Sealed bids were received for the Eagle Point Water Plant West Clear Well Phase II
Pipe Coating Project on April 8, 2009. K&W Coating, LLC submitted the low bid in the
amount of $35,000. This amount is approximately 32.5% under the estimate of
probable cost. Since then it was discovered that K&W Coating could not comply with
the City of Dubuque's insurance requirements. The City is now proceeding with the
recommendation in awarding the project to the second low bidder, Superior Painting &
Epoxy Coating, LLC in the amount of $36,256, which is approximately 30% under the
estimate of probable cost.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION:
Through City Council Action, on May 4, 2009, authorization was approved to proceed
with K & W Coating, LLC of Elkader, Iowa, to complete this phase of the project in the
amount of $35,000.
DISCUSSION:
Since the awarding of this project to K & W Coating, LLC, staff and I have been working
with them in an effort for them to comply with the contract specifications for this project.
Through several discussions and requests, it was discovered that K & W Coating, LLC
could not comply with the City of Dubuque's insurance requirements for this project.
As a result of this we are recommending through the attached Resolutions that the offer
to K & W Coating, LLC of Elkader be rescinded and that the project be awarded to the
second low bidder, Superior Painting & Epoxy Coating, LLC of Urbandale, Iowa in the
amount of $36,256.
Representatives from Superior Painting have advised us that they have no issues in
meeting the City's insurance requirements. They have agreed to honor their original bid
price and a new proposed construction schedule should they be awarded the project.
It is our recommendation to hold K & W Coating of Elkader, Iowa accountable for the bid
price difference of the two in the amount of $1,256 through their bond.
SUMMARY:

RECOMMENDATION:
The bid proposals for this project have been reviewed by the Water Department's
Consultant Firm, V & K Engineering of West Des Moines. It is their recommendation to
proceed with the second low bidder, Superior Painting & Epoxy, LLC of Urbandale,
Iowa.
This project phase has been reviewed and approved by the Iowa Department of Natural
Resources SRF Clerk-Specialist, Eunice Boyd. This review and approval process is
required when State Revolving Funds are to be used.
Staff and I concur with the recommendation(s) and request that the original contract
offer awarded to K & W Coating, LLC of Elkader, Iowa in the amount of $35,000 be
rescinded and the new contract be awarded to the second low bidder, Superior Painting
& Epoxy Coating, LLC of Urbandale, Iowa in the amount of $36,256.
BUDGET IMPACT:
The estimate of probable cost for the Clear Well Rehabilitation Pipe Coating Project is
summarized as follows:
Estimate:
Construction Contract $ 40,000
Contingency 6,000
Construction Engineering & Inspection 6,000
Total Estimated Rehabilitation Coating Cost $ 52,000
The interior coating to the west tank transmission pipes was scheduled to take place
under a separate contract immediately following completion of the construction
rehabilitation to the structure of this tank.
The following fund summary is as follows:
Funding for this project has been secured through prior approval of a state revolving
loan fund.

ACTION TO BE TAKEN:
I respectfully request that the City Council adopt the attached Resolutions, one in
rescinding the Eagle Point Water Plant Clear Well Reservoir Rehabilitation Phase II
(Pipe Coating) Project from K & W Coating, LLC of Elkader, Iowa in the amount of
$35,000 and approving the second Resolution in awarding this project to Superior
Painting & Epoxy, LLC of Urbandale, Iowa in the amount of $36,256.

Whereas, Resolution No. 142-09 awarded the public improvement contract to K
& W Coating, LLC of Elkader, Iowa for the Eagle Point Water Plant Clear Well Reservoir
Phase II Rehabilitation (Pipe Coating) Project; and
Whereas, K & W Coating, LLC has failed to meet and comply with the contract
insurance requirements for this project.
Now therefore, be it resolved by the City Council of the City of Dubuque, Iowa:
That Resolution No. 142-09 be and is hereby rescinded.

Whereas, sealed proposals were submitted by contractors for the Eagle Point
Water Plant Clear Well Reservoir Phase II Rehabilitation (Pipe Coating) Project (the
Project) pursuant to Resolution 116-09; and
Whereas, Resolution No. 142-09 awarded the public improvement contract to K
& W Coating, LLC of Elkader, Iowa for the Project; and
Whereas, K & W Coating, LLC failed to meet and comply with the contract
insurance requirements for the Project; and
Whereas, Resolution No. 142-09 has been rescinded; and
Whereas, Superior Painting & Epoxy Coating, LLC of Urbandale, Iowa with a bid
in the amount of $36,125 is the next lowest responsive, responsible bidder for the
Project.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
That a Public Improvement Contract for the Project is hereby awarded to
Superior Painting ~ Epoxy Coating, LLC of Urbandale, Iowa and the City Manager is
hereby directed to execute a Public Improvement Contract on behalf of the City of
Dubuque for the Project.
