Van Milligen, City Manager SUBJECT:Acceptance of Public Improvements Elmwood Green Subdivision Public Works Director Mike Koch is recommending acceptance of the public improvements that the developer, Joe Graham, has recently completed in Elmwood Green Subdivision. Maintenance of said improvements shall be the responsibility of the contractor and the owner, Joe Graham, for a period of two years from the date of acceptance. I concur with the recommendation and respectfully request Mayor and City Council approval. Koch, Public Works Director SUBJECT:Acceptance of Public Improvements in Elmwood Green Subdivision INTRODUCTION The enclosed material provides for City Council acceptance of the public improvements which the developer, Joe Graham, has recently completed in Elmwood Green Subdivision. BACKGROUND As a condition of subdivision plat approval through Resolution No. 201-97, the developer of Elmwood Green Subdivision was required to install certain improvements including street paving, storm sewer, stormwater detention, sanitary sewers, watermain and street lighting, and to dedicate the improvements to the City upon completion. The developer of Elmwood Green Subdivision, Joe Graham, has recently completed the improvements and has formally requested the City's acceptance of the public improvements which have been installed. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On June 3, 2002, Joe Graham, requested City's acceptance of the improvements in Elmwood Green Subdivision. Upon inspection by the City, it has been determined that all of the public improvements required by Resolution No. 201-97 have been completed in accordance with plans approved by the City Council and in conformance with City specifications. RECOMMENDATION I would therefore recommend that the City Council accept the improvements. Maintenance of said improvements shall be the responsibility of the contractor and owner, Joe Graham, for a period of two years from the date of acceptance by the City Council. ACTION TO BE TAKEN The City Council is requested to adopt the attached resolution accepting the improvements. CC:Robert Green, Water Department Manager Don Vogt, Operations/Maintenance Manager RESOLUTION NO. 31-03 ACCEPTING IMPROVEMENTS IN ELMWOOD GREEN SUBDIVISION Whereas, pursuant to Resolution No. 201-97 certain improvements including street paving, storm sewers, stormwater detention, sanitary sewers and watermain and street lighting were installed by the developer of Elmwood Green Subdivision; and Whereas, the improvements have been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the improvements b'e accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said improvements in EImwood Green Subdivision be and the same is hereby accepted. Section 2. That maintenance of said improvements shall be the responsibility of the contractor and the owner for a period of two years from this date. Passed, approved and adopted this 3rd dayof Februarv ,2003.
