.
Any subsequent change or modification to the terms of this Addendum will be in the
form ora duly executed amendment to this document.
