ARTICLE IV. COMMUNITY DEVELOP.
MENT ADVISORY COMMISSION
Sec. 15-46. Creat~d~ Composition:
Individuals who, by their professional .or
personal experience or in~erest, are knowledge-
able of the development needs of the community
at large and of Iow and moderate income per-
sons in particular shall be considered qualified
to serve on the Commission, subject to City
Council review and consideration of other appli-
cable information. (Ord. 83-92, 11-2-1992)
There is hereby created a Community Devel-
opment Advisory Commission whose primary
purpose shall be to provide for citizen participa-
tion in the development and evaluation of the
City of Dubuque's Community Development
Block Grant CCDBG") program.
Sec. 15.48. Term; Filling Of Vacancies;
Compensation:
The term of office for a Commission member
shall be three (3) years except as set forth be-
low.
The Commission shall consist of nine (9)
members; five (5) of which shall be residents of
one of each of the five (5) census tracts with the
lowest median household incdme as determined
by the U.S. Department of Commerce, Bureau
of the Census; three (3) of which shah be resi-
dents of the community at large; and one of
which shall be a member of the Housing Com-
mission designated by the Honsing Commission.

Sec. 15-47. Application And Appointment
Process:
The process of appointment to the Commis-
sion by the City Council shall include at least
the following elements:
(1)
Submission of an application form con-
talning the requested information on the
qualifications and expectations of the
applicant; and
(2)
Notice to and an opportunity for the
general public to comment, in writing, on
the qualifications of each applicant; and
(3) A formal interview by the City Council to
The initial terms of the Commission shall be
as follows:
(1)
For each of the five (5) residents of the
~ve (5) census tracts with the lowest
median household income as determined
by the U.S. Department of Commerce,
Bureau of the Census; one shall be ap-
pointed for an initial term of one year,
two (2) shall be appointed for an initial
term of two (2) years; two (2) shall be
appointed for an initial term of three (3)
years.

For the three (3) community at large
residents; one shall be appointed for an
initial term of one year, one shall be
appointed for an initial term of two (2')
years, and one shall be appointed for an
initial term of three (3)years.
(3)
For the one member of the Housing Com-
mission designated by the Housing Com-
mission, the initial term shall be one
year.
A Commission member may be removed at
any time with or without cause by a vote of two-
thirds (el3) of all members of the City Council.

A vacancy occurring on the Commission
caused by resignation or otherwise, shah be
filled by appointment of the City Council for the
rema/nder of the unexpired term.
Members of the Commission shall serve with-
out compensation except for actual expenses,
which shall be subject to approval by the City

Sec. 15-49. Duties And Responsibilities;
General:
The Commission shall have the following
duties and responsibilities:
(1)
To conduct public hearings in accordance
with the minimum standards established
in the CDBG program's citizen participa-
tion plan to ensure meaningful citizen
input in the planning, implementation
and assessment of the City's CDBG pro-

To provide for and encourage the partici-
pation of low and moderate income per-
sons who reside in designated areas of
slum and blight and residents of low and
moderate income neighborhoods, as de-
fined by the City Council, in the plan-
ning, implementation and assessment of
the CDBG program;
(3)
To identify community development
needs, particularly the needs of persons
of low and moderate income;
(4)
To serve in an advisory role upon the
request of the City Council in policy
decisions regarding funding priorities
and program development and implemen-
tation;
(5)
To monitor and evaluate program activi-
ties to advise whether identified commu-
nity development objectives have been
met;
(6) To undertake public information efforts
to educate the citizenry of the availabili-
ty of CDBG funded programs and to.
provide for a greater understanding of
the City's community development ef-
forts; and
(7)
To assist in the preparation of the state-
ment of community development objec-
tires and projected use of funds, amend-
ments thereto and required reports in-
cluding, but not limited to, the annual
grantee performance report (GPR) and
the annual comprehensive housing assis-
tance strategy (CHAS);
(8)
To serve in an advisory role to the City
Manager in the review of complaints and
grievances received in accordance with
the procedures established herein in
Section 15-52;
(9)
To support, upon request, the efforts of
the City Council and other City commis-
sions in the assessment of the general
development needs of the connnunity.
The City Council shall have the autl~ority to
establish or revise the priorities of the Commis-

Sec. 15.50.
Duties And Responsibilities;
Grievance Procedure; Review
Standards; Appeal Process:
The Commission shall participate in the fol-
lowing described grievance procedure estab-
lished by the City Council for the community
development block grant program.
(1)
All complaints regarding the community
development block grant (CDBG) pro-
gram shall be handled in accordance
with the following described grievance
procedure.
Any aggrieved person shall file a
grievance with the City Manager,
Grievances shall be filed in a timely
manner and must be received by the
City Manager within one year of the
alleged occurrence.

attend at least two-thirds (2/3) of the regalarly
scheduled Commission meetings within a twelve
(12) month period, the Commission may request
the Council to declare that member's seat ya-
ck.ut. Attendance of all members shall be en-
tered in the minutes.
Sec. 44-218..Membership; Terms; Officers:
(a) The Cornr-ission shall consist of seven (7)
members appointed by the City Council. In its
appointments, the Council shall endeavor to
achieve a broad representation of the
subcemmunities and public interests which can
take advantage of dedicated chs~els to benefit
the residents of Dubuque. The Council shall
appoint only residents of the City and shall give
preference to applicants who are actively inter-
ested in prometing cc~-,~unity cable program-
ming who possess, or are willing to acquire,
video production background, and who will
relate to the spectrum of informational and
cultural needs of cable viewers of Dubuque.
The Cable Frauchise Administrator and any-
one who is an owner, shareholder, employee 'or
agent of the franchise holder shall be ineligible
to serve as a member of the Co~-~-ission. The
membership may include a maximum of two
government officers and employees.
-~Iembers of the Commission who represent
subcommunities utilizing dedicated ch~els
shall not be deemed to have a conflict of inter-
est in the use of the equipment and facilities
provided for that purpose solely because of their
membership on the Co,-,-isslon.
(b) The term of each member shall be for
three (3) years, with three (3) such terms expir-
ing each June, except those of the initial ap-
pointees only, three (3) appointments shall have
one year terms and three (3) appointments shall
have two (2) year terms. If a vacancy occurs
before the expiration of a term, the appoint-
ment shall be for tho unexpired portion of that
term. If the Council fails to make an appoint-
ment upon tho expiration efa term, the incum-
bent shall continue to serve until an appoint-

among themselves a presiding officer an/[ a
secretary whose offices shall expire the next
June. The City's Cable Franchise Administrator
shall be adviser to the Commission. (1976 Code,

Sec. 44-219. Meetings; procedures:
(a) The members -~hall meet as needed to
condu~t the business of the Coro,~ission, but
not less frequently than once each calendsx
quarter. A quorum of five (5) members shall be
required for members to conduct the business of
the Commission. All meetings and proceedings
of the Co,-~sion shall conform with applica-
ble open meeting requiremen.ts.
(h) The Commission shall file with the City
Council a copy of the minutes of each re~tlar
and special meeting withi~ ~en (10) days after
such meeting.
(c) All administrative, personnel, accounting,
budgetary, and procurement policies of the City
shall govern the Commission in all of its ope~a-
