SUBJECT:Bell Street Construction Project
Sealed bids were received by the Iowa Department of Transportation in Ames on
January 14, 2003, for the Bell Street Construction Project. Subject to concurrence by
the Iowa Department of Transportation, Public Works Director Mike Koch recommends
award of the contract to the only bidder to comply with the specifications established by
IDOT for the project, Tschiggfrie Excavating Co., in the amount of $1,511,452.70, which
is 14.2% under the engineer's estimate.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution provides for the award of the Bell Street Construction Project.
DISCUSSION
Sealed bids were received by the Iowa Department of Transportation (IDOT) in Ames
on January 14, 2003. Tschiggfrie Excavating Co. of Dubuque, Iowa, was the only
bidder to comply with the specifications established by IDOT for the project. The bid of
Tschiggfrie Excavating Co. was in the amount of $1,511,452.70, which is 14.2 pement
under the engineer's estimate.
The project consists of the construction of Bell Street from Fifth Street to its northerly
terminus near Pine Street. The pavement will be 41-foot wide concrete, with curb and
gutter. The project includes the construction and installation of an ornamental railing
located between the back of sidewalk and the existing parking lot, placement of trees
every 40 feet, installation of an irrigation system, sidewalks, a recreational trail,
historical lighting, and two (2) directional monuments at the corner of Third and Bell
Street, and two (2) monuments at the westerly end of Fifth Street.
Existing Bell Street from 3rd to Fifth Street, and existing Fifth Street from White Street to
Bell Street will also include the placement of trees, irrigation systems, sidewalks, and
historical lighting behind the existing pavement. The pavement itself will remain as it
currently exists.

Subject: Contracts Recommended for Award
(City is Contracting Authority; DOT does not sign contract)
The Iowa DOT has accepted and reviewed bids on behalf of the City for the projects
enclosed.
We have enclosed a copy of the bid tabulations for each project; 2 sets of Material
Source sheets; and 3 originals of the contract for the City to execute with the contractor
who we have determined to be the lowest responsible bidder. To execute this contract,
we ask the City to take one of the following two options:
REJECT ALL BIDS OPTION
l. Do not contact the contractor to discuss rejection of the contract.
2. Take action to reject all bids.
3. Send written notification to the contractor of your intent m not award the
contract.
4. Send written notification to the Office of Contracts, Iowa DOT, of your action to
reject all bids, within 30 days.
AWARD A CONTRACT OPTION
1. Do not contact the contractor to discuss modifications to the contract.
2. Take action to award the contract.
3. Send 3 originals of the contract to the contractor and ask for two signed originals
to be returned to the City for the City's signature.
4. Obtain a "generic perfomanee bond" from the contractor for contracts $25,000
and over. Note: Bond fora 181218 and bond form 181217 cannot be used
as the performance bond form on City projects.
5. Obtain a "certificate of insurance" from the contractor listing both the contractor
and City as insured parties.
6. Have the contractor sign the "storm water discharge" certification statement for
those projects where the certification is required and remm m the City.
7.Send 2 sets of Material Source sheets to the contractor and have the contractor
remm one completed set of Material Source sheets to you.

8. After execution of the contract, the City shall send one photocopy of the contract,
one photocopy of the performance bond, one copy of certificate of insurance, and
the original of all "Subcontract Request and Approval" forms (please keep a copy
of the "Subcontract Request and Approval" form for your files) to:
Karen Lidman, Office of Contracts, Iowa DOT, 800 Lincoln Way, Ames,
IA 50010. These contract documents should be returned to the Office of
Contracts within 30 days, regardless of when the work is proposed to start. This
does not prohibit the contractor from requesting additional subcontractors during
the course of the contract. These additional subcontractor requests or changes
after the contract has been signed should be submitted te the Project Engineer
with the justification as required by the Iowa Code.
9. The City should funfish the contractor a signed original of the contract. No
work shall commence on this project until the contractor has been furnished a
signed contract.
10. The City is reminded that federal regulations may apply to this contract. The
City shall ensure compliance with all applicable civil rights, and Davis-Bacon
requirements. The Office of Contracts, Iowa DOT, will furnish the contractor
with applicable posters.
11. Please contact your District Local Systems Engineer regarding the
preconstruction meeting, and construction administration and inspection
requirements.

AWARDING CONTRACT
Whereas, sealed proposals have been submitted by contractors for the
Bell Street Construction Project pursuant to Resolution No~-~.~/-~',~ and notice to
bidders published in a newspaper published in the City of Dubuque, Iowa on the
19th day of December, 2002.
Whereas, said sealed proposals were opened and read on the 14m day of
January, 2003, and it has been determined that the bid of Tschiggfrie Excavating
Co. of Dubuque, Iowa, in the amount of $1,511,452.70 was the lowest bid for the
furnishings of all labor and materials and performing the work as provided for in
the plans and specifications.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That the contract for the above improvement be awarded to Tschiggfrie
Excavating Co., subject to the concurrence by the Iowa Department of
Transportation, and the Manager be and is hereby directed to execute a contract
on behalf of the City of Dubuque for the complete performance of the work.
BElT FURTHER RESOLVED:
That upon the signing of said contract and the approval of the contractor's
bond, the City Treasurer is authorized and instructed to return the bid deposits of
the unsuccessful bidders.

Sealed bids will be received by the Iowa Department of Transportation, at
the Department of Contracts in Ames, Iowa and at C.T. Mardott in Des Moines,
Iowa no later than 9:00 o'clock A.M. on the 14th day of January, 2003, for the Bell
Street Construction Project.
Copies of the plans and specifications may be obtained in the Office of
Contracts at the Iowa Department of Transportation in Ames, Iowa until noon on
the previous day of the letting.
Payment to the contractor will be made from funds as may be legally used
for such purposes.
Failure to execute a contract and file an acceptable Performance Bond
and Certificate of Insurance within 30 days of the date of the approval for
awarding the contract, as herein provided, will be just and sufficient cause for the
denial of the award and the forfeiture of the proposal guarantee.
All proposals must be filed on the forms furnished by the Iowa Department
of Transportation, Contracts Office, sealed and plainly marked. Proposals
containing any reservations not provided for in the forms furnished will be
rejected, and the Iowa Department of Transportation reserves the right to waive
technicalities and to reject any or all bids.
A Proposal Guaranty not less than the amount as set forth in the proposal
form shall be filed with each proposal. The Proposal Guaranty shall be in the

The successful bidder will be required to furnish a Performance Bond in
an amount equal to one hundred percent (100%) of the contract price. Said bond
is to be issued by a responsible surety company approved and acceptable to the
City Council and the Iowa Department of Transportation, and shall guarantee the
faithful performance of the contract and terms and conditions therein contained,
and shall guarantee the prompt payment of all materials and labor and protect
and save harmless the City of Dubuque, Iowa, and the Iowa Department of
Transportation from claims and damages of any kind caused by the operations of
the Contractor. Said Bond shall also guarantee the material and the
maintenance of the improvement(s) constructed for a minimum period of two (2)

bid which contains a condition or qualification upon the bid which has the effect
of qualifying or modifying any provision of the specifications in any manner will be

INTRODUCTION
At the July 15, 2002 City Council meeting, the City Council set the award of the
contract for the October 7, 2002 meeting. Because of an error on the part of the
Iowa Department of Transportation in the performance of the historic review of
the property upon which Bell Street will be located, the Iowa Department of
Transportation delayed the bid-letting on the project.
DISCUSSION
The project consists of the construction of Bell Street from Fifth Street to its
northerly terminus near Pine Street. The pavement will be 41-foot wide concrete,
with curb and gutter. The project also includes the construction and installation
of an ornamental railing located between the back of sidewalk and the existing
parking lot; placement of trees every 40 feet; installation of irrigation systems and
sidewalks; a recreational trail; historical lighting; and two (2) directional
monuments at the corner of Third and Bell Street, and two (2) at the westedy end
of Fifth Street.
Bell Street from 3rd to Fifth Street and Fifth Street from White Street to Bell Street
also includes the placement of trees, irrigation systems, sidewalks, and histOrical
lighting behind the existing pavement.

hearing for July 15, 2002. In addition, City staff was directed to investigate design
alternatives for the extension of Bell Street to avoid conflicts with the AIliant Energy
lattice structure. This project is to be funded 80% with Surface Transportation (STP)
Funds from the Iowa Department of Transportation (IDOT).
In reviewing the schedule for the construction of Bell Street and 5th Street, plans will not
be available on the July 12 bid order date and Assistant City Engineer Gus Psihoyos is
requesting that Resolution 322-02 be rescinded. However, engineering is requesting
that the public hearing remain scheduled for July 15 in order to meet the bid letting
schedule established by IDOT. In addition, the construction of 5th Street will impact the
new hotel. In an effort to meet the hotel's schedule, it is recommended that a part of the
construction of 5th Street be removed from the Bell Street project and included in the
construction of the hotel parking lot.
Lastly, City staff has provided two alternatives for the extension of Bell Street that would
avoid conflicts with the Alliant Energy lattice structure. Alternate #1 is being
recommended by HOK Venue, URS/BRW and the design review committee because of
the minimal impact in design to Bell Street and planned parking for the Education and
Conference Center and the Brewery development site.

BACKGROUND
On June 17, 2002, the City Council approved preliminary plans for the construction of
Bell Street and 5t~ Street, established July 15, 2002 as the date for the Public Hearing
on the adoption of the plans and specifications and the award of the contract, and
directed the City Clerk to advertise for bids. In addition, City staff were directed to
investigate possible design alternatives for the extension of Bell Street that would avoid
conflicts with the Alliant Energy power line lattice structure.
DISCUSSION
The Design Committee has considered two alternatives that would not require the
relocation of the lattice structure. Both alternatives would require the elimination of the
proposed monument at the end of Bell Street, and call for the redesign of the circular
cul-de-sac into a T-intersection. Both alternates would also allow for access to the
Conference Center parking lot from Bell Street in the same general location. Pine
Street would be redesigned around the lattice structure. The elimination of the
monument is being proposed because of height restrictions and possible visual conflict
with the tower. The new intersection is being proposed because it minimizes the right-
of-way requirements for Bell Street and retains existing parking counts for the Brewery
and Conference Center. Alternate 1 would allow the Bell Street alignment to remain as
it was previously designed. It would also allow for future extension of Bell Street.
Alternate 2 would angle Bell Street west of the lattice structure, and reduces the amount
of parking on the Brewery lot.
The Design Review Committee has recommended Alternate 1. The project, which will
be partially funded (80%) with Surface Transportation Funds (STP), was scheduled for
an Iowa Department of Transportation (IDOT) bid letting on August 20, 2002. However,
the archeological studies that IDOT performed did not include the entire project area.
Therefore, IDOT has indicated that the project may not be ready for the August 20,
2002 bid letting. To meet the hotel time schedule, the construction of 5th Street will be
removed from the Bell Street plan and added to the hotel parking lot plans.
RECOMMENDATION
I recommend that the City Council select Alternate 1 as the design for Bell Street and
that the City Council also adopt the attached Resolution rescinding Resolution 322-02,
ordering the publication of the Notice To Bidders, which was scheduled for July 12,
2002. This will allow the July 15, 2002 Public Hearing to take place as planned since it
is likely that the plans can be modified by this date.
ACTION TO BE TAKEN
I respectfully request that the City Council select Design Alternate 1 for the design of
Bell Street for approval at the Public Hearing set for July 15, 2002. I further recommend
that the City Council adopt the attached Resolution rescinding Resolution 322-02.

and the establishment of a public hearing for the Bell Street and Fifth Street
Construction.
DISCUSSION
The project includes the construction of Bell Street from Fifth Street to the
northerly end, and the construction of Fifth Street from Bell Street to the easterly
end.
The project will consist of the construction of a 41-foot street from back-of-curb to
back-of-curb from Fifth Street to the northerly end (approximately 900 feet long),
and a 37-foot roadway from back-of-curb to back-of-curb from Bell Street to 500
feet easterly to the floodwall.
The pavement will be concrete with curb and gutter. The City also included the:
construction and installation of ornamental railing that will be located between the
back of sidewalk and the existing parking lot; placement of trees every 40 feet;
installation of irrigation systems, sidewalks, and a recreational trail; historical
lighting; and five (5) directional monuments at the corners of Fifth Street, Third
Street and Bell, and the end of Bell Street.
This project is funded 80% by Federal STP funds, with the City paying the
remaining 20%. Engineering costs will not be reimbursed.
