The Civil Service Commission shall keep a record of all its meetings and also a complete
individual service record of each civil service employee which record shall be permanent and
kept up-to-date. (1976 Code, § 2-185)
Sec. 2-186. Applicants To Be Examined:
Examinations for the positions in the City civil service shall be applicable to and required of all
applicants in accordance with the Civil Service Law, namely, I.C.A. chapter 400. (1976 Code, §
2-186)
Sec. 2-187. Examinations To Be In Accordance With Statutes; Qualified
Persons To Be Certified:
The Civil Service Commission shall conduct examinations in accordance with the provisions of
the laws of the State relative thereto, and for the purpose of determining the qualifications of
applicants for positions under civil service and shall duly certify to the Council a list of the
qualified persons as set forth in I.C.A. chapter 400. (1976 Code, § 2-187)
Sec. 2-188. Procedure For Conduct Of Hearing Appeals:
Notwithstanding Sections 1-20 through 1-25 of this City Code, the Civil Service Commission
shall adopt its own rules governing the procedure for the conduct of hearing appeals. (1976

Re: Appointment to the Civil Service Board
I have been informed that there might be another opening on the Civil Service Board
again this year. In order to provide more detailed information regarding my application
for this position I am enclosing a copy of my resume' for your information.
Presently I am involved with two organizations, the Hoffmann Development Center and
Area Residential Care as a member of their operational boards. I serve as Treasurer for
the Hoffmann Board of Directors. Meetings of each of these boards are scheduled once a
month.
The reasoning behind my application for appointment to the Civil Service Board is that
I've spent my adult life in the service of my city and my country, as a police officer for
the City of Dubuque, and also as a member of the U.S. Naval Reserve. During both of
these periods it became clear to me that the quality of service to citizens begins at the
initial application and certification level. Citizens are entitled to expect the best from the
employees that serve them. From that perspective the testing and certification of the best
applicants is essential to that goal. It is my understanding that the Civil Service Board
supervises the testing and certification process that can accomplish this goal. In addition,
this board also provides testing and certification for the appointment of supervisory
positions within each department. This is another area that can result in a high level of
quality of service to each department and to the community, and another reason that I
would like to become involved in this process.

Sec. 46-66. Established:
The city does hereby create and establish a transit authority in and for the city, effective
July 1, 1975. (1976 Code, ? 38-66)
Sec. 46-67. Qualifications of Trustees:
The trustees of the transit authority shall qualify by taking their respective oaths of
office. (1976 Code, ? 38-67; Ord. 94-95, ? 1, 12-18-1995)
Sec. 46-68. Organization, Election of Officers; Adoption of Rules;
Terms:
(a) The board of trustees of the transit authority shall organize for its transaction of
business, elect from its own number a chairperson and a secretary who shall serve
for such terms as the board shall determine, not exceeding their terms of office as
members of the board, and abide by all rules and regulations that govern the
proceedings of the board.
(b) The board of trustees of the transit authority shall comprise five (5) trustees
appointed by the city council. Three (3) of the initial appointments shall be for terms
expiring July 30, 1984; one of the initial appointments shall be for a term expiring
July 30, 1983; and one of the initial appointments shall be for a term expiring July
30, 1982. Thereafter, all appointments shall be for a term of three (3) years or until a
successor has been appointed and qualified. (1976 Code, ? 38-68)
Sec. 46-69. Quorum; Majority Vote Required For Action By Board:
Three (3) members of the board of trustees of the transit authority shall constitute a
quorum for the transaction of business. All action of the board shall be by resolution and
the affirmative vote of at least three (3) members shall be necessary for the adoption of
any resolution. (1976 Code, ? 38-69)
Sec. 46-71. Powers, Duties of Board:
The board of trustees of the transit authority shall have:
(1) The power to execute agreements and act as the applicant and recipient of
federal and state grants relating to the transit system operation and the purchase of
new equipment.
(2) The power from time to time to fix and establish routes and schedules and
change the same whenever it is deemed advisable and to fix, maintain and regulate
rates, fares or charges for the transportation of passengers and any incidental
services and the rates or charges to be made for advertising in buses or any other
facility under the control of the board. (1976 Code, ? 38-71; Ord. 94-95, ? 2, 12-18-
1995)
Sec. 46-74. Meetings:
(a) The transit authority shall meet not less than bimonthly on a regularly scheduled
day.
(b) Members of the board of trustees of the transit authority shall attend at least two-
thirds (2/3) of all regularly scheduled meetings within any twelve (12) month period.
If any member does not attend such prescribed number of meetings, it shall
constitute grounds for the board to recommend to the city council that said member
be replaced. Attendance of all members shall be entered on the minutes.
(c) All meetings shall be held in conformance with the provisions of the Iowa open
meetings law.
(d) The board of trustees of the transit authority shall file with the city council a copy of
the minutes of each regular and special meeting of the board within ten (10) working
days after each such meeting. (1976 Code, ? 38-74)

system is reliable, it does need some improvement. With IBM coming to town, more
people may use the system if it is changed or services added. A lunch time shuttle from
downtown to the Locust St. Hy-Vee, for example. I also would like someway of getting
around town at night and on Sunday.

Building Code Board of Appeals
Sec. 112. Section 112, "Board Of Appeals," is hereby amended by repealing such
section and replacing such section with a new section in lieu thereof as follows:
Sec. 112. Building Code and Advisory Appeals Board.
(a) Board Established. In order to determine the suitability of alternative building
materials and methods of building construction, to provide for reasonable
interpretation of the provisions of the building code, and to advise the city council
on all building construction regulations and procedures, there is hereby created
the building code advisory and appeals board.
(b) Membership. The building code advisory and appeals board shall consist of
five (5) members appointed by the city council. One (1) member shall be an
architect or engineer registered in the state of Iowa, one (1) member shall be a
general building construction contractor, one (1) member shall be a journeyman
carpenter, and two (2) members shall be from the public at large.
(c) Term Of Office. The term of office of all board members shall be for three (3)
years, except that initial appointments of one (1) member shall be for a term of
one (1) year, two (2) members for two-year terms and two (2) members for three-
yearterms.
(d) Rules And Regulations. The board shall make such rules and prescribe such
procedures as may be reasonably necessary for its operation, except that such
rules shall include the following:
(1) Board Chairperson. The chairperson of the board shall be a member of the
board elected annually by a majority of the board.
(2) Secretary Of The Board. The building official, or designee, shall be secretary
of the board. The secretary shall arrange for meetings and prepare and keep
such minutes and records and perform such other clerical work as the board
may direct.
(3) Quorum. Three (3) members shall constitute a quorum. The concurring vote
of three (3) members of the board shall be necessary to pass any motion.
(4) Service Until Appointment Of Successor. Upon completion of the term of
office, members of the building code board shall continue to serve in their full
capacity until their successor has been duly appointed.
(5) Meetings. The building code board shall meet upon call of the chairperson,
secretary or city manager. Members of the building code board shall attend at
least two-thirds of all scheduled meetings within atwelve-month period. If any
member does not attend such prescribed number of meetings, it shall constitute
grounds for the board to recommend to the city council that said member be
replaced.
(6) Attendance. The attendance of all members shall be entered on the minutes
by the secretary.
(7) Conformity With Open Meetings Law. All meetings shall be held in
conformance with provisions of the Iowa open meetings law.
(8) Minutes. The building code board shall file with the city council a copy of the
minutes of each meeting of the board within ten (10) working days after such
meeting.
(9) Administrative Policies. All administrative, personnel, accounting, budgetary,
and procedural policies of the city shall govern the building code board in all of
its operations.
(10) Duties When Serving As An Appeals Board. Any person who is aggrieved
by a decision of the building official on any requirements resulting from the
enforcement of the building code, may appeal from such decision to the building
code board and said board shall serve as an appeal board. In case the
aggrieved party is a member of said board, said member shall be disqualified as
a member of the board acting as an appeal board, until the person aggrieved
has been heard and a decision rendered.
The appeal shall be made by the person aggrieved, giving written notice of such
appeal to the building official within seven (7) days of receipt of decision from which
the appeal is taken. The building code board sitting as an appeal board shall meet
within ten (10) working days after receiving such notice and render a decision within
five (5) working days thereafter. Any interested party, including the building official,
shall have the right to present their case to the appeal board, whose decision shall
be final unless appealed to the district court as provided by law.
The board of appeals may reverse or modify a decision of the building official only
on finding that:
a. The building official had incorrectly interpreted the provision of this code;
b. The decision of the building official creates an unnecessary hardship upon the
appellant.
The board of appeals shall require that sufficient evidence or proof be submitted to
substantiate any claims made regarding the use of alternates.
All appeal hearings shall be conducted in accordance with the procedures specified
in this code.
(e) Limitations Of Authority. The board of appeals shall have no authority relative to
interpretation of the administrative provisions of this code nor shall the board be
empowered to waive requirements of this code.
In so modifying or reversing such decision of the building official, the board of
appeals may authorize any alternate to the decision of the building official and the
provisions, provided it finds the proposed material or method of construction is
satisfactory for the use intended and complies with the provisions of this code, and
that the material, method or work offered is, for the purpose intended, at least
equivalent to that prescribed by this code in suitability, strength, effectiveness,
durability, fire resistance and safety.

Chapter 30
Sec. 30-1. Board of Trustees-Composition:
The Carnegie-Stout free public library of the city shall be under the control and direction of the
board of library trustees. Such board shall consist of seven (7) members who shall be
appointed by the mayor with the approval of the city council. (1976 Code, § 23-1)
Sec. 30-2. Board of Trustees-Eligibility For Membership:
Citizens and residents of the city, male or female, over the age of eighteen (18) years, are
alone eligible for membership on the board mentioned in section 30-1 of this chapter. (1976
Code, § 23-2)
Sec. 30-4. Board of Trustees-Terms Of Members; Filling Of Vacancies:
Each member of the board described in section 30-1 of this chapter shall hold office for four (4)
years and until such member's successor is appointed and qualified. The term of office of any
member shall commence July 1 in the year in which the member is appointed. Vacancies
occurring on the board through death, resignation or permanent removal from the city shall be
filled by the mayor with the approval of the city council, but such appointments shall be made
to fill out the unexpired term for which the appointment is made. (1976 Code, § 23-4; Ord. 92-
95, § 1, 12-18-1995)
Sec. 30-5. Board of Trustees-Powers And Duties Generally:
(a) The board of library trustees described in section 30-1 of this chapter shall have and
exercise the following powers:
(1) To meet and organize by the election of one of their number as president of the board,
and by the election of a secretary and such other officers as the board may deem
necessary;
(2) To have charge, control and supervision of the public library, its appurtenances and
fixtures, and rooms containing the same, directing and controlling all the affairs of such
library;
(3) To employ a librarian, such assistants and employees as may be necessary for the
proper management of said library, and fix their compensation; but, prior to such
employment, the compensation of such librarian, assistants and employees shall be fixed
for the term of employment by a majority of the members of said board voting in favor
thereof;
(4) To remove such librarian by a vote of two-thirds (2/3) of all of the members of the board
and to provide procedures for the removal of assistants or employees;
(5) To select and make purchases of books, pamphlets, magazines, periodicals, papers,
maps, journals, furniture, fixtures, stationery and supplies for such library;
(6) To authorize the use of such libraries by nonresidents of the city and to fix charges
therefor;
(7) To make and adopt, amend, modify or repeal bylaws, rules and regulations, not
inconsistent with law, for the care, use, government and management of such library and
the business of said board, fixing and enforcing penalties for the violation thereof;
(8) To have exclusive control of the expenditures of all taxes levied for library purposes as
provided by law, and of the expenditure of all monies available by gift or otherwise, for the
erection of library buildings and of all other monies belonging to the library fund;
(9) To contract with the trustees of the township or the board of supervisors of the county or
of adjacent townships or counties, or with the trustees or governing bodies of neighboring
towns or cities not having library facilities for the public, to loan the books of said library,
either singly or in groups, upon such terms as may be agreed upon in such contract.
(b) The board shall keep a record of its proceedings. (1976 Code, § 23-5; Ord. 28-04, § 1, 4-
19-2004)
Sec. 30-6. Board of Trustees-To Have Charge Of Building, Donations:
The library board of trustees shall have charge and control of the Carnegie-Stout free public
library building and all gifts and donations to the city for library purposes, and see that the
same are properly preserved for public use. (1976 Code, § 23-6)
