The application, memorandum and related materials are attached for your review. Discussion The applicant spoke in favor of the request noting that he has lived at this address for 75 years. He said that he would like to give two parcels of land to his daughters. Staff Member Kritz discussed the previous plat request noting that the property is located in the County within the City's two-mile extraterritorial jurisdiction. He said that the County Supervisors did not approve the previous plat because of the inability to obtain a mortgage release for one of the lots. As a result, Mr. Graf has resubmitted a modified plat. He said the new plat is the same as the previous submitted final plat with the exception of removing the aforementioned lot. He recommended the Commission approve the final plat subject to waiving Article IV, except for Section 42-19 Lots & Blocks. There were no public comments. Recommendation By a vote of 5 to 0, the Zoning Advisory Commission recommends that the City Council approve the request subject to waiving Article IV, Design Improvement Standards of the City of Dubuque Subdivision regulations, except for Section 42-19 Lots & Blocks. A simple majority vote is needed for the City Council to approve the request. Whereas, there has been filed with the City Clerk a Final Plat of Graf Farm Subdivision in Dubuque County, Iowa; and Whereas, the Final Plat has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said Final Plat has been examined by the City Council and they find that it conforms to the statues and ordinances relating thereto. Whereas, Resolution No. 362-08 approved the Final Plat of Graf Farm subdivision but included a lot where a mortgage release could not be obtained and therefore should be rescinded. NOW, THEREFORE, BE IT RESOLVE® BY THE CITY COUNCIL OF THE CITY OF ®UBUQUE, IOW~4: Section 1. That the City Council hereby waives Article IV, Design and Improvement Standards of the Subdivision Regulations, except Section 42-19, Blocks and Lots. Section 2. That the Final Plat of Graf Farm Subdivision is hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa upon said Final Plat. Kritz, Associate Planner SUBJECT: Final Plat Graf Farm Subdivision, Dubuque County, Iowa INTRODUCTION The submitted final plat resubdivides property located on either side of Humke Road immediately west of Seippel road in Dubuque County. The subject property is located within two miles of the City of Dubuque corporate limits and the plat is being reviewed jointly between the City of Dubuque and Dubuque County. The City Council approved a previous Final Plat of Graf Farm Subdivision at their October 20, 2008 meeting. Subsequent to that meeting, a mortgage release for Lot 3 was not obtainable. The original final plat was not approved by the Board of Supervisors because of the lack of a mortgage release for Lot 3. Because the City Council approved the previous final plat, the original resolution approving the Final Plat of Graf Farm Subdivision must be rescinded. DISCUSSION The submitted Final Plat of Graf Farm Subdivision resubdivides 57.59 acres of land into four lots. The lots all have sufficient lot area and sufficient frontage to meet the City of Dubuque Subdivision Regulations. Two of the four lots already have residential structures constructed on them while Lot 1 and Lot 3 will be available for future development. RECOMMENDATION Planning Services staff recommends that the resubmitted Final Plat of Graf Farm Subdivision be approved subject to waiving Article IV Design Improvement Standards for the City of Dubuque Subdivision Regulations, except for Section 42-19 Blocks & Lots.
