Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, stating that the submitted lot split would
allow them to transfer Lot 2 to their son. There are currently two houses on the same
lot and the lot split is necessary to convey the property.
Staff reviewed the request, stating the lot split would not result in any new homes being
built, but would place each existing home on a separate lot.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the submitted plat
is jointly reviewed by the City and County of Dubuque because of its location within two
miles of the City's corporate boundaries. The proposed lot split will not adversely
impact adjacent properties.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Subdivision of Lots 1 & 2 of O'Mara Second Subdivision
INTRODUCTION
The submitted plat is located within Dubuque County off of John F. Kennedy Road. The
subject property is within two miles of the city of Dubuque corporate limits and requires
joint review by the City of Dubuque and Dubuque County.
DISCUSSION
The submitted plat subdivides an existing property into two parcels. Lot 1 has existing
frontage on John F. Kennedy Road of 20 feet. The owner of the parcel is asking to
subdivide the parcel into a second lot of 2.6 acres and be served by the platted
easement for ingress and egress. Lot 2 will be conveyed to the owner's son to place an
existing single-family home on a separate lot. Lot 1 and Lot 2 do not have 50 feet of lot
frontage on a public or private street, and the Zoning Advisory Commission is being
asked to waive the lot frontage requirements for both lots.
Planning staff does not believe the proposed lot split will significantly impact adjacent
property. County subdivision requirements would require that a 66-foot wide right-of-
way easement for a pdvate street be provided before any additional subdivision of Lot 1
could take place.
RECOMMENDATION
Planning staff recommends that the submitted plat of subdivision of Lot 1 of 2 of O'Mara
Second Subdivision be approved subject to the waiving of lot frontage requirements for
Lot 1 and Lot 2.

RESOLUTION NO. 13-03
RESOLUTION APPROVING THE PLAT OF SUBDIVISION OF LOT 1 & LOT 2
OF O'MARA SECOND SUBDIVISION IN THE COUNTY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a Plat of Subdivision of Lot I &
Lot 2 of O'Mara Second Subdivision; and
Whereas, said plat provides Lot 1 with 20 feet of lot frontage and Lot 2 with 0
feet of frontage, where 50 feet of lot frontage is required; and
Whereas, said Plat of Subdivision has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said Plat of Subdivision has been examined by the City Council and
they find that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot I with 20 feet of lot frontage and Lot 2 with 0 feet of lot frontage, where 50
feet of lot frontage is required.
Section 2. That the Plat of Subdivision of Lot 1 & Lot 20'Mara Second
Subdivision is hereby approved, and the mayor and City Clerk are hereby author'~ed
and directed to endorse the approval of the City of Dubuque, Iowa upon said Plat of
Subdivision.
