Van Milligen, City Manager FROM: Gus Psihoyos, City Engineer DATE: June 26, 2009 SUBJECT: Southwest Arterial Project Right-of-Way Acquisition Iowa DOT Project No. ESL-2100 (646)--7S-31 INTRODUCTION The purpose of this memorandum is to seek City Council approval to authorize the City Engineer to execute all necessary documents on behalf of the City of Dubuque with respect to right-of-way property acquisitions for the Southwest Arterial Project. DISCUSSION The right-of-way property acquisition phase of the project will complete real estate property acquisition for approximately forty-seven (47) impacted properties within the project corridor for the construction of the Southwest Arterial, which is a proposed 6.1- mile four-lane arterial between U.S. Highway 61/151 and U.S. Highway 20. In an attempt to accelerate the right-of-way acquisition and the final design process, the City has evaluated several options to potentially "fast track" the project so that the Southwest Arterial project is positioned to potentially take advantage of any future state or federal economic stimulus funding packages, the new federal transportation bill, and the Iowa Department of Transportation (Iowa DOT) Five-Year Highway Transportation Improvement Program. On February 2, 2009, the City signed a joint partnership agreement between the City and the Iowa DOT to perform right-of-way property acquisition services for the Southwest Arterial Project. On April 6, 2009, the City Council approved the selections of: Iowa Appraisal & Research Corporation, Des Moines, Iowa to provide real estate property acquisition appraisals; and Peoples Company of Iowa, Indianola, Iowa to provide review appraisal services. In order to continue the Southwest Arterial "fast-track" process for right-of-way property acquisition completion within 12 months, it has been recommended by the Iowa DOT Right-of-Way Office that a City representative be authorized to execute all necessary documents on behalf of the City with respect to right-of-way property acquisitions for the Southwest Arterial Project. Therefore, it is recommended that City Engineer Gus Psihoyos be authorized to execute all necessary right-of-way acquisition documentation on behalf of the City. ACTION TO BE TAKEN I respectfully request that the City Council authorize City Engineer Gus Psihoyos to execute necessary documents on behalf of the City of Dubuque for right-of-way property acquisitions for the Southwest Arterial Project. cc: Bob Schiesl, Assistant City Engineer RESOLUTION NO. 214A-09 RESOLUTION AUTHRIZING THE CITY ENGINEER TO EXECUT NECESSARY DOCUMENTS ON BEHALF OF THE CITY OF DUBUQUE FOR RIGHT-OF-WAY PROPERTY ACQUISTION FOR THE SOUTHWEST ARTERIAL PROJECT Whereas, the City of Dubuque has designated the Southwest Arterial Project (the Project) as the No. 1 surface transportation priority in the Dubuque area and has commenced the right-of-way property acquisition phase on approximately forty-seven (47) impacted properties within the project corridor for the construction of the Project; and Whereas, to expedite the acquisition of right-of-way for the Project, the City Council has determined that the City Engineer should be authorized to execute all necessary documents on behalf of the City of Dubuque for right-of-way property acquisitions for the Project. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA, AS FOLLOWS: Section 1. The City Engineer is hereby authorized to execute all necessary documents on behalf of the City of Dubuque with respect to right-of-way property acquisitions for the Southwest Arterial Project.
