Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request indicating their intent is to construct a duplex on Lot
1 of 1 of 224.
Staff reviewed the surrounding land use and noted that the applicants are requesting the
Commission to waive the lot area requirement for both lots.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the minimum lot area is
5,000 square feet and that both lots are within 500 square feet of the lot area requirements.
The Commission found that waiving the lot area requirement would not adversely impact
adjacent properties.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve
the request.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Lot Split for Property. at 2389 University Avenue
INTRODUCTION
Dennis and Amy McCarthy, 2389 University Avenue, have requested to split an existing
9,345 square foot lot into two lots. Lot 2 will have 4,764 square feet of area and will
accommodate the existing residence and accessory off-street parking. Lot 1 will be
4,581 square feet and will be vacant.
DISCUSSION
The proposed lot split will create two lots that will have slightly less than the 5,000
square feet of area required. Lot 2 is a corner lot with 67 feet of frontage along
University Avenue and 74 feet of frontage along Finley Street. Lot 1 has 70 feet of
frontage along Finley Street. Both lots, therefore, meet the 50-foot minimum frontage
requirement.
The subject property is adjacent to an existing ten-unit multi-family residence. There is a
duplex adjacent to Lot 1 and a single-family residence across University Avenue from
Lot 2. Both lots are across Finley Street from an existing office/apartment building.
The applicants were granted a special exception from the Zoning Board of Adjustment
allowing them to place a duplex on the vacant lot. The duplex will be required to meet
all R-2 bulk standards and provide the requisite amount of off-street parking.
RECOMMENDATION
Planning staff recommend that the Plat of Survey Lot 1 of 1 of 224 and Lot 2 of 1 of 224
Finley's Addition be approved as the plat will not adversely impact the use and
enjoyment of adjacent property, and that the lot area requirement is waived to allow
both lots to have less than 5,000 square feet of lot area.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1 OF l/OF 224
AND LOT 2 OF 1 OF 224, FINLEY'S ADDITION
Whereas, there has been filed with the City Clerk a Plat of Survey of Lot 1 of 1
of 224 and Lot 2 of 1 of 224, Finley's Addition; and
Whereas, Lot 1 of 1 of 224 provides 4,581 square feet of area, and Lot 2 of 1 of
224 provides 4,764 square feet of area, where 5,000 square feet is required for each
lot by Section 42-19(b) of the Subdivision Regulations; and
Whereas, said survey plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said survey plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 1 of 1 of 224 to have 4,581 square feet and Lot 2 of 1 of 224 to have 4,764
square feet, where 5,000 square feet is required for each lot.
Section 2. That the Plat of Survey of Lot 1 of 1 of 224 and Lot 2 of 1 of 224,
Finley's Addition, is hereby approved, and the Mayor and City Clerk are hereby
authorized and directed to endorse the approval of the City of Dubuque, Iowa upon
said final plat.
